DEVELOPMENT STANDARDS VARIANCE 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: it results in a reduction in the amount of signage currently on the building 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: it results in a reduction in the amount of signage currently on the building. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the petitioner will be penalized for making improvements to the property through a decrease in allowable signage to meet the current sign standards. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. 07020025V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. Solada, Esq. Statement of Variance and Statement of Support I. Proiect Overview The petitioner seeks to replace two existing signs at 2290 E 116th Street with two new signs. A third existing sign will be removed. The property is currently a two. tenant structure, occupied in part by Hamilton Beverage, one of a family of stores operated by United Package Liquors. The second tenant space is currently occupied by Verizon Wireless but will soon be vacated. Hamilton Beverage plans to remodel the existing building, eliminating the second tenant space in order to occupy the building in its entirety. As part of this remodel, Hamilton Beverage would like to update its signage. Two signs are currently located on the 116th Street frontage, one above each tenant space. A third sign faces a private drive to the east. There is no freestanding signage. The signs do not conform to the current Ordinance standards but received a variance in the late 1970s. Hamilton Beverage proposes to keep one sign on the 116th Street frontage, and one sign on the eastern elevation. While the total sign area on the building would be reduced through the elimination of the second tenant sign, the new signs exceed the maximum area permitted. II. Statement of Variance Variance 07020025V: Maximum Si!!n Sauare Foota!!e Petitioner requests a variance of Ordinance ~ 25.07.02-08(c)/Sign Chart A to allow a total sign area of 176.73 square feet. (123.03 square feet oriented to 116th Street and 53.7 oriented to the east). The total area permitted is 45 square feet (45 square feet oriented to 116th Street and zero square feet oriented to the east). . Note: Carmel's Ordinance measures sign area as the maximum vertical dimension of the sign times the maximum horizontal dimension of the sign. The unique shape of these proposed signs therefore results in a large amount of air being counted as part of the sign area. The total proposed area of actual signage is 85.49 square feet on the 116th Street elevation and 38.55 square feet on the eastern elevation. Variance 07020026V: Si!!n Oriented East Petitioner requests a variance of Ordinance ~ 25.07.02-08(b) to permit a sign on the east elevation of the building. This elevation is oriented to a private (not public) street. The proposed sign replaces an existing sign in this location. o o o o o o o o o D o o o D D o o ~ ~ III. Statement of Support Hamilton Beverage is a longstanding member of Carmel's retail community. The improvements it plans to make to its building will result in a face-lift to an older building along one of Carmel's most traveled corridors. Likewise, the replacement of the old signage will significantly enhance the appearance of the building. However, to require a significant reduction in the amount of Hamilton Beverage's signage as a result of the improvements would result in a major setback for the business desirous of providing improvements to one of Carmel's more established retail areas.
