This evaluation is intended to assess the level of compliance with 327 lAC 15-5 (Rule 5). It is also intended to identify areas where
additional measures may be required to control erosion and sedimentation. All practices recommended in this report should be
evaluated as to their feasibility by a qualified individual with structural practices designed by a qualified engineer.
All erosion and sediment control measures shall meet the design criteria, standards, and specifications outlined in the "Indiana
Handbook for Erosion Control in Developing Areas" or similar guidance documents.
Current Site Information: Mass grading is nearly completed. Storm sewer is installed. Most buildings
are under construction and many of the gravel or paved lots are established. Paving has continued on
Rangeline Road. The northern stormwater basin is complete. The fill area on the south side of
Rangeline Rd. is to final grade but not seeded. Dirt work north of Walter Road is not seeded or
stabilized. The detention basin north of the creek has not been finished. Sediment storage has been
restricted by not completing the two basins as scheduled. The construction schedule has the two
Stormwater basins completed before the storm sewer is installed. Some of the disturbed areas at the
south end of the site have been mulched. The large stock pile at the north end has not been mulched.

utilized on all sites. Sediment tracked into the street shall be removed (do not flush with water) at the
end of each work day.

The City has engaged Crossroad Engineers, PC, to review storm drainage plans and drainage calculations
for all projects submitted to the Department of Engineering for review/comments. Please find the attached
copy ofthe Crossroad review completed on May 17, 2004 for the revised Sheets C4.1 and C4.2. Please
provide written responses to the comments provided by Crossroad Engineers, PC as they relate to Sheet
C4.1 (revision date of March 5, 2004) and Sheet C4.2 (revision date of March 26, 2004).

It appears that thereis over 15 acres oj developed ground not accountedJor in
the detention calculations. The pre-developed condition exhibit and data show a
-iotal oJ 73. 69 acres, "while the proposed exhibit and data only accountJor 57.95
acres. Please explain why the main boulevard is included within the existing
basinJor calculating the allowable outflo'rl' rate, but its area is not considered in
the proposed condition inflow rate. Please explain why this area is not being
diverted through any detention.
Based on the letter dated March 29, 2004 it appears that the storage volume
within the proposed wetlands has been eliminated, but the stage elevations Jor
Pond J have been revised accordingly. Without stage/storage dataJor the
wetlands or Pond J, an exact check could not be made to see if storage is
adequate; however, the detention areas were modeled in AutoCAD based on the
contours shown on the construction plans. It 'was approximated that the volume
of the 'wetlands (from 815.50 to 818.04) was 135,400 cft, ...vhile the volume of
Pond 1 (from 818.04 to 819.81) is only 106,250 cft. Therefore, it appears that
there is a deficiency of approximately 29,150 cft of storage. Based on these
assumptions, it does not appear that the revised 100 year flood elevation is
correct, especially considering that the outlet weir 'was raised and reduced in size.
The revised calculations were not available for reviell/, so they should be supplied
and clearly show the revised detention calculations including the outlet structure
output report and the stage/storage/discharge report for Pond 1.
o Drainage Calculations
There are no pipe sizing calculations offeredfor Structure Nos. 101 through 188.
Please supply rational method pipe sizing calculations, including the local
drainage basin map, for these structures.
o Pipe Design - 10 yr flood
Yes, the pipes were designedfor a 10-year flood.
o Pipe Slopes / Velocities (2.5 fps min, 10 fps max)
Minimum pipe velocities hm'e been met for structures included within the drainage
calculations; however, a check of the runs between Sir. No. 173 to Sir. No. J 68 and
between Str. No. 168 to Str. No. 165 both exceed the maximum of lOfps. Please revise
the runs so as to maintain a maximum velocity of J 0 fps.
There are a number of runs on the plans that are sho'wn to be placed at aflatter slope
than what the drainage calculations specify. As close as some of the designflows are to
the full flow capacities. all runs should be reviewed and calculations should be tpdated
showing adequate pipe sizingfor the designed slope.

The OUtjlOH' structure for the Pond is listed as STR. 644 in the Storm Sewer
Profile; however, this structure is listed as STR. 643 in the Storm Sewer Profile
and the Drainage Calculations.

There are a number of pipe runs that call out a smaller pipe diameter in the plans
than what the drainage calculations state. Specifically: 10A, 13, 16, 19, 32, 34,
36, 38, 57, 57A, and 69 are all listed smaller on the plans than in the calculation
report. All pipe runs should be reviei-\'ed to ensure adequate pipe sizing is
accomplished.

Thanks for taking the time to return my email. I trust you had an enjoyable holiday.
I appreciate your offer to meet, but unless it is to tell me how you plan to remove
the high traffic road now in the plans just 50 ft. from our subdivision property line,
I'm not sure I see the point of spending further time on this with you. I am
confident you understood our initial concerns at the outset when we objected to enabling
a short cut for the high school kids to take around the perimeter of your property as they
come back across Meridian on Rangeline from the high school and bypass the
center lane of traffic in favor of taking the short cut along the back of the property
line on the western border of the proposed development, exiting onto 146th.
This enables high traffic counts to go very close to our property fine
creating another source of traffic noise as well as creating a dangerous intersection with
constant exit traffic only 250 ft. from our subdivision entrance. Your understanding
of this was evidenced by the fact you removed this exit from your plans prior to the
rezone hearing as per our neighborhood wishes, funnelling all traffic back onto the 5 lanes
available on the new Rangeline Road through the middle of the development.

I don't know what else can be said, either it's in as it stands now or out as per our initial
understanding when you changed the plans to accommodate us and win our support for
your rezone. Either you can see your way clear to stick your original representations
or you don't. Seems pretty straight forward to me. A further explanation of your
position isn't going to protect our property values.
I have a question for you on your interpretation of the "Notification Ordinances" within the
Carmel City Limits. In my initial consult with a partner in a prominent Indianapolis law firm,
he seemed to think the notification statutes provided that notice should be given to anyone
in the neighborhood within the greater of 2 city lots or 600 ft. I told him if that were the

case that there are several of my neighbors at the 425 ft. mark from your development
that did not receive the original rezone notice or any other subsequent notices. These
folks are pretty upset they haven't been notified as they are on wells, also and would have
remonstrated against the retention ponds. I offered to my legal counsel, that surely with all
the resources you had expended on this so far, having had us in for meetings on three separate
occasions with your entire legal staff present and all the investment you had made on
optioning the land that I was confident you would have done your homework on this,
as this would be grounds for the entire rezone to be set aside. I couldn't imagine that would
be the case. He said he would check on it for me after the first of the year, but I was curious to hear
your take on this. I see that you are interpreting it as an "either/ or" situation not lithe greater of'
as he did on my initial meeting.

