ORDINANCE D-2697-23
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING CHAPTER 9, ARTICLE 6, SECTIONS 9-224 AND 9-231(k) OF THE CARMEL
CITY CODE
Synopsis: Sets the monthly residential Solid Waste Removal and Recycling rate for the City of
Carmel from January 1, 2024 to December 31, 2030.
WHEREAS, Carmel Ordinance D-2053-11 established, subject to the control of the Carmel
Board of Public Works and Safety (the “Board”), the Division of Solid Waste (the “Division”) and
enabled it to exclusively provide Solid Waste Removal and Recycling services to City residents;
WHEREAS, the current agreement with the private contractor under which City Residential
Solid Waste Removal and Recycling services are been provided expires on December 31, 2023;
WHEREAS, in order to obtain the most competitive prices for Carmel residents and pursuant to
Indiana Code § 36-9-30-5 and Carmel City Code Section 9-228, the Carmel Board of Public Works and
Safety (the “Board”) solicited bids from private contractors for Residential Solid Waste Removal and
Recycling services to begin on January 1, 2024;
WHEREAS, the sealed bids to provide Residential Solid Waste Removal and Recycling
Services were opened at the Board meeting on October 4, 2023;
WHEREAS, Republic Services was the lowest responsive and responsible bidder;
WHEREAS, the Board shall execute a contract with Republic Services to exclusively provide
Solid Waste Removal and Recycling services to City residents; and
WHEREAS, it is in the interest of public health, safety and welfare to set the rates for
Residential Solid Waste Removal and Recycling services beginning on January 1, 2024.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are fully incorporated herein by this reference.
Section 2. Chapter 9, Article 5, Section 9-224 of the Carmel City Code shall be and the same is
hereby amended to read as follows:
“9-224 Effective Date of Service
The charges fixed by this Article shall become effective against a residential unit on
January 1. All residential units shall be subject to the charges on January 1, 2024, subject
to the provisions of § 9-226 below.”

Section 3. Chapter 9, Article 5, Section 9-226(k) of the Carmel City Code shall be and the same
is hereby amended to read as follows:
“(k) Rates and charges. Customers shall pay the rates and charges per month as follows:
2024 2025 2026 2027 2028 2029 2030
$14.70 $15.35 $16.03 $16.74 $17.48 $18.25 $19.07
Section 4. The remaining sections of Carmel City Code Chapter 9, Article 5 are not affected by
this Ordinance and shall remain in full force and effect.
Section 5. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section 6. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.
