The applicant seeks the following development standards variance approval:
Docket No. 07010015 V Section 7.04.03.D rear yard setback
The site is located at 11815 Eden Glen Dr., and is zoned R-1/Residence. Filed by Garry L. Lyons.
General Info:
The petitioner is
seeking variance
approval for the rear
yard setback of a
proposed garage, which
will be an addition to
an existing single
family house.
Analysis:
The zoning ordinance
requires a rear yard
setback of 20 feet in
the R-1/Residence district. When a garage is attached to the principal structure, it must follow the same
setback requirements as the principal structure. The petitioner is proposing a rear yard setback of 13 feet,
which is a difference of7 feet. (If the garage were proposed to be 10-ft or greater from the house, then it
could have a side and rear yard setback of 5-ft.)
Findings of Fact: garage setback
1.) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: The petitioner is proposing a setback of 13 feet, which is a
difference of7 feet. If the garage were proposed to be lO-ft or greater from the house, then it could have a
side and rear yard setback of 5-ft.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: The petitioner is proposing a setback of 13 feet,
which is a difference of 7 feet. If the garage were proposed to be lO-ft or greater from the house, then it
could have a side and rear yard setback of 5-ft.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the lot is irregularly shaped, and the placement
of a garage is difficult. The petitioner may not be able to place a garage on the site.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. 07010015 V.