Relative to your ongoing study of the US31 corridor north of 1-465, our site consultant had the
opportunity to recently (12/3/02) review with Parsons the current schematics being considered by
them as possible interchange geometric options. We recognize other options may also be
considered prior to submittal of the DEIS and subsequent Public Hearing.
The three schematics could be generally described, as they affect our development; i.e., the SW
quadrant of 146th and US31, as follows:
I. MIS Study Plan, providing a SB US31 entrance/exit to new Rangeline Road south of 146th
Street to the west, with "Y" R/W take shown.
2. A SB loop ramp from US31, with loop in the SW quadrant of 146th and US31. This loop
along with a SB "on" leg would eliminate Rangeline Road connection to 146th Street from
south.
3. A "tight diamond" interchange ramp system, providing SB "on" to US31 from 146th Street at
our project's location, the SW quadrant of 146th and US31.
You need to be aware of fact that our development plan allows for future R/W considerations per
the available schematic plans for both first and third alternative as identified above. Our
buildings and parking, as currently presented will not be compromised by either of these
schemes.

Below are correlated itemized responses to above stated letter are as follows:
1. Kick off meeting with the Hamilton County Engineers and their consultants were held on
November 27, 2002 to discuss Rangeline Road. The Rangeline Road design will incorporate
the Traffic Study, which was part ofPUD package. Once the Rangeline Road design
document is ready for issuance, we will forward necessary copies for your review and
comment.
2. Although "Plat Vacation of Walter's Plaza Replat" was submitted, timing of approval may be
past PDP review and approval by the Plan Commission on December 17, 2002. Therefore
we request Plan Commission's review and approval is based on ratification of "Plat Vacation
of Walter's Plaza Replat".
3. "Plat Vacation of Walters Rolling Acres" will be submitted, timing of approval may be past
PDP review and approval by the Plan Commission on December 17,2002. Therefore, we
request Plan Commission's review and approval based on ratification of "Plat Vacation of
Walters Rolling Acres".
4. The current site plans dated December 5, 2002, will reflect following:
. North detention pond will encroach into Frontage Road R-O- W and future US31 off ramp
easement. We will reconstruct the detention pond, maintaining designed capacity, if
INDOT pursues US31 off ramp in lieu of 146th Street off ramp.
. Sliver of southern parking lot, east of Rangeline Road, encroaches into the Frontage Road
R-O- W.
We will apply for the Encroachment Permit for the above stated items. We request that Plan
Commission's review and approval is based on issuance of the Encroachment Permit.

6. Preliminary Development Plan review comments:

We received your comment letter dated November 19,2002. The following are responses to
each of your comments. Corrections to the plans have been made where appropriate.
1. An 85-foot half right-of-way section is already noted along 146th Street east of
Rangeline Road. The half right-of-way section to the west of Rangeline Road is less
than 85 feet.. Lauth has agreed to dedicate the necessary land to make an 85-foot half
right-of-way section. The plans note this.
2. The path east of Rangeline Road has been moved south out of the limited access
right-of-way.
3. Amenities will be installed based on agreements with the City of Carmel and their
maintenance agreement with Hamilton County.
4. We will design utility connections to not interfere with a right turn.
5. The right-of-way line for a possible ramp is noted on the plans near the parking lot on
the east side. If a ramp is installed and the area is needed, the parking lot can be
reconfigured at such time.
6. The right-of-way near the future intersection has respected all agreed-to ramp
configurations.
7. The right-of-way for the possible ramps is shown on the plans.
8. All travelIanes are shown as 12-foot width. The median is shown as 14-foot width.
9. The water feature can be configured to accommodate either ramp option.
10. It is understood that further comments may be necessary.

Dear Joe:
This letter is designed to bring greater clarity to the process of approval for the Clay Terrace
project. The following comments need to be addressed and/or plans/applications updated
accordingly:
1. Carmel TAC has not seen plans for the construction of Range Line Road. Provide plans
for improvements to Rangeline Road including south of US 31 for review by TAC.
These plans should include an update to the Traffic Study prepared at the time of the
rezone based on the improvements that are now being proposed.
2. The plat vacation of Walter's Plaza Replat has been submitted. Approval must occur
prior to approval of the PDP by the Plan Commission.
3. A Plat Vacation must be filed for Walters Rolling Acres (area where Carmel Motel used
to stand) where Range Line Road and storm water facilities will be constructed.
4. A request needs to be filed with the Carmel City Council to vacate the existing frontage
road. The proposed Preliminary Development Plan with detention ponds, parking areas,
and a building encroaching into this area cannot be approved by the Plan Commission
until the City Council vacates this area ofr-o-w. As part of this request you should
provide an explanation as to why the City would desire to vacate the right-of-way to a
private entity so the State, County, or even City would have to come back later and
reacquire it for the anticipated improvements to US 31 regardless which ramp option is
chosen. I would encourage an alternative of perhaps requesting a reduced setback and/or
an encroachment into the frontage road right-of-way. It is not likely the City will vacate
this right-of-way.
5. A request needs to be filed with the Carmel City Council to vacate the portion of Walter
Street you desire to be vacated. The Preliminary Development Plan as proposed with
setbacks cannot be approved by the Plan Commission until the City Council vacates this
area ofr-o-w.

7. Provide a specific report on how the proposed plan conforms to Section 13 of the PUD
Ordinance regarding tree preservation in future ramp area.
8. Forward a letter with Preliminary Development Plan attached to the State (INDOT)
requesting any and all comments. Copy DOCS on this letter.

Note: All erosion and sediment control measures shown on the plans and referenced in this review must meet the design
criteria, standards, and specifications outlined in the "Indiana Handbookfor Erosion Control in Developing Areas" from the
Indiana Department of Natural Resources, Division of Soil Conservation or similar Guidance Documents.
Comments-
The existing wells neeed to be abandon according to local and state statue.
A full erosion and sediment control plan needs to be approved by the Hamilton County Soil and Water
Conservation District prior to any earthwork, demolition or clearing activity. The erosion control plan for
this project should be broken down into several plans to address the different stages of construction.
A stilling basin is recommended to slow and spread the flow from the 30" outfall pipe at the southwest
comer of the site.
The proposed topo lines would be helpful for review of this project.

required at this location along 131st Street. An 85' half right of way is required from
the centerline of 146th Street. The 85' is needed 500' from the intersection in both the
east and west direction. Belond the 500' a 70' half if required.
2. The path shown along 146 Street will not be permitted to cross the limited access
right of way that is presently in place.
3. Please note that decorative signs, sprinkler systems, trees, landscaping mounds,
c1ght poles or other such amenities are not permitted in the right of way.
4. he area near the intersection of 146'" Street and Rangeline Road must be left clear
of all utilities, landscaping and any other structures which would prohibit the
f:'\ installation of a right turn lane from 146'" Street to Rangellne Road.
~ The par1<lng lot on the east side of the project near US 31 may need to be
reconfigured to allow for the proper centertine radius to be installed as a part of the
tt;1 ramp project.
.l!.J. The buildings, which are planned for the area near the future Intersection of the ramp
project and Rangellne Road, must be constructed in areas that would allow for a
~ continuous turning movement at the intersection.
~ The areas at the future intersection of the ramp and Rangellne Road will need to be
distinguished in some manner to note that the area will be removed when the ramp
from US 31 is constructed. The right otway for the ramps will need to be shown on
the construction plans for the Clay Terrace Project.
8. All travel lanes shown in the typical section, including the left turn lane, will need to
be 12' in width. The medians in the street parking section will need to be a minimum
of 14' from face to face of curb.
~ The location of the water feature in the northeast corner must be located in an area

