CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
TUESDAY, MAY 28, 2024
(V) 10838 McPherson St., Front Yard Setback Variance.
The applicant seeks the following development standards variance approval to construct a new 1-story
house on a vacant lot:
7. Docket No. PZ-2024-00074 V UDO Section 2.12 Minimum 30’ front yard building setback
allowed, 20’ requested.
The site is located at 10838 McPherson Street. It is zoned R3/Residence and Home Place Overlay Zone.

General Info:
• The Petitioner seeks approval to construct a new home on a vacant lot.
• A variance is requested for reducing the minimum front yard building setback.
• The site is located in Home Place Addition Subdivision; no active official HOA (Homeowners Association)
exists.
• Surrounding this site are single family residential homes and two-family homes.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Front Setback -
• The UDO requires a minimum 30-ft front yard building setback, and 20-ft is requested. This is a variance of
10-ft or a 33% change.
• The existing dwellings immediately surrounding the subject site have front setbacks that range from 21 feet
to 35 feet, and it is assumed that a lot of those are legally nonconforming (or grandfathered).
• The house’s front façade will utilize brick and stone. The sides and rear of the home will utilize horizontal
composite siding.
Remaining Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request.
• Instead of installing a 5-ft wide sidewalk along the lot’s street frontage along the street, they will instead pay
into the Thoroughfare Fund for what it would cost to construct it.
• A landscape plan will be created by the Petitioner after the house is built; they will be keeping most of the
existing trees on the lot and re-seeding the perimeter of the house with grass seed.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
