BPW 04-03-24-02 A RESOLUTION OF THE CITY OF CARMEL BOARD OF PUBLIC WORKS AND SAFETY AUTHORIZING DEPARTMENT HEADS TO ENTER INTO MUTUAL AID AND OTHER NON- MONETARY RECIPROCAL AGREEMENTS Synopsis: This resolution authorizes certain Department Heads to enter into Mutual Aid and other non-monetary reciprocal agreements on the Board’s behalf. WHEREAS, pursuant to Indiana Code 36-8-3-2(b), Carmel Board of Public Works and Safety (the “Board”) has exclusive control over all matters and property relating to the police and fire departments; and WHEREAS, pursuant to Indiana Code 36-8-3-2(d), the Board may adopt general and special orders to the police and fire departments through the chiefs of the departments; and WHEREAS, from time to time, Indiana police and fire departments and/or other governmental entities wish to enter into mutual aid and other non-monetary reciprocal agreements to enhance and improve public safety within and across Indiana communities (collectively “Reciprocal Agreements”); and WHEREAS, the Police and Fire Chiefs have requisite expertise and experience to evaluate the need and scope of such Reciprocal Agreement; and WHEREAS, the Board now desires to authorize Carmel Police and Fire Chiefs to enter into Reciprocal Agreements on the Board’s behalf. NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Board of Public Works and Safety, that: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. The Board hereby authorizes Carmel Police and Fire Chiefs to enter into non- monetary Reciprocal Agreements on the Board’s behalf. Section 3. Prior to execution, all Reciprocal Agreements shall be reviewed and approved by the Office of Corporation Counsel. Section 4. This Resolution shall be effective from and after adoption by the Board.