B. Response to review comment letter dated October 16,2002 are as follows:
1. The plans for improvements to Rangeline Road south of US 31 will be on the plans
developed by the county for the Rangeline Road Project.
2. The plat vacation of Walter's addition will be submitted upon closing.
3. The revised site plan will reflect 75' Right-of-Way for the 146th Street.
4. We will submit plans to the state (INDOT) for review and comment. We anticipate their
review to be focused on issues surrounding vacation of the frontage road along US31.
5. Right-of-Way and building setback lines will be shown on the revised plan.
6. The building at the SE comer of 146th street and Rangeline Road will be relocated to
meet 45' setback requirements. This will be reflected on the revised site plan.
7. Landscaping wiIl be placed in the islands within the "Shell Pipeline Easement", This wiIl
be reflected in the Landscape drawing, which will be submitted during ADLS.
8. 10' strip of landscaping will be provided along 146th Street.

Rangeline Road's turning radius remains as indicated on our current site drawing.
14. An 8' fence is shown along the west and south property lines. 4.5' is given between the
50' Tree Preservation Easement and 50' Shell Pipeline Easement for the construction of
the fence.
As the design documents progress forward, we anticipate all of the concerns and comments by

Urban Forester Notes
Carmel Clay Historical Society: There are no objections to the Use Variance, but no landscape
plan has been submitted with the Development Plan. Comments will be made after a landscape
plan has been submitted.
Lakeside Park. Section One: The Landscape Plan for the Secondary Plat and Construction Plans
does not meet the Open Space Plan, Landscape Plan, Buffering requirements, and Tree
Preservation Plan commitments submitted for the approved Primary Plat received by this office
on August 29, and September 10, 2002. The Secondary Plat plans and Construction plans must
meet, or equal these approved plans.
Sheet 6 shows the installation of a storm sewer between yard inlet 159 and yard inlet 160. This
sewer installation bisects a tree preservation area (Common area #1). The installation by
trenching through this tree preservation area is not acceptable. Sewer installation through tree
preservation areas must be accomplished by tunneling to sufficient depth not to injure trees in the
woodlands; otherwise, drainage should be accomplished by grading, earthwork, or trenching
outside the tree preservation areas. These woodland preservation areas are primary natural
openspace conservation areas.
Lakes at Hayden Run. Section Two: Four "street trees" shown along Lorenzo Boulevard on the
Primary Plat are missing from the Secondary Plat landscape plan for Section Two. These need
to be replaced. The developer's commitment to plant at least one large maturing shade tree near
the street but outside the right-of-way in the front of each lot not on Lorenzo Boulevard (a county
thoroughfare) must be included in Section Two as it was in Section One. The individual amounts
for species are missing from the submitted landscape plans. These must be added to the plan.
The Primary Plat Landscape plans show the woodland on the north perimeter being saved in its
entirety. The Section Two plans show an encroachment into the woods by lots, a drainage
easement, and a 6' asphalt path. Sheet 22 shows Tree Preservation Detail F (fencing), but there
is no corresponding fencing on the Landscape Plan. This woodlands in its entirety is a primary
conservation area on the open space plan for this subdivision as submitted to the Carmel Clay
Plan Commission on October 21, 2001, and subsequently approved. This issue must be
resolved before this plan can be approved.
Fence row or native trees along the north-east perimeter should be preserved by utilizing tree
protection measures as well.
Villaae of West Clay. Helen Wells Buildina:
The Villas at Sweet Charity Farms: Landscape plans must include planting notes and graphic
planting details. Please also include a diagram detailing required bufferyard plantings and
proposed plant numbers. Any additional shade trees committed to be planted in the front yards of
lots must be near the street but outside the right-of-way. Please detail the species of the 102
shade trees committed for the 51 lots on the landscape plans.
Additional plant materials for buffering should be added behind Lots 1-7 and along the path
between Benevolence Court and Beaument Boulevard South to screen views into the PSI
property. More should be added along the east perimeter south of Lot 27. It my suggestion that
the open drainage on the south east corner be graded outside the existing strip of brush and
woods.

Laura Vista Subdivision: Due to the wildlife in this area, connectivity of the common areas should
be a priority. The US Fish and Wildlife Service has acknowledged this riparian corridor (forested
floodplain) as an ecologically sensitive area (possible habitat for the federally protected Indiana
bat) that should not be disrupted. A written tree preservation plan needs to accompany the
secondary plat including graphic details of the tree and all woodland protection measures.
Wooded common areas need to be listed as tree preservation areas on the plat and in the
neighborhood covenants. Requirements and allowed activities must be detailed for tree
preservation areas within the neighborhood covenants.
If a monument sign is proposed, a plan of the sign the required landscaping must be submitted.
There has been no landscaping plan submitted at all. If one is not proposed, a written
explanation must be provided. I will be glad to meet separately and on site if needed. Shade
trees should be planted along the portion of the multi-use path from Laura Vista Drive west to the
woods. (Path on plat?)
Clay Terrace: There have been significant changes between the Rezone PUD plan and the
Development plan currently submitted. The current plan does not include any landscaping, tree
protection. or reforestation plans as required with the Rezone application. Comments will be
made when those are submitted. The areas to plant the required landscaping and reforestation
seem to have significantly lessened due to changes in storm water detention and change of
layout.
Motorcycles of Indiana: No change of use?
Cherry Creek Estates: No submittal
Providence at Old Meridian: Correct mistakes on plant schedule. No Austrian pine, no red
maples, no cockspur thornless hawthorn, change Malus Coral Burst to recommended species.
American Standard for Nursery Stock (1996) not ANSI. Significant changes to PUD development
plan - doesn't match original plan (Mark Timmons) or installed (Rick Riddle). Label all plants
individually and give #'s in schedule. Planting details - plant trees with root flare at grade level
(not same as nursery), don't pile mulch up on trunk of tree. Remove large dead Oak at entrance
and others that are risk trees. Donate large White Oak sections for community use. Plant
evergreen screen on Arbors border as agreed when development plan approved. Areas of
constructed soils?
Clarian Hosoital North: Haven't had sufficient time to make a complete review. Construction
causes a removal of a significant section of trees. No planting schedule, needs table of
requirements vs. plan, NO Austrian Pines, NO Pin Oaks, replace Tilia cordata with Tilia
tomentosa. Planting details - flare root at grade level. Why planting pits for containerized trees?
Suggest constructed soils.

