FIRST AMENDMENT TO THE
CONDOMINIUM DECLARATION FOR
MAGNOLIA CONDOMINIUMS
IN
THIS FIRST AMENDMENT TO THE CONDOMINIUM DECLAMATION FOR
MAGNOLIA CONDOMINIUMS (this "Amendment") is made as of this p�_ day of March

LLC, an Indiana limited liability company ("Ueclarant41-9),
rive, Suite 100, Carmel, Indiana 46032
under the following
A. Pursuant to that certain Condominium Declaration for Magnolia Condominiums
(the "Declaration") recorded as Instrument No. 2023016103 in the Office of the Recorder of
Hamilton County, Indiana (the "Recorder's Office") and that certain Secondary Plat (the recorded
as Instrument No. 2021052858 recorded in the Recorder's Office,, Declarant created Magnolia
Condominiums and imposed certain covenants, restrictions and easements on certain real property
owned by Declarant located in the City of Carmel, Hamilton County, Indiana and more particularly
described in Exhibit A attached to the Declaration (the "Pro e ").
B. Pursuant to Section 8 of the Declaration, Declarant reserved for itself the right to
expand the Property and subject certain additional real estate to the terms and conditions of the
Declaration and provide for any additional restrictions on such property as Declarant deems
necessary.
C. Declarant desires to amend the Declaration to expand the Property to include Lot
2A, as more particularly described herein.
NNOW,fTHEREFORE, or valuable consideration paid, the receipt and sufficiency of which
is hereby acknowledged, Declarant hereby amends the Declaration as follows:
1. Additional Property. The real property described in Exhibi005000�t A attached hereto and
made a part hereof is hereby submitted to the terms and conditions of the Declaration (the
"Additional Propertv"), Floor plans for the Additional Property have been recorded as Instrument
No. 90,9 4 010 a / in the Recorder's Office.
2. Adjustment of Percentage Interestsmm�. Pursuant to Section 8(b) of the Declaration,
Exhibit C in the Declaration is hereby amended to reflect the Percentage Interests appertaining to
each Condominium Unit, including the Additional Property and shall be replaced in its entirety
with Exhibit C attached hereto. The adjusted Percentage Interests shall vest upon recording of this
Amendment.
3. General., Except as modified by this Amendment, the Declaration remains in full
force and effect. The Declaration, as modified by this Amendment, is ratified and confirmed.
