RECOMMENDATION ON THE PETITION OF THE CITY OF CARMEL
TO AMEND THE CARMEL/CLAY ZONING ORDINANCE
PURSUANT TO INDIANA CODE 36-7-4-605

An Ordinance to Amend most chapters of the Zoning Ordinance in order to add new provisions and
make several corrective amendments.

The Carmel Advisory Plan Commission offers you the following report on the application to the
Commission (Docket No. 150-02b OA) to Amend Chapters 1: Title, Purpose, Authority and
Jurisdiction; 2: Compliance with the Regulations; 3: Definitions; 4: Districts & Boundaries; 5: S-
l/Residence District; 10: R-4/Residence District; 11: R-5/Residence District; 12: B-l/Business District;
13: B-2/Business District; 14: B-3/Business District; 15: B-4/Business District; 16: B-5/Business District;
17: B-6/Business District; 18: B-7/Business District; 19: B-8/Business District; 20A: I-I Industrial
District; 20B: M-l/Manufacturing District; 20C: M-2/Manufacturing District; 20D: M-3/Manufacturing;
20E: C-l/City Center; 20F: C-2/0Id Town; 20G: OL Old Meridian District; 23A: SR 431/Keystone
Avenue Overlay; 23B: US 31/Meridian Street Overlay; 23C: US 421/Michigan Road Overlay; 23D: Old

of the Zoning Ordinance in order to add new provisions and make several corrective amendments.
The Carmel Advisory Plan Commission's recommendation on the petition is FAVORABLE.
At its regular meeting on July 20, 2004, the Commission voted seven (7) in Favor, zero (0) Opposed, zero
(0) Abstaining, to forward to the Common Council the proposed Ordinance No. Z-453-04 with a
Favorable Recommendation.
Please be advised that by virtue of the Commission's Favorable Recommendation, pursuant to IC 36-7-4-
607(e)(3), the Council has ninety (90) days to act on this petition before it becomes effective as Certified
by the Commission. Ninety days from the date of the original Certification (July 21,2004) is Tuesday,
October 19, 2004.

NOTICE OF ADOPTION OF
AN AMENDMENT TO THE CARMEL/CLA Y
ZONING ORDINANCE
Notice is hereby given to the taxpayers of the City of Carmel and Clay Township,
Hamilton County, Indiana, that the proper legal officers of the City of Carmel met at their regular
meeting place, Council Chambers, Carmel City Hall, One Civic Square, Carmel, IN 46032, at
7:00 p.m. on Monday, the 16th day of August 2004, and adopted the following:

Ordinance No. Z-453-04 affects all properties within the City of Carmel and Clay
Township in Hamilton County, Indiana.
Ordinance No. Z-453-04 does not amend any provision of the Carmel/Clay Zoning
Ordinance regarding penalties or forfeiture prescribed for a violation of the ordinance.
The entire text of Ordinance Z-453-04 is available for inspection in the Department of
Community Services, Division of Planning & Zoning, Third Floor, Carmel City Hall, One Civic
Square, Carmel, Indiana; and in the Office ofthe Clerk-Treasurer, Third Floor, Carmel City Hall,