AN ORDINANCE OF THE COMMON COUNCIL
OF THE CITY OF CARMEL, INDIANA ESTABLISHING
THE U.S. mGHWAY 31 AND 146TH STREET
PLANNED UNIT DEVELOPMENT DISTRICT
WHEREAS, Section 31.6.4 of the Carmel/Clay Zoning Ordinance Z-289, (the
"Carmel/Clay Zoning Ordinance") provides for the establishment of a Planned Unit Development
District in accordance with the requirements on.c. ~ 36-7-4-1500 et seq.;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, pursuant to I.C. ~ 36-7-4-1500 et seq., it adopts this ordinance, (the
"Ordinance"), as an amendment to the Carmel/Clay Zoning Ordinance.
Section 1.
Applicabilitv of Ordinance:
Section 1.1. The Official Zoning Map of the City of Carmel and Clay Township, a part
of the Carmel/Clay Zoning Ordinance, is hereby changed to designate the land described
in Exhibit 'A', (the "Real Estate"), as a planned unit development district.
Section 1.2. Development in the planned unit development district shall be governed
entirely by the provisions of this Ordinance, with the exception that provisions of the
Carmel/Clay Zoning Ordinance specifically referenced within this Ordinance shall also
apply.
Section 1.3. Any capitalized term not defined herein shall have the meaning as set forth
in the Carmel/Clay Zoning Ordinance.

Section 4. Accessory Buildings and Uses: All accessory buildings and uses which are
permitted in the B-2 zoning district shall be pennitted, except that any detached accessory
building shown in any Preliminary Development Plan ("PDP") shall have on all sides the same
architectural features or shall be architecturally compatible with the principal building(s) with
which it is associated.
Section 5. Minimum Tract Size: The minimum tract size is 5 acres. This Section 5 does not
however preclude the sale or other transfer of any parcel of land that is less than 5 acres within a
tract after the approval of a PDP for the entire tract. However, the development of the parcel
must still conform to the Final Development Plan ("FDP") for the entire tract as approved or
amended by the Director, and all other applicable requirements contained in this Ordinance.
Section 6.
Height. Area and Architectural Reauirements:
Section 6.1. Maximum Buildimz Heights: All uses: sixty-five (65) feet for buildings
located east of Range Line Road; fifty-five (55) feet for buildings located west of Range
Line Road and more than three hundred (300) feet from the west property line or a single
family residential zoning district; and forty-five (45) feet for buildings located west of
Range Line Road but less than three hundred (300) feet from the west property line or a
single family residential zoning district.
Section 6.2. Minimum Building Heismt: The minimum building height is eighteen (18)
feet, with a minimum of sixteen (16) feet to the lowest eaves for a building with a gable
or hip roof; excepting for standalone buildings not abutting Range Line Road, which shall
have a minimum building height of twenty-five (25) feet. Accessory buildings and
screened delivery areas are exempt from the requirements of this Section. In the ADLS
approval process, building heights along Range Line Road will be reviewed to avoid long
building facades at the same height.
Section 6.3. Minimum Building Setbacks: The minimum buil~g setback shall be at
least 90 feet from the current U.S. Highway 31 right-of-way. Along the right-of-way of
146th Street, the minimum building setback shall be 45 feet. Along any right-of-way of
any future ramp on or off U.S. Highway 31, the minimum building setback shall be 25
feet. There shall be no minimum setback for those buildings oriented toward and adjacent
to the Range Line Road right-of-way, but there shall be a maximum building setback of
twenty-five (25) feet.
Section 6.4. Minimum Gross Floor Area. Buildings East of Range Line Road and
Range Line Road Develooment:
A. All buildings, which are not connected to or an integral part of the Range
Line Road streets cape development, shall have a minimum of fifteen thousand
(15,000) square feet of gross floor area, excluding the floor area of any basement

or any accessory building(s). Provided, however, that one standalone restaurant
building is allowed and shall have a minimum of 7,500 square feet of gross floor
area. Also, one standalone financial institution building is allowed and shall have
a minimum of 2,500 square feet of gross floor area, excluding the floor area of
any basement or any accessory building(s).
B. Any building having a building footprint of greater than eighty thousand
(80,000) square feet shall be located east of Range Line Road. Any tenant in a
building located west of Range Line Road may however, occupy more than eighty
thousand (80,000) square feet of gross floor area (For purposes of this Ordinance,
the term "tenant" includes an owner/occupant of a building.)
C. Accessory buildings permitted need not meet the minimum floor area
requirement.
D. The majority of the developed gross floor area (excluding the gross floor
area of any building with a single tenant having a building footprint greater than
50,000 square feet) shall abut the right-of-way of Range Line Road.
Section 6.5. Architectural Design Requirements:
A. Suitability of building materials: A minimum of three materials shall be
used for building exteriors, from the following list: stone, architectural masonry,
architectural pre-cast (panels or detailing), architectural metal panels, glass, ElF'S
or ornamental metal.
B. All buildings shall be designed in order to eliminate monotonous box
buildings.
C. Sloped roofs shall be a maximum of one hundred fifty (150) feet without a
change in roof plane, or gable or dormer. Sloped roofs shall be either standing
seam metal or dimensional shingles.
D., The building facades shall consist of three elements: a base or foundation;
middle or modulated wall; and a top formed by an articulated cornice.
E. Fixed or retractable awnings are permitted.
F. Facades constructed of more than one material shall only change material
along a horizontal line (not a vertical line, except in the case of an offset described
in subparagraph G below or a diagonal line).
G. Continuous facades of more than 200 feet wide shall be designed with
vertical offsets at intervals which divide the facade. Offsets may be projecting,
recessed or may be a simple change in building material or detailing.

H. All window design shall be compatible with the style, materials,
architectural detail and proportion of the building.
I. No sign may extend above the cornice line of the building.
J. Individual tenants in multi-tenant ground floor or multi-tenant multi-level
buildings should strive for a unique design and graphic image and style, rather
than be required to conform to a single design and graphic image and style for the
building.
K. Exterior lighting on the front building fayade shall be architecturally
integrated with the building style and materials. Rooftop lighting shall be
prohibited, but ground mounted lighting is highly encouraged.
L. Individual storefronts shall incorporate architectural elements such as
lintels, pediments, pilasters, columns and other design elements appropriate to the
architectural style of the building as a whole.
M. Buildings which are connected to or an integral part of the Range Line
Road streetscape development shall be at least one and one half (1 Yz) stories, or
be designed to appear so from the front and sides. Retail buildings are encouraged
to be two stories in height, with office use or retail use on the second floor.
Section 6.6. Sincle Tenant Buildings: Any single tenant building with a building
footprint greater than eighty thousand (80,000) square feet shall be located east of
Range Line Road.
Section 7.
Landscaoing Reauirements.
Section 7.1. Landscaoine: Plan: A landscaping plan shall be submitted to the
Commission for its approval at the same time the information on architectural
design, landscaping, parking, signage, and lighting, ("ADLS") is submitted. This
plan shall:
1. be drawn to scale, including dimensions and distances;
2. delineate all existing and proposed structures, private parking areas, walks,
ramps for handicapped, terraces, drive-ways, signs, lighting standards, steps and
other similar structures; and
3. delineate the location, size and description of all landscape material and
the irrigation system for all planting areas. Landscape treatment for plazas, roads,
paths, service and private parking areas shall be designed as an integral and
coordinated part of the landscape plan for the entire tract.

