SWIMMING POOL PURCHASE
AND INST ALLA nON CONTRACT
THIS PURCHASE AND INST ALLA TION CONTRACT ("Contract"), executed on
January 5, 2007 between Ken Williams, hereinafter called the "Purchaser", whose address is
1809 Milford, CarmeL IN and MIKE McGHEE & ASSOCIATES, INC., hereinafter called
"Contractor" .
WHEREAS, Purchaser is desirous of having Contractor build a swimming pool at 1809
Milford, CarmeL IN ; and
WHEREAS, Contractor agrees to build and install a swimming pool for Purchaser at the
above location; and
WHEREAS, Contractor and Purchaser agree that the swimming pool shall be built and
installed under the following terms and conditions.
NOW, THEREFORE, Purchaser and Contractor agree to the following terms and
conditions:
PROJECT
Contractor shall furnish, except for such work specifically excluded, all labor, materials,
tools, equipment and services as called for in the plans and specifications, said in-ground gunite
pool shall be completed in a workmanlike manner:
The Purchaser agrees to make these payments to the Contractor on the day the Contractor
presents an invoice. The Purchaser agrees that the Contractor has the right to stop work if these
payments are not timely received. The Contractor agrees that the pool will meet or exceed the
National Spa & Pool Institute's residential swimming pool standards.
SWIMMING POOL MEASUREMENTS
The pool will be built in accordance with plans, specifications and other documents
attached to this Contract.

FOR ANY DESIGNATED MATERIAL, EQUIPMENT, PRODUCT, METHOD OF
CONSTRUCTION, INSTALLATION OR SERVICE IDENTIFIED BY SPECIFIC BRAND OR
TRADE NAME, CONTRACTOR HAS THE RIGHT TO SUBSTITUTE AND FURNISH
ANOTHER MATERIAL, EQUIPMENT PRODUCT, METHOD OF CONSTRUCTION,
INST ALLA TION OR SERVICE OF COMPARABLE QUALITY OR UTILITY.
ADDITIONAL WORK
If Purchaser requests Contractor to perform additional work and if the Contractor is willing
to perform such additional work, Purchaser agrees to pay Contractor for each item of extra work at
the actual cost of subcontracts, labor, materials and equipment plus Fifteen Percent (15%) for
Contractor's overhead and fee. Request for extra work or modifications shall be in writing, signed
by both parties and shall become part of this contract. All sums for extras or modifications shall
be due and payable when completed, concurrent with the other progress payments, and the
Contractor shall have the right to stop work and keep the job idle if payments are not made when
due.
Extra work shall include, but is not limited to the following:
Any changes requested by the Purchaser not included in the scope of work.
Expense incurred because unsuitable or hard soil, filled ground, rocks, ground water or any
other material not removable by ordinary hand tools is encountered.
The removal or rerouting of pipes, sprinkler systems, electrical wires, water or sewage
disposal or conduits in areas of excavation.
Any change or alteration from the drawings or specifications.
