1. This Item will not appear on an agenda of the Technical Advisory Committee.
2. Mailed and Published Public Notice needs to occur no later than Friday, March 16. Published notice is required within
the Indianapolis Star. Note: the placement of a public hearing sign on the property is required; see attached pdf.
3. The Proof of Notice will need to be received by this Department no later than noon, Friday, March 23. Failure to
submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley no later than
NOON, Friday, March 16. Failure to submit Informational Packets by this time will result in the automatic tabling of the
petition to the April agenda.
5. This Item will appear on the March 26, 2007 agenda of the Hearing Officer of the Board of Zoning Appeals under
Public Hearings.
6. The petitioner will need to provide a fully filled-out Findings-of-Fact sheet for each petition the night of the meeting for

The Carmel Department of Community Services (DOCS) is committed to facilitate
resolution of the building setback and bufferyard issues for the Schneider parcel,
10321 Pennsylvania Street, which will be created when the City of Carmel
acquires the additional right-of-way necessary for construction/widening of
Pennsylvania Street, per the plans of the City.
DOCS will initiate the variance process as co-petitioner with the property owner,
proposing to the Carmel Board of Zoning Appeals (BZA) adjustments to the
minimum front-yard and bufferyard standards in the Carmel Zoning Ordinance for
B-7 Business zoned property. These variances will eliminate any illegal non-
conforming status created when the City closes on the portion of ground owned
by Mr. Schneider for public street right-of-way.
The DOCS participation will be initiated upon receipt of a legal right-of-entry from
the property owner. Upon such receip~, the DOCS will complete the steps
required fora petition to appear on the BZA's docket, including any certified
mailings to adjacent property owners, and submitting public legal notice in the
newspaper. DOCS will be supportive of the variance requests, and will
recommend BZA approval. There will be no filing fee or other cost typically
associated with such a petition.
The DOCS will need your help to have iprepared maps and exhibits of the
property to submit to the BZA as part of the overall submittal.
It is anticipated the right-of-entry can be obtained in sufficient time to allow the
variances to be heard at the February 26, 2007 Board of Zoning Appeals
meeting.