Section 7.2. Areas to be Landscaped.
A. Greenbelt:
1. The greenbelt along U.S. Highway 31 shall be a minimum of thirty
(30) feet in width and landscaped per the requirements of Section 7.3.
2. Greenbelt areas shall be unoccupied except for plant material,
steps, walks, terraces, bike paths, driveways, lighting standards, signs, and
other similar structures (excluding a private parking area).
B. Parallel Roadwavs:
1. There shall be landscaEe planting areas located adj acent to the
south right-of-way line of 146 Street west of Range Line Road and the
U.S. Highway 31 on and off ramps (if constructed), which shall be a
minimum often (10) feet in width and landscaped pursuant to Section 7.3.
2. These landscape areas shall be unoccupied except for plant
material, steps, walks, terraces, bike paths, driveways, lighting standards,
signs, and other similar structures.
3. Landscaping along Range Line Road shall be located within the
right-of-way as per the agreement of the Director, the Hamilton County
Highway Department and the owner of that portion of the Real Estate
adjacent to the right-of-way of Range Line Road.
C. Planting Within Parking Lots: Landscaping within the planting islands,
planting peninsulas and entranceways (other than those along Range Line Road)
of the parking areas shall be of a quality to improve and enhance the site and its
surrounding area, representing no less than six percent (6%) of the total surface
parking area. (For purposes of this computation, landscaping in the greenbelt(s),
landscaping along the front and sides of the building(s) and landscaping on the
periphery of the tract shall not be included.) Landscaping within parking lots shall
be landscaped pursuant to the standards set forth in Section 7.3. The minimum
size of a parking lot island shall be four hundred (400) square feet in area.
D. Tree Preservation Areas: An area fifty (50) feet in width shall be
maintained in its natural state on the western property boundary and on the south
property boundary (west of Range Line Road) of the Real Estate except for
normal pruning, removal and replacement of dead trees. A fence at least eight (8)
feet in height shall be erected and maintained approximately fifty feet from the
western boundary and the southern boundary (west of Range Line Road) of the
Real Estate.
E. Plantine Adjacent to Standalone Buildines:
1. A planting area equal to an area measuring ten (10) feet in depth by
the width of the front of a standalone building plus twenty (20) feet (to

extend ten (10) feet out on both sides) shall be installed at the front of a
standalone building.
2. A planting area equal to an area five (5) feet in depth shall be
installed on the sides of a standalone building but is not required on the
rear of the building.
3. Sidewalks up to eight (8) feet in width are permitted in these areas,
but shall not occupy the entire area on any side of a standalone building
(excepting for those areas adjacent to access points to a standalone
building).
4. These adjacent planting areas need not be rectangular in shape as
long as the required amount of space is landscaped, innovative and
original designs are encouraged.
F. Planting Adiacent to Multi-Tenant Buildings:
1. A planting area equal to an area three (3) feet in depth shall be
installed on the sides of a multi-tenant building but is not required on the
rear of the building nor along any side adjacent to a pedestrian walkway
(not a street, drive or other vehicle access way).
2. Sidewalks are pennitted in these areas, but shall not occupy the
entire area on any side ofa multi-tenant building (excepting for those areas
adjacent to access points to a multi-tenant building).
3. These adjacent planting areas need not be rectangular in shape as
long as the required amount of space is landscaped, innovative and
original designs are encouraged.
Section 7.3. Landscaoim1: Standards.
A. Interior Areas: The dimensions, specifications and design of any planting
area or planting median shall be sufficient to protect the landscaping materials
planted therein and to provide for proper growth. The following minimum
widths for interior planting areas shall be used:
Canopy Trees; 9 feet wide
Ornamental Trees: 7 feet wide
Shrubs (only): 5 feet wide
B. Greenbelt and Parallel Roadwavs: The primary landscaping materials used
in the greenbelt areas, along parallel roadways except Range Line Road shall be
shade trees, ornamental trees, shrubs, ground covers, grasses, and flowers. A base
planting unit of one hundred (100) linear feet will be designated for the U.S.
Highway 31 greenbelt and along parallel roadways which includes:
1. Five (5) shade trees;
2. Three (3) ornamental trees or three (3) evergreen trees; and
3. Fifteen (15) shrubs

Plantings within greenbelt and along the parallel roadways may be grouped
together to provide visual perspectives of the buildings and address public safety
concerns. Due to the grade elevation change along 146th Street east of Range Line
Road~ landscaping will not be required adjacent to the right-of-way of eastbound
146th Street east of Range Line Road where the grade change reasonably precludes
landscaping.
C. Parking Lot Landscaping. Landscaping within the planting islands,
planting peninsulas and entranceways of the parking areas shall contain not less
than two (2) trees and ten (10) shrubs for each four hundred (400) square feet of
interior landscaped area, but shall not include any ornamental trees.
D. Materials: All plants proposed to be used in accordance with any
landscaping plan shall meet the following specifications:
1. Shade trees: a minimum trunk diameter of 2 Y2 inches at six (6)
inches above the ground line~ a minimum height of eight (8) feet, and a
branching height of not less than 1/3 nor more than 1/2 of tree height.
2. Ornamental trees: a minimum trunk diameter of 1 ~ inches at six
(6) inches above the ground line, a minimum height of six (6) feet, and a
branching height of not less than 1/3 nor more than 1/2 of tree height.
3. Evergreen trees: a minimum height of eight (8) feet~ a width of not
less than 3/5 of the height.
4. Deciduous shrubs: minimum height of twenty-four (24) inches~
with no less than six (6) main branches upon planting.
5. Evergreen shrubs: minimum height and spread of twenty-four (24)
inches.
Section 7.4. Landscaoing Installation and Maintenance.
A. Installation: All required landscaping shall be installed prior to the
issuance of a final Certificate of Occupancy by the Department. If it is not
possible to install the required landscaping because of weather conditions, the
property owner shall post a bond for an amount equal to the total cost of the
required landscaping that has yet to be installed and/or completed prior to the
issuance of the temporary Certificate of Occupancy.
B. Maintenance: It shall be the responsibility of the owners and their agents
to insure proper maintenance of project landscaping and retention ponds approved
in accordance with the development requirements specified for this Ordinance.
This is to include~ but is not limited to~ irrigation and mulching of planting areas,
replacing dead~ diseased, or overgrown plantings with identical varieties or a
suitable substitute~ and keeping the area free of refuse, debris, rank vegetation and
weeds.

