A. Short memo/letter introducing the project I am writing to introduce a Privacy Fence Project. This proposed fence aims to enhance the privacy, safety and functionality of our family. Docket No. PZ-2024-00072 V. contains a request to petition for a Development Standards Variance from UDO Section 5.09.B.1. The property involved is 10940 Timber Lane, Carmel, IN 46032 (Parcel Number 17-14-06-04-01-007.000) The property is a corner lot and contains two street frontages. Please note, the street frontage (110th St.) nearest to us (our side yard) is a dead-end next to our lot – it is not a through street. The proposed 6-ft privacy fence will be a tasteful traditional cedar fence that will be professional installed. B. Statement of Variance request (short paragraph explaining what you are asking for) Request to petition for a Development Standards Variance from UDO Section 5.09.B.1. Property owner is seeking a 6-foot privacy fence where a maximum 42-inch fence in the front yard allowed (with at least 25% visibility). Please note that a 6-ft traditional cedar privacy fence is proposed in the side yard. The property is considered a corner lot and is along two street frontages, therefore the side yard is also considered a front yard, and the front yard standards apply for the fence height. We are requesting a 6-ft privacy fence for the added privacy and safety of our pets and family (the area is used as a side/back yard). Amerifence of Indianapolis is the vendor and the project would start in mid to late June if approved. C. Statement of Support I, the Petitioner, respectfully submit this petition to request a variance for the installation of a 72-in fence on our property located at 10940 Timber Lane. We believe that granting this variance is necessary to address specific circumstances that affect our property and its intended use. Reasons for Requesting a Variance: i. Safety and Security: The primary reason for installing the fence is to enhance the safety and security of our property and its occupants. A fence would act as a deterrent to unauthorized access, reducing the risk of trespassing, vandalism, and theft. ii. Privacy: Our property is situated in close proximity to the main path connecting both sides of 110th street which compromises our privacy. A fence would provide a necessary barrier for our yard (treated as a back yard), safeguarding our privacy and allowing us to enjoy our property without intrusion. iii. Property Enhancement: The installation of a fence is crucial for the overall enhancement and aesthetic improvement of our property and add to the visual appeal of the neighborhood. iv. Noise Reduction: In some cases, our property may be affected by noise pollution from nearby roads, businesses, or other sources. A fence can serve as a barrier to mitigate the impact of noise, creating a more peaceful environment for residents. v. Pet and Child Safety: As responsible pet owners and caregivers, we are concerned about the safety of our pets and children. A fence would provide a secure enclosure, allowing them to play freely while minimizing the risk of encountering hazards. vi. Property Value: Studies have shown that well-maintained fences can contribute positively to property values. By investing in a fence, we are not only improving our quality of life but also contributing to the overall desirability and value of the neighborhood. We understand the importance of adhering to zoning regulations and guidelines. However, we believe that in this particular case, granting a variance for the installation of a 72-in fence is justified due to the unique circumstances outlined above. We assure you that the proposed fence will be installed in compliance with all relevant safety standards and architectural guidelines. We are committed to working closely with the appropriate authorities to ensure that the installation process is conducted smoothly and efficiently. In conclusion, we respectfully request that our petition for a fence variance be carefully considered and approved. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: This proposed privacy fence will enhance the privacy, security, property appeal and enjoyment of outdoor activities for the homeowners and their pets. It will in no way negatively impact the public health, safety, morals and general welfare of the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: This proposed privacy fence will not adversely impact adjacent property as it is within the confines of our property. The fence is visually pleasing in design and aligned with other fence styles within the neighborhood. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: This property is a corner lot which is subjected to increased vehicle, bike, and foot path traffic which limits the privacy, security and enjoyment our family feels while trying to enjoy outdoor activities. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. ___________________________ is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
