Subject: Request for Variance Approval for Setback at 10838 McPherson St.
Dear Members of the Board,
I hope this leter finds you well. I am wri�ng to formally request a variance approval for the property
located at 10838 McPherson St. Specifically, we seek approval to reduce the front yard setback
requirement from 30 feet to 20 feet for the construc�on of our new home.
Our family has chosen to build our home in the Homeplace neighborhood because of its unique charm
and community feel. Upon reviewing the exis�ng proper�es in the area, we have observed that many
homes do not adhere strictly to the 30-foot setback requirement. A significant number of houses in our
neighborhood have setbacks that are closer to 20 feet. This variance request aligns with the established
character and aesthe�c of the neighborhood, ensuring that our home will fit harmoniously with the
surrounding proper�es.
Moreover, the reduced setback will enhance the safety and privacy of our family. With a 30-foot setback,
our home would be posi�oned awkwardly on the lot, poten�ally exposing it to greater risks and reducing
our usable backyard space. As a growing family, this is a significant concern for us seeking a safe and
private environment.
We understand that variances are granted based on specific criteria, and we believe our request meets
these standards. The variance will not alter the essen�al character of the locality; rather, it will preserve
and enhance the cohesive appearance of the neighborhood. Furthermore, it will not adversely affect
public health, safety, or welfare.

CARMEL ADVISORY BOARD OF ZONING APPEALS

1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare
of the community because:
The current community has homes next to the property with setbacks at or less than 20’ from the road or
right away therefore our request will not disrupt the cohesive character of the area or adversely impact the
adjacent properties.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
All adjoining neighbors currently are less than or equal to the requested setback of 20’ from the road or
right away.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties
in the use of the property because:
Our current backyard space presents significant challenges for our expanding family. Compounded by the
adjacency of our neighbor's property, which extends right up to our property line, our concerns regarding
safety and privacy are paramount. This proximity not only limits the potential for our backyard to
accommodate our family's needs but also raises apprehensions about the safety and enjoyment of our
outdoor space in the future.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. PZ-2024-00074 V is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