C. Chanl!es After ADDroval: No landscaping which has been approved by the
Conunission may later be materially altered, eliminated or sacrificed, without first
obtaining further Commission approval. However. minor alterations in
landscaping may be approved by the Director in order to conform to specific site
conditions.
D. Insoection: The Director shall have the authority to visit the Real Estate to
inspect the landscaping and check it against the approved plan on file.
Section 8.
Parking Requirements:
A. Parking is prohibited in the u.s. Highway 31 Greenbelt and within
planting areas along parallel roadways.
1. The number of parking spaces required shall be according to
Section 27.5 of the Cannel/Clay Zoning Ordinance; however. for the
purposes of calculating the required number of parking spaces, retail and
grocery store uses shall use a parking ratio of one (1) parking space for
every two hundred fifty (250) of gross floor area and the area of screened
delivery areas shall be excluded. Upon the review and approval by the
Director, parking spaces on the Real Estate may be shared among tenants
as long as the demand for the spaces does not coincide among tenants.
2. There shall be an appropriate number of parking spaces, accessible
to the building(s) and identified as reserved for use by handicapped
individuals, and these spaces shall meet State of Indiana requirements.
3. Above-grade, structured parking facilities shall have on all sides
architectural features that are compatible with the principal building(s)
with which they are associated.
Section 9.
Lightin2 ReQuirements:
A. A site lighting plan shall be submitted along with the information on
ADLS. The site lighting plan shall include the layout, spread and intensity of all
site lighting. including:
1. parking lot and service/storage area lighting;
2. architectural, display lighting;
3. security lighting;
4. lighting of pedestrian and bicycle ways;
5. landscape lighting.
B. The maximum height of light standards shall not exceed twenty-five (25)
feet. However. when light standards abut or fall within ninety (90) feet of a
residential district or use, they shall not exceed fifteen (15) feet.

C. All site pole lights and wall mounted lights shall be low-level, 900 cutoff
luminaires and shall not spill over into adjoining properties in excess of 0.3
footcandle in commercial areas, and 0.1 footcandle in residential areas.
D. Exterior architectural, display, decorative and sign lighting visible to the
public from U.S. Highway 31 is allowed.
Section 10. Other ADLS Requirements.
Section 10.1. Outside Storage of Refuse or Merchandise: No outside, unenclosed storage
of refuse (whether or not in containers) or merchandise shall be permitted on any tract.
All refuse shall be contained completely within the principal or accessory building(s).
Any accessory structure designed for refuse storage shall be architecturally compatible
with the principal building.
Section 10.2. Loading Berths: Any loading or unloading berth or bay visible from U.S.
Highway 31 shall be screened subject to the approval of the Commission or Committee of
the Commission.
Section 10.3. Sign Reauirements:
A. Sign Plan: A sign plan shall be submitted for the Commission's
approval as part of an ADLS or ADLS amendment application.
B. Sign Standards: The signs within the Planned Unit Development District
shall conform to the following standards, unless specified otherwise in this
Ordinance:

The color of the signs shall not be restricted; however, each
building shall have a palette of colors approved at the time of the
ADLS approval for the building. Tenants may amend the colors by
petition to and upon the approval of a Committee of the
Commission pursuant to the Commission's Rules of Procedure.
Window signage shall be allowed for all tenants and shall conform
to the standards established for window signs under Ordinance Z-
302. In the event that a building has been previously approved by
the Commission under the ADLS approval process a tenant may
seek the approval of its window signage through an amendment to
the previously approved ADLS application to be approved by a
Committee of the Commission.
Banners shall be allowed as provided for in Ordinance Z-302.
Provided, that banners may be installed on lighting and other
fixtures located within the streetscape along Range Line Road in
accordance with the review and approval of the proposed banners
by a Committee of the Commission pursuant to the Commission's
Rules of Procedure.

C. Center Identification Ground Si2l1s:
1. Two (2) Center Identification Ground Signs each with a maximum
height of 6 feet and a maximum sign area 0 uare feet shall
be allowed at: (a) the south entrance to th development orth of
the intersection of Range Line Road with U.S. . way 31; and (b)
at the intersection of Range Line Road and 146th Street. These
Center Identification Ground Signs may not include tenant
identification and shall be consistent in design with the sign shown
in Exhibit "B".
2. One (I) Center Identification Ground Sign with a maximum height
of 7 feet and a maximum sign area of 360 square feet shall be
allowed in the area adjacent to the greenbelt along U.S. Highway
31. This Center Identification Ground Sign may not include tenant
identification and shall be consistent in design with the sign shown
in Exhibit "B".
3. Two (2) Center/tenant identification ground signs with a maximum
height of 5 feet and a maximum sign area of 35 square feet shall be
allowed at each intersection of a private drive or public street and
Range Line Road. Copy on these Center/tenant identification
ground signs may include tenant names up to seventy (70) percent
of the maximum sign area and if tenant identification is included,
at least two but no more than six tenants may be identified.
D. Wall Shms: Consistent with the sign standards set forth in subparagraph
B. above, wall signs shall be permitted for each tenant. Excepting for any
standalone single or multi-tenant building adjacent to the greenbelt along U.S.
Highway 31, the Maximum Sign Area shall be determined in accordance with the
non-freeway sign chart applicable for tenants in Single Tenant & Multi-Tenant
Buildings (Ground Floor & Multi-Level) as set forth in Ordinance Z-302.
However, for purposes of this Ordinance, any building located adjacent to the
right-of-way of Range Line Road that is located less than five (5) feet from the
right-of-way line of Range Line Road shall be deemed to be located five (5) feet
from the right-of-way line for purposes of applying the sign chart referenced
above to determine the allowable sign area for the wall signage. Wall signs shall
be composed of individual letters and logos and may be illuminated by internal or
external sources. Tenants in buildings with more than one frontage on a public
street or private drive are allowed one wall identification sign per frontage on a
public street or private drive, as long as the total number of wall signs does not
exceed three (3). Standalone single or multi-tenant building adjacent to the
greenbelt along U.S. Highway 31 shall be permitted wall signs facing or oriented
toward U.S. Highway 31 in accordance with the provisions of Ordinance Z-302.
Provided, however that:

1. there shall be no wall signs on the east facade of any multi-tenant
or single tenant buildings located east of the right-of-way of Range
Line Road; and
2. there shall be no wall signs on the west facade facing a single
family residential zoning district of any multi-tenant or single
tenant buildings located along or west of the west right-of-way of
Range Line Road.
E. Awnin2 Sifms: Signs may be imprinted on permanent awnings.
These signs shall be secondary to the wall signage of any tenant and the sign area
shall be subject to the approval of the Commission or a Committee of the
Commission as a part of the ADLS or ADLS amendment approval process and
pursuant to the Commission's Rules of Procedure.
F. Single Tenant Building Sifms. Single tenant building signage shall
be as permitted by Ordinance Number Z-302, and as amended by Subparagraphs
B and D above
Section 10.4. Rooftop Mechanical Equipment: Any rooftop mechanical equipment
visible from an adjoining street or highway shall be screened with suitable walls or
fencing subject to the approval procedures contained in the Commission's Rules of
Procedure.
Section 10.5. Cart Corrals: Any cart corrals on the Real Estate shall be constructed of
masonry materials subject to the approval procedures contained in the Commission's
Rules of Procedure.
Section 11. Approval of ADLS:
A. The Commission shall consider an ADLS approval application for any
project on the Real Estate.
B. The Commission shall approve the ADLS without conditions, or approve
with conditions.
C. Pursuant to Paragraph A above, multi-tenant buildings shall be submitted
to the Commission for ADLS approval. At that time, palettes of building
materials, lighting fixtures, signage types and designs, awnings and window
treatments for the tenant facades may be submitted for approval concurrently with
the approval of the ADLS application for the multi-tenant building. Thereafter,
tenant facades (including, but not limited to, building materials, signage, awnings
and window treatments) may be submitted to the Department for approval. To the
extent that there is Material Alteration from the approved items within a particular
palette, then the request shall be reviewed and approved by a Committee of the
Commission, pursuant to the Commission's Rules of Procedure.

