The applicant seeks the following development standards variance approval: 4. Docket No. PZ-2024-00061 V UDO Section 2.04 Maximum 35% lot cover allowed, 38% requested. The site is located at 2993 Topaz Lane (Kings Mill, Lot 116). It is zoned S1/Residence. Filed by Robyn Brown, owner. General Info: • The Petitioner seeks approval for a pool pergola and additional concrete patio area to be added to the lot, which will affect lot coverage. • Related pending building permit is B-2024-00415. • The existing swimming pool was built in the early 2000s. • The site is located in Kings Mill subdivision, and HOA (Homeowners Association) approval has been granted. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Lot Cover - • The UDO requires a maximum 35% lot coverage, and 38% is requested. This is a 3% variance. • The pool pergola and small additional concrete patio area are proposed to be added to the back yard area, but will still comply with side yard setbacks. • The slight increase in lot cover does not cause a concern to the Carmel Engineering Dept.; there is an existing neighborhood stormwater detention pond for the overall neighborhood. Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request. The very small increase in lot cover is not a concern for the Carmel Engineering Dept., and so it is not a concern for Planning Staff. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
