The applicant seeks the following development standards variance approval: 6. Docket No. PZ-2024-00073 V UDO Section 2.06 Minimum 10’ side yard building setback allowed, 5’ requested. The site is located at 11025 Westfield Blvd. It is zoned S2/Residence. Filed by Katy Matthews, owner. General Info: • The Petitioner seeks approval to add two building additions to the existing house (pictured to the right) as part of an overall renovation/remodel. • A variance is requested for side yard building setback. • The site is not located in a Subdivision, so no HOA (Homeowners Association) approval is required. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Side Setback - • The UDO allows for a minimum 10-ft side yard building setback, and 5-ft is requested. This is a variance of 5 feet or 50% change. • The building additions will be added to the front/west side of the house and to the rear/east side of the house. • It appears that the existing house has a 5-ft side yard setback along the north property line. It was built in 1936. Its setback is legally nonconforming (or grandfathered). • However, any new improvements to the site must comply with the current UDO regulations, hence the variance request. • After all is said and done, the building additions and existing house will have an overall comprehensive design/color theme. (Changes are proposed to the existing exterior house materials and colors, too.) Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
