We strongly object. It is our understanding that the requested variance is to allow for an off premise sign located in the center ofa median in the right of way of Meadow Lane, approximately 50 feet north of Main Street. We own the two apartment buildings .located at 5 Meadow Lane and at 7 Meadow Lane. We have identified our buildings on the attached map we received with our notice ofthe variance request. It is our understanding that the apartment buildings located across the street on Meadow Lane and just north of our buildings are also independently owned. The proposed location of the Stonegate sign presents several problems. First, the sign's proposed location on Meadow Lane will give the appearance that all of the independently owned apartment buildings just north of Main Street on Meadow Lane are part of Stonegate' s property and apartment complex. This could impose an economic hardship on the owners of the other apartment buildings, as prospective tenants will be misled into believing that all of the apartments in the area north of the sign are part of the Stonegate complex. Prospective tenants will then more than likely call Stonegate to inquire about our apartments, thus providing Stonegate with an opportunity to lease their units before a prospective tenant even learns that apartment buildings along Meadow Lane have a different owner. Second, the proposed sign will associate our apartment buildings with Stonegate; our reputation could suffer if our apartments or our management are somehow viewed in a negative manner in the event Stonegate should have a negative reputation, or a tenant is not satisfied with their experience living at Stonegate. Finally, the proposed sign will impede the aesthetic nature of the area and will create an eyesore and potential hindrance and. distraction to motorists entering and exiting this neighborhood from busy Main Street. ..... By way of background, Van Rooy properties purchased the Stonegate apartments about 2 1/2 years ago. In the last few months, Van Rooy decided to replace the old signs with new, more attractive signs. One of the signs happened to be an off premise sign located in the median of Meadow Lane that has existed for several years as a prior legal, nonconforming use. At the time the signs were replaced by the sign company, Van Rooy was notified that, due to the replacement of the off premise sign, it lost its status as a prior legal, nonconforming use. The City requested that Van Rooy remove the sign immediately or file a variance request. Van Rooy filed the variance request and also removed the off premise sign in an effort to be a good citizen. Van Rooy has serious concerns that its request will not be granted. As you can imagine, the location of the off premise sign is very important to Van Rooy as the Stonegate Apartments are set far back off of Main St. and not easy to locate absent the sign. Regarding the appearance of the sign, the sign is no bigger than its predecessor, and it also is now made of wrought iron and is generally more attractive. Van Rooy is also willing to landscape around the sign as Carmel would request. I would like to call you sometime this afternoon or tomorrow morning to discuss as I will be out the rest of the week. I have recently discussed this issue with the Building Commissioner and the Engineering Department of the City of Carmel and we have reached a decision in this matter. You have until the end of business on Friday, January 27th to have a variance petition on file with the Planning and Zoning Office to attempt to legally establish the location of your off-premise advertising signs located on the grass median on Meadow Lane. If the Board of Zoning Appeals approves your request at the hearing then a Consent to Encroach will be the next step in this process. I must inform you that the staff will not be in support of your request and that the BZA may not look favorably upon your petition as well. We are granting you this last extension in an effort to allow you to pursue a remedy to your current situation. If no petition has been filed by the stated deadline I will have no further recourse than to have the signs removed and your company will be billed the the entire expense of removal and enforcement. Because the Mayor was unavailable, I took the call. He has a sign that has been found in violation of our Sign Ordinance by being in a median in the vicinity of the Stonegate Apartments. I did confirm to him that these type signs do violate our sign ordinance. Mr. Watson is desirous of discussing any possible action that he might take to gain an exception to our rules regarding his sign. I suggested to him that I would have someone in the office responsible for the Sign Ordinance to contact him, and he is fine with that idea. I am sending this note to you for further action.
