The Owner also hereby agrees to provide, at Owner’s cost, all additional maintenance, repair, and/or replacement services reasonably necessary to maintain the function and longevity of the BMPs from and including the date this Agreement is executed by Owner to and including the date on which a new Agreement is filed with the City by another party who assumes all of the obligations and responsibilities of Owner as set forth herein. Section I – Description and Location (INST# 2011020380) A part of the East Half of the Northeast Quarter of Section Twenty-five (25), Township Eighteen (18) North, Range Three (3) East, as follows: Begin at a point 92 rods 2 feet north of the southeast corner of said northeast quarter and run thence north 13 rods 10 feet 6 inches ; thence west 22 rods 10 feet; thence south 13 rods 10 feet 6 inches; thence east 22 rods 10 feet to the beginning, except 10 rods off the whole west end thereof, and also except begin at the northeast corner thereof and run thence west 12 rods ; thence south 4 rods; thence east 12 rods, thence north 4 rods to beginning. Narrative 520 N Range Line RD Side yard swale between the existing and proposed buildings, will receive all roof drain flows and most of the ground flows around these building. The swale will function by slowing these flows and allowing infiltration into the surrounding soils, trapping TSS up to 70%. Additionally ground flows will cross grassy and other landscaped areas providing some measure of TSS removal. 6” SSD Roof drains along the side of each structure will further aid in infiltration and transportation of ground water & roof flows to the western vegetated swale with native vegetation. Vegetated Swale (with native vegetation) resided along the West edge of the parking lot. This area will function the same as above, providing full treatment up to the 100yr runoff volume. SITE MAP BMP CROSS SECTION SECTION II – MINIMUM STANDARDS OF CARE Properly designed and installed rain garden areas require some regular maintenance, most within the first year or two of establishment. Less maintenance is required when the native perennial vegetation becomes established. 1. Water vegetation at the end of each day for two weeks after planting is completed. Newly established plants should continue to receive approximately one inch of water per week throughout the first season, or as determined by the landscape architect. 2. While vegetation is being established, pruning and weeding may be required. Weeds should be removed by hand. 3. Organic material may also need to be removed approximately twice per year (typically by hand). 4. Perennial plantings may be cut down at the end of the growing season to enhance root establishment. 5. Mulch should be re-spread when erosion is evident and replenished once every one to two years or until the plants begin to fill in the area and the space between plants is minimized. 6. Vegetated Swale area should be inspected at least two times per year for sediment buildup, erosion, and to evaluate the health of the vegetation. If sediment buildup reaches 25 percent at any location, it should be removed. If erosion is noticed within the swale area, additional soil stabilization measures should be applied. If vegetation appears to be in poor health with no obvious cause, a landscape specialist should be consulted. 7. Swale vegetation may require watering, especially during the first year of planting. Ensure the maintenance plan includes a watering schedule for the first year, and in times of extreme drought after plants have been established. 8. Swale areas should not be mowed on a regular basis. Trim vegetation as necessary to maintain healthy plant growth. 9. Native seed area shall not be mowed during the first year so as to allow natural over seeding to occur. 10. DO NOT mow Native seed area during the growing season, following the restrictive signage placed by this area. 11. Follow supplier care and maintenance schedule and recommendations. Requirements regarding the submittal of annual inspection reports to the City of Carmel Engineering Department. The first report is due one year after construction is completed, with subsequent reports due each year within the same month of the initial report. If there are any deficiencies found during the inspection, these should be addressed. If the inspection report is not received within the month it is due, if there are deficiencies which were not included in the report, or if any deficiencies included in the report are not addressed in a timely manner, the BMP owner faces enforcement action from the City.
