The applicant seeks the following development standards variance approval: 9. Docket No. PZ-2024-00077 V UDO Section 5.09 (B) Maximum 42-inch fence in the front yard allowed (with at least 25% visibility), 6-ft to 7-ft privacy fence requested. The site is located at 380 Patricia Court. (Woodland Springs, Lot 380). It is zoned R1/Residential. Filed by Jordan Logan, owner. General Info: • The site is a Corner Lot with two street frontages, hence two front yards. • The Petitioner seeks approval for a 6-foot tall privacy fence in the front/north yard. • The street to the north ‘dead ends’ at the west side of the subject property. • The site is located in Woodland Springs Subdivision; and HOA (Homeowners Association) approval has been granted (with the condition of variance approval). • Surrounding this site are single family residential homes. • Fence permit F-2024-00124 is pending. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Fence Height - • The UDO allows a maximum 42-inch tall fence (with at least 25% visibility) in the front yard, and 6- to 7- foot tall privacy fence is requested. (This is a variance of 30 inches, or a 71% change.) • Fences are required to be placed at least 12 inches off of any sidewalk or path. The proposed fence will be located close to 11 feet south of the north sidewalk. • The lot has 35-ft front yard building setbacks along the north and east property lines. Also, an easement runs along the west side of the lot. • Due to the placement of the house and front door on the lot, the north side of the lot serves more like a side yard or back yard rather than a front yard. Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request for a 6-ft tall fence. (A 7-ft tall fence was not supported.) Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, with the condition of it being 6-ft tall at most, and with adoption of the Findings of Fact submitted by the Petitioner.
