These typically show up on the actual permit, but I thought you might need to know ahead of time in case the fence company needs to make changes to the style of fence. If you want a fence taller than 6-ft, you would need to apply for a Development Standards Varia from UDO Section 5.09 C. With variances, you have to prove a practical difficulty or hardship as to why you cannot comply with the Zoning Ordinance regulations. Planning Staff can be supportive of having your item heard by a BZA Hearing Officer, rather than the full 5-member Board of Zoning Appeals. Hearing Officer Variance items have a lesser filin fee, a more compressed timeline, and are more likely to be approved. I have attached a Handout about the Board of Zoning Appeals (BZA) Hearing Officer Development Standards Variance process that contains instructions, a checklist, templates, affidavits, etc However, the official creation and filing of the BZA Hearing Officer Development Standards Variance (Single Fam) application must be done on the online application portal. Then few days after that, you or whomever is listed at the ProjectDox/ePlan contact person will get invited to the project via email and will also receive an Applicant Upload task. That is where you/t will upload things like an aerial photo, site plan with location of fence, photos of the fence, findings of fact, etc. (ProjectDox is our online plan review software.) The BZA webpage contains things like the Calendar, Flowchart of the Process, and more. Fees associated for a BZA Hearing Officer petition: Filing Fees for Single-Family Residential = $207.25. Public notice requirements are spelled out in the attached handout, but they include: Public Notice sign placed in the yard, viewable from street, 10 days prior to your meeting date. Mailed public notices via Certificates of Mailings to your adjoining property owners need to be mailed out 10 days prior to your meeting date. You would obtain the Official Adjoiners List here. Legal Ad of your public notice is sent to the Current in Carmel. NOTE: The Current in Carmel has different deadline (not 10 days) to submit your public notice, but they will publish your public notice on a Tuesday, prior to the 10-day deadline. I am attaching a photo of our survey showing the placement of the current backyard fence. I reviewed the approved Variance examples (specifically the Brennan and Folley residence, as they pertained to backyard fences), and it appears we are in a similar situation. In one of the correspondence files on the Brennan case, he had said "...upon a quick google view by your staff I was told the likelyhood of that variance was high based on the backyard" Would you be able to weigh in similarly for our case? It sounds like we would have a similar request to the Brennan case: we are surrounded by residential family houses, and with out house on a hill, I know our neighbors would be more than happy to have a visually aesthetic privacy fence installed. But would like to get your feedback before moving forward with the variance request: would hate to waste anyone's time if you think we are barking up the wrong tree.
