Analysis:
This variance request is

property became non-compliant after the City's road widening project along 116th Street. Road right of
way was used for the road expansion, causing the distance between the subject house and the road to
decrease.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: The variance request is for 10.99 feet. This variance
request is the result of a road widening project completed by the City.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: The variance request is for 10.99 feet. This
variance request is the result of a road widening project completed by the City.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the site/property owner will be in
violation ofthe zoning ordinance, through no fault of her own.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket Nos. 07030003 V.