D. If there is a Material Alteration in the ADLS plans, review and approval
shall be made by a Committee of the Commission, pursuant to the Commission's
Rules of Procedure.
E. The ADLS shall be a specific plan consisting of the architectural design of
any buildings, landscaping, lighting, and signage for a site on the Real Estate.
Section 12. Approval or Denial of the Preliminary and Final Development Plans:
A. The Commission shall approve without conditions, approve with
conditions, or disapprove the Preliminary Development Plan ("PDP") for any
project on the Real Estate. Provided, however, that the Commission shall not
unreasonably withhold or delay the approval of a PDP that is in conformance with
this Ordinance and the Carmel/Clay Zoning Ordinance. If the Commission
disapproves the PDP for any project on the Real Estate, the Commission shall set
forth in writing the basis for the disapproval.
B. The Director shall approve without conditions, approve with conditions, or
disapprove the Final Development Plan ("FDP") for any project on the Real
Estate. Provided, however, that the Director shall not unreasonably withhold or
delay the approval of a FDP that is in conformance with this Ordinance and the
Carmel/Clay Zoning Ordinance. If the Director disapproves the FOP for any
proj ect on the Real Estate, the Director shall set forth in writing the basis for the
disapproval.
C. An amendment to a PDP or FDP which does not alter the use of any land
may be reviewed and approved by the Director. However, any interested party
may appeal the decision of the Director directly to a committee of the
Commission.
D. The PDP shall be a preliminary plan for the development of real property
that is submitted for approval by the Commission showing proposed facilities and
structures and parking information for a site on the Real Estate.
E. The FOP shall be a specific plan for the development of real property that
is submitted for approval by the Director showing proposed facilities and
structures, parking, drainage, erosion control, utilities and building information
for a site on the Real Estate.
F. No Final Certificate of Occupancy shall be issued for any building until
Range Line Road has been constructed between l46th Street and U.S. Highway
31, west of U.S. Highway 31.
G. Improvements to Range Line Road south of the intersection of Range Line
Road and U.S. Highway 31 shall be completed in accordance with plans approved

by the Department within 6 months following the completion of construction of
Range Line Road between 146th Street and U.S. Highway 31.
Section 13. Tree Preservation in Future Ramo Area: No fewer than 140 inches of trees
will be preserved on that portion of the Real Estate designated as Area "C." Area
"C" is situated on the projectts eastern boundary, facing U.S. 31, and comprises
approximately 4.75 acres as outlined and defined in the tree preservation and
reforestation plan approved by the Carmel Department of Community Services'
Urban Forestert Mr. Scott Brewer. This commitment to preserve these trees is in
lieu of the establishment of a 50 foot buffer area along U.S.31. The owner of the
Real Estate reserves the right to remove any dead or diseased tree, or any tree that
constitutes a threat to the public health, safety welfare; however, the owner shall
replace any removed tree and maintain the minimum. 140-inch requirement. This
commitment will terminate in the event that the Indiana Department of
Transportation, Hamilton County or any other governmental unit acquires Area
"e" for the installation of ramps related to the expansion of U.S. 31. However,
consistent with the approved tree preservation and reforestation plan, the 140
inches of trees will be replaced through new plantings elsewhere on the site.
Section 14. Commencement of Construction: If at the end of twenty-four (24) months
following the date of adoption of this Ordinance by the Common Council of the
City of Carmel (the "Council")t construction has not commenced on the Real
Estate consistent with the provisions of this Ordinancet then Lauth Property
Group, its successors or assignst as developert (the "Developer"), shall, upon
notice, appear before the Council to update the members of the Council as to the
status of the commencement of construction. At that time, Developer may request
one (1) additional yeart to commence construction. At the meeting, the Council
shall be free to: (1) allow this Ordinance to remain in full force and effect; (2)
allow this Ordinance to remain in full force and effect for one (1) additional year;
or (3) repeal this Ordinance.
Section 15. Violations of Ordinance: All violations of this Ordinance shall be subj ect to
Section 34.0 of the Carmel/Clay Zoning Ordinance.
Section 16. All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section 17. This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor.

The Carmel/Clay Plan Commission otTers you the following report on the application of the Lauth Property Group
(Docket No. 127-01 Z) petitioning the Commission to establish the U.S. Highway 31 & 14rJ" Street Planned Unit
Development District. The area affected is generally located on the southwest comer of East 146lh Street and U.S.
Highway 31, Hamilton County, Indiana.
The Carmel/Clay Plan Commission's recommendation on the petition of the Lauth Property Group is
FAVORABLE.
At a special meeting held Tuesday, June 4, 2002, the Carmel/Clay Plan Commission voted nine (9) in Favor, zero
(0) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Ordinance No. Z-386-02 with a
Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-4-
607(e), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the
Commission. Ninety days from the date of this Certification is Monday, September 2,2002.

multiply the nwnber of seats by 0.10 EDUslseat equals the total nwnber of ED Us. Multiply the
total EDUs by the Connection Fee for water (SI,310.00IEDU) and sanitary sewer (S795.00IEDU).
I am enclosing copies of our Average User Factors for Water and Sanitary Sewers and our current
fee schedule. I have also highlighted the Average User Factors that might apply to this
development.
Note: Any deviation from the Connection Fee calculations listed in our Ordinance wiU require
Carmel Utilities and Board of Public Works and Safety approvals.
5. T AC ReviewlDrawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and
be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resOlved. All Carmel Utility issues must also re resolved. The
design engineer must certify all drawings submitted for final approval. This office will require five-
sets of approved drawings after all issues have been resolved. The drawings will be stamped approved
and signed by both the City Engineer and Director Carmel Utilities. The Developer/Owner will
receive one-set which is to be maintained on the construction site at all times. Carmel Utilities will
receive two-sets. Our Public Works Inspector will receive one-set and one-set will be maintained in
the Department of Engineering. If more than five-sets are requested to be approved, the additional sets
must be submitted with the five required sets.
6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
easements will require a Consent to Encroach Agreement between the OwnerlDeveloper and the City
of Carmel. This Agreement requires Board of Public Works and Safety approval. Installations within
dedicated right of way require separate Board approval.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water
main and sanitary sewer main locations.
8. Carmel Utilities will provide a separate review of this project for water and sanitary sewer issues.

