I was say yes on the hold but under the premise that we are verifying there is not
easement encroachment issues. If it is not in our easement, I donlt really think we have
any jurisdiction to tell them they canlt install the pool. The complaining neighbor ~ants
us to stop it because of the increase in Stormwater runoff, but where does that stop? Do
we need to have and review permits for every pool, basketball court, swing set, and even
sandbox. The request is beyond what reasonable authority we have but I do want to protect
our infrastructure. Does that make sense? If you have any questions, please let me know.

Bill asked me to ask you some additional questions from your e-mail. (He's out on
inspections right now.)
The permit for the pool has not been issued yet, but the builder, Blue Haven Pools, has
been notified that it is ready for pick-up. Do you want us to hold this from being issued
until you have a chance to look into the drainage issues? We can do that. Without the
permit, they can1t start any work.

I am guessing you just talked to a resident in Huntersfield about his neighbors pool. Can
you send me a copy of the pool permit for the neighbor? I want to make sure that is does
not affect our drainage facilities or encroach into our Regulated Drain Easement. If you
have any questions, please let me know.

Hello, all.
Due to some neighbors' complaining about a potential pool going into their area, the permit application for a pool
at 3597 Hounds Crossing (Lot 8 Huntersfield) has been placed on a Do-Not-Issue Hold at the request of Greg
Hoyes, a plan reviewer for the Hamilton County Surveyor's Office. The builder is Blue Haven Pools, and the
owners are Mike and Shelly Reffeitt. The permit was approved for issuance, and we notified Blue Haven by e-
mail on January 23rd (No, they haven't picked it up, yet.)
The issues are whether or not the pool and/or decking are within the easements and whether or not the runoff
from the pool and/or decking will create drainage issues.
So, Greg Hoyes is going to investigate and let us know, because it is within a Hamilton County Drain Protection
Area. (This property is outside of the City limits.)
I am removing this application from the ready-to-issue drawer and putting it in the hold drawer-bottom drawer
under the Okidata dot matrix printer.

I called and talked to Denise. She is ready to get the project going, now that it's
warmer and was planning to come in to get the permit next week. 80, I told her that we
canlt issue it until we1ve heard from the County inspector, most likely on Monday. r; also
told her that if there isn't anything out of the ordinary, then I expected that she would
be able to get the permit next week, anyway, and that we just need to check this out
first.

Just let blue haven know we came across an issue and the surveyors office is looking into
it for a possible elevation change or a drainage system to divert water from the neighbor

Thanks for the hold on this. I have looked it over and it appears they are not in the
easement and are just right up to it. That really takes an legal jurisdiction we would
have out of the picture. Now, in regards to the drainage, I am still looking into that
and need to talk to our inspector that went out there today. I won't see him again until
Monday, but I think we can make some "recommendationsl1 on how to make the water drain away
from the complaining neighbor. I will let you know more on Monday. If you have any
questions, please let me know.

I have talked to the inspector that visited the sight and here is what we came up with as
the official stance from our office.
Based on the plans with the permit, the pool is not in our easement and therefore, we have
no jurisdiction over the pool itself. In regards to the drainage issues the neighbor. had,
HCSO does not feel that we have any jurisdiction over somebody installing a swimming pool
and increasing the runoff. Our storm sewers are designed to handle the runoff that comes
from a typical subdivision and adding a swimming pool is not uncommon. The neighbor
believes that the increased runoff with cause him problems, but based on the design and
field verification, the water runs to the SW corner of the permit applicants lot, which is
were our storm inlet is located. In a effort to "prevent 11 further "drainage problems", we
would recommend the pool installer direct all the storm water runoff to the SW corner of
the lot and if need be, do some minor regrading to direct the water directly to the storm
inlet that is behind the berm. This should remove any runoff issues from affecting the
neighbor's lot, and if not, then this really is a "private" issue between two neighbors to
resolve.
With that information, HCSO would ask that any holds on the pool permit be released and
the project be allowed to move forward. If you have any questions, please let me know.
