Findings of Fact for Use Variance EXPLANATION The applicant, The Family Place, LLC, is the owner of a parcel of real estate located at 10455 N College Avenue, is identifled as tax parcel identiflcation number 17-13-12-01-02- 031.000, with a full legal description provided herein with site location map provided in section 4. The real estate is currently zoned B-1 in the Homeplace Overlay District and the applicant is seeking a use variance with special exception/special use to operate a day care and preschool facility. Enclosed are the architectural fioor plans, elevations, site plan and landscaping plans. ABZA Use Variance approval is required for the day care component, with the preschool component also being an accessory use. The Use Variance is required because the zoning classiflcation of B1/Business and Home Place Business District do not permit a day care use per UDO sections 2.19 and 3.01. Included in Section 7 are the Findings of Fact and Ballot Sheet for this variance request described above. The Findings of Fact, Statement of Use Variance (Section 2), and Statement of Support included herein explain in detail the nature and reasoning for this variance. Skidmore Single Source Real Estate Services Legal Description SECTION 2 Statement of Use Variance 10455 College Avenue Carmel Board of Zoning Appeals Docket No. PZ-2024-00060 UV STATEMENT OF USE VARIANCE The petitioner is seeking a use variance approval in order to operate a day care facility with preschool and adult classes in the existing structure located at 10455 College Avenue. The proposed use is not permitted in the current zoning or in the Overlay District (Homeplace). Section 3 Statement of Support Carmel Board of Zoning Appeals Docket No. PZ-2024-00060 UV STATEMENT IN SUPPORT OF USE VARIANCE This use variance is requested in order to permit a day care with preschool to function in a former office building. The petitioner, The Family Place, LLC, owns the property at 10455 N. College Avenue and would lease to a related entity for operation of the day care and preschool facility. This would be the second location in operation for The Family Place is a premier early learning preschool that provides comprehensive care and education for children aged 0 to 6 in Carmel, Indiana. Our goal is to prepare children developmentally, educationally, emotionally, mentally, and socially for kindergarten while supporting families and educators in the community. The Family Place mission is to foster the holistic development of children and empower families and educators by providing a nurturing and educational environment that aligns with Indiana's standards for school readiness. Services offered will include: • Early learning preschool program for children aged 0 to 6 years old. Developmentally appropriate curriculum based on Indiana's foundation's standards for school readiness. • Parenting classes and empowerment sessions. • Support and resources for early childcare educators. • Designated classrooms for each age group, meeting state standards. • Conference room for family meetings and discussions. Staff includes 30 well-trained and certifled staff members at this location to support children and families with no more than 12 staff members on site at one time. Hours of operation are Monday to Friday, 5:30 AM to 11:30 PM with day care open 5:30AM – 7PM and with 2 to 3 weekend events for the school and the community. All public parking will be access off of College Avenue with staff accessing the rear parking lot of 105th Street. All classrooms for children under the age of 3 are located on the flrst fioor with ages 4 and 5 on the second fioor along with training rooms for adult and staff classes. A contractor has been hired to complete the scope of work for the operation. The majority of the scope of work is interior to build out the classroom, but fencing will be added for a play area and to protect children from running into College Avenue at pick up and drop off, trim will be painted to refresh the building, and bike racks and sidewalks and enhanced landscaping are proposed to address staff comments. Dr. Charity Holland will be responsible for operations of the facility. Dr. Charity Holland, aka Dr. MommyC, CEO of The Family Place. Dr. MommyC’s original intent was to create an in-home atmosphere that would be enjoyable for children and design a place that they could grow and mature daily. Her initial childcare design was birthed out of the personal frustration she had due to the lack of concern for meeting the changing needs of her own child when he attended an in-home childcare setting. She desired something that would truly help with the essentials for her growing son. She knew if she had the desire for quality care for her own son, others may feel the same way about their children. Her frustration birthed something wonderful, as she planned a solution to the growing problem of quality care for all children. Dr. MommyC has always been a risk-taker and created "outside of the box" teaching where children were concerned. Today, her desire is unchanged; now at a larger scale. From 2008 up until now, she has served the Hamilton County area with a Nationally Accredited in- home, paths to quality level 4 childcare that grew from one home to three homes, in the heart of the community. She has always had the desire to do the in-home concept "bigger", under one umbrella, and flnally saw her utmost dream come to pass with a new location in 2014. In the summer of 2018, she expanded the building to 8,000 square feet of play space along with the re- branding of a more suitable name; The Family Place Early Enrichment Academy Inc. Just recently she moved to an even larger facility in 2021, with over 12,000 square feet of fun. Now, in 2023, the plans to open a new location in Carmel, is underway. Dr. MommyC, CEO of The Family Place, is the mother of two miracle children and a wife of 25 years. She is a recent graduate of National University where she obtained her Doctorate of Education (EdD) degree, specializing in Early Childcare Education. She is also a mentor and business coach for others in the fleld. Her persistence for excellence still holds true today, as she coaches and mentors her team to pursue higher standards of operation. Dr. MommyC believes in the innovative approach that gives children a bright and positive start in life as she encourages both exploration and discovery, as well as emotional intelligence and building friendships. The Family Place Early Enrichment Academy Inc. has operated in Hamilton County for 16 years and is poised to become an asset to the Carmel community with this second location, providing essential early childhood education and support services. It will ultimately promote the success and well-being of children and families as they navigate the educational journey. SECTION 6 Findings of Fact FINDINGS OF FACT - USE VARIANCE CARMEL BOARD OF ZONING APPEALS Docket No.: PZ-2024-00060 Petitioner: The Family Place, LLC 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community because: the change in use to a day care & preschool facility will improve the public heath, safety and general welfare of the community by providing early education to children in the community through ministry teachings, preparation for elementary school, and providing a safe learning environment. In addition the offering of classes for parents and teachers improves the general welfare of the adult community in the City. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the change in use to a day care & preschool facility as the primary goal of the operation is to provide early education for children and a solid base going into elementary school providing for a lower intensity retail use as contemplated by the UDO. 3. The need for the variance arises from some condition peculiar to the property involved because: This site location provides the opportunity to service a large area of not only Carmel, but northern Indianapolis, and Fishers with only interior modiflcations and the addition of a play area. The business plan for this unique daycare/preschool/education facility doesn’t support a new building construction and this site location afforded the opportunity to offer this service to a wider geographic area. 4. The strict application of the terms of the Zoning Ordinance will constitute an unnecessary hardship if applied to the property for which the variance is sought because: The goal of this facility is to educate children, parents, & staff, however the broad deflnition of a day care also encompasses the operations of this facility requiring a use variance in in lieu of only a special use variance. In addition, the owner has already purchased the property, worked with City of Carmel to dedicate right of way, demolished the interior of the building, submitted for permits, and is ready to move forward with the remaining interior renovations upon approval of this variance. The Owner was not made aware that their previous contractor was not working on the request and their broker represented that the zoning could easily allow for this use. A signiflcant amount of investment has already been made prior to the Owner notiflcation of the use variance requirement. 5. The approval will not interfere substantially with the Comprehensive Plan because: The owner has already dedicated right of way for the improvements contemplated within the Comprehensive Plan. In addition the East Neighborhood Development Pattern calls for neighborhood-serving commercial & schools and this use would meet the deflnition of both of those uses.
