Docket No. 166-02 Z; Pennsylvania and 122nd Street - Northeast Corner The applicant seeks to rezone 28.378 acres zoned R-l (Residential) and M-3 (Manufacturing) to B-6 (Business). The site is located at the northeast comer of 122nd Street and Pennsylvania Road. Filed by Blair D. Carmosino of Duke Realty Corporation. The applicant is requesting a favorable recommendation from the Plan Commission on their petition to rezone 28.378 acres zoned R-l (Residential) and M-3 (Manufacturing) to B-6 (Business). The Department feels that the following issues need to be addressed prior to the Plan Commission forwarding the petition to the City Council: 1. Please provide a proposed Ordinance for review by the Department. The role the Plan Commission is performing in this matter is to forward a recommendation on to the City Council for final action. 2. 122nd Street: a. The Ordinance requires a 70' half ROW along 122nd Street. The plans show 35'. The Department will request that additional real estate be dedicated up to the 70' shown on the Thoroughfare Plan. Please prepare documentation for the dedicationofthat ROWand address this in your proposed Ordinance. b. Again, what you have submitted is a conceptual plan. It is likely that future drive cuts along 122nd Street shall align with existing cuts across the street. Do not rely on the Plan Commission reviewing these plans as a guarantee of future acceptance. 3. Pennsylvania Street: a. The ordinance requires a 60' half. The Department will request that additional real estate be dedicated up to the 60' shown on the Thoroughfare Plan. Please prepare documentation for the dedication of that ROWand address this in your proposed Ordinance. b. The City is currently committed to making improvements to both Pennsylvania Street and 122nd Street (City Center Drive) across the subject frontage. With the City in a position to make these improvements it would not be unreasonable for the petitioner to commit to some level of assistance in this effort including offsetting the cost of landscaping and path/sidewalk across the frontage and at the roundabout at the north end of the property. 4. Development Plan (DP) Approval: a. The proposed B-6 zone does not require DP approval. The current M-3 zoning does require this. It is the desire of the Department that the applicant commits to file for and obtain DP approval for the development of this real estate. Please incorporate language into your ordinance addressing this commitment. The Department recommends that this item be forwarded to the Special Studies Committee on January 7th for further discussion.