16. Parking Lot Design:
Some difficulties may be found in the skewed alignment of parking spaces. Certain intersections are
", very confusing. Many aisle lane entries are extremely wide (70'+). This office would be interested in
1 discussing alternative solutions to these issues.
We reserve the right to provide additional review and comments upon receipt of detailed construction
drawings and drainage calculations.
The above comments are based upon the Engineering Department's initial review. Please provide our
office with a follow up letter and revised plans, indicating all revisions. A second review will focus only
on revised items. It is critical that our office be made aware of all modifications made on the plans being
re-submitted, particularly if any such changes are considered "new" or fall outside of our initial review. If

Upscale retail project planned for Hamilton County in 2004

A large retail mecca in Hamil-
ton County will be getting nearly
half a million additional square
feet of shops and restaurants with
the newly approved Clay Terrace,
a $90 million "lifestyle center"
planned by a local developer. 0
The Carmel City Council on
Sept. 3' approved the 520,000-
sqqare-foot project, which will
contain 450,000 square feet of
retail space and 70,000 square
feet of office space. Lau~ Proper-
ty Group will develop the center
over the next two 'years on 70
acres at 146th Street and U.S. 31
in northern Clay Township.
Clay Terrace will join two
existing shopping centers in the
. immediate vicinity-Village Park
Plaza on the east side of U.S. 31
and Greyhound Pass on the west.
Construction is expected to begin
next spring with the center's
opening set for the third quarter of
2004, Lauth President Greg
Gurnik said. The price tag
includes costs for construction
and purchasing the ass~mbled
land from 20 separate owners.

acres-will be set aside for an
extension of Rangeline Road,
which currently ends at U.S. 31.
The new road will veer to the
northwest and cut through Clay
Terrace on its way to 151st Street.
As a lifestyle center, Oay Terrace
is expected to include several
upscale retailers and restaurants in
an open-air configuration. The
. design of the center, speameaded by
Dallas-based RTKL Associates, Win
evoke a "main street" feeling, with
h~rylan~~ping,~n~es, OO~
door lighting, a variety of storefrontS
and open space. Parking will ~ rel-
egated to space behind the center.
Lauth is not ready to identify
potential tenants, but, according to
Gumik, many will ~ the same
stores typically found in a tradition-
al shopping mall. With new mall
construction on the decline, many
well-known. chains are turning to
lifestyle centers for growth, he said.
'There's not a lototnew malls for
the retailers to go into and it doesn't
make sense for them to be in a typi-
cal strip center," Gurnik said.
The relatively new concept of a
lifestyle center, named for Mem-
o phis-based od~veloper Poag & 0
McEwen Lifestyle Centers, is one
Of nine distinct shopping concepts
recognized by the International
Council of Shopping Centers.
Last winter, ICSO convened a
task force to draw up a defInition
. of the popular new retail format
and 0 identify some 30 lifestyle
centers for an industry report.
Of those, 17 are in the warmer
climates of Florida, Califofnia, 0

Lauth's acreage. "I've been in the retail
research business since 1980 and I can't
recall a site with this kind of development
potential."
According to herresearch, there is 13.3
square feet .of per-capita shopping center
space in the area, compared with the
national average of 22 square feet. And
demographic data show the population in
the region. which covers roost of Hamil-
ton County, growing twice as fast as the
rest of the Indianapolis area.
But some aren't convinced by the num-
bers. .
"r personally was not comfortable with
whether or not that amount of retail was
needed," said Wayne WIlson, an at-large
m~mber of. the City Council, who, along
WIth co~ncIlor Kevin Kirby, voted against
the proJect. The vote was 4-2. Councilor
Luci Snyder did not vote.
WIlson, who is running against Snyder
and M~yor Jim Brainard in next May's
Repubbcan mayoral primary. said he is
concerned that other retail centers in
Carm~l could lose tenants to Clay Ter~
race.
. He also took issue with the retail use.

report.
Cold weather can dampen sales at
lifestyle centers, but they are usually less
expensive to operate than enclosed malls,
said Mark Perlstein. a retail broker whose
firm. The Linder Co., owns the Mer-
chan~s' Square and Merchants' Pointe
shopping centers at 1 16th Street and Key-
stone Avenue.
Unlike a. regional mall, which is
enclosed, or a power center, which is
anchored by several "big-box" stores, a
lifestyle center usually contains several
small specialty stores, sit-down dining
and entertainment in a village-style out-
door setting. According to lCSC, popu-
lar tenants at such centers are Gap, Ann
Taylor, Banana Republic, Victoria's
Secret, Williams-Sonoma. and Pottery
Barn. .
A true lifestyle center does not have
large anchor tenants such as department
stores or big boxes like Wal-Mart,Home
Depot or Meijer. Most range in size from
150,000 square feet to 500,000 square
feet, while a regional ,mall could be as
large as 800,000 square feet:
Shopping centers around 146th and
U.S. 3 f contain at least 1 million square
feet and include Target, Wal-Mart,
Kohl's, Menard's, Lowe's, Marsh Super~
markets, Barnes & Noble, Galyan'sand
Regal Cinema.

This correspondence will serve as our request to be included on your upcoming October 16,2002
CarmeVClay Technical Advisory Committee Agenda. In accordance with Section 12, subsection A, of the
approved Planned Unit Development Ordinance, the Commission shall approve the Preliminary
Development Plan (PDP) for any project on the real estate. Please consider this our initial step in obtaining
the Commission's approval.
Plans will be delivered to you under separate cover by American Consulting Engineers on Friday, October
4. Plans will also be delivered to all other T AC members on this same date.

Jon, included with this memo are two set of Preliminary Development Plans and a plan
review application for the Clay Terrace project at 146th and US 31.
The plans are being submitted in conformance with the ordinance that established the
PUD District for this site, Ordinance No. 2-386-02. As discussed, we will provide the
TAC members with plans this Friday and, at the same time, provide your office with two
more sets of plans that will be current with the plans delivered to the T AC members.

Dear Mike:
This letter serves to inform you of several issues that were discussed in a meeting with the Lauth
Property Group, A&F Engineering and the Highway Department concerning the above-mentioned
plans. A plan dated 5/2102 was received by the Highway Department on 5/16/02. The Highway
Department agrees conceptually with the plan for planning and general zoning considerations,
however there are several issues that needed further investigation before any final construction or
platting approvals are granted by the Hamilton County Highway Department. The issues are
listed below.
1. A Traffic Study to be performed by A&F Engineering for this area in needed. The Study will
needs to show that a 2012 Level of Service "C" and a 2022 level of Service "0" can be
achieved from the ramps through the 1461h Street Intersection. The traffic volumes shall be
estimated assuming the ramps are Installed.
2. Minimum Right of Way along 146th Street shall be granted In accordance with the Hamilton
County Thoroughfare Plan. From the Intersection of Western Way and 146th Street to point
500' to the east and 500' to the west, the right of way is an 85' half. From that point to the
eastern and western property fine, the right of way is a 75' half.
3. The right of way dimensions for the Interior street are repres~ntatlve only. The exact width for
this right of way will be determined by the Highway Department after a more detailed plan for
the site and roadway engineering is completed. This may lead to adjustments in the building
locations after the final determinations for rlght of way are completed.
