The applicant seeks the following development standards variance approval: 3. Docket No. PZ-2024-00030 V UDO Section 2.06 Maximum 35% lot cover allowed, 47% requested. The site is located at 11033 Lakeview Dr. (adjacent to The Woodlands subdivision). It is zoned S2/Residence. Filed by Robert Moran of Moran's Lawn Care on behalf of Brent and Davela Dilts, owners. General Info: • The Petitioner seeks approval for deck and patio additions in the back yard. • Variance is requested for exceeding the maximum allowed lot coverage. • The site is not technically located in any platted subdivision, and so an HOA (Homeowners Association) does not exist. However, it appears that The Woodlands subdivision has “adopted” this lot, and they have also provided an HOA approval letter. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Lot Coverage - • The UDO allows for a maximum 35% lot cover, and 47% is requested. This is a 12% increase. • A 664 sq. ft. patio deck will be added to the northeast section of the lot, and front on the lake. • A 448 sq. ft. deck (32-ft by 14-ft) is also proposed along the north side of the house, also fronting the lake. • The house and large driveway area were originally constructed in the late 1970s. • Even if this site is considered grandfathered (or legally nonconforming), any new improvements or development installed today needs to comply with the current zoning ordinance standards, hence the need for the variance request. • The Carmel Engineering Dept. has no issue with the requested lot coverage variance. Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request, since the Carmel Engineering Dept. has no concerns. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
