As I recall from our last conversation, the target date for the closing on your
property is late August, 2003. While we have hot received any official
I
communication regarding the disposition of tile closing, we have received telephone
calls which suggest that we need to reiterate a~d clarify the issues which both we
and the City of Carmel would prefer to have resolved prior to Closing.

The first issue raised by the prospective purch~sers is that they do not desire to be a
part of the Laura Vista Homeowners' Association. In earlier conversations, we have
indicated that we are amenable to their exclusion. If they are exempt, thev will not
receive anv assessments and will not be permitted to use any areas defined as
Common Areas of Laura Vista. as those areas ~re created for the exclusive
enjoyment of the Members of the Homeowner's Association.

The next issue is whether "Lot #55" (your property) remains within the Laura Vista
Plat. Jon Dobosiewicz's letter of August 14, 2~03, (copy attached) addresses this
matter. If the property has to remain within the Laura Vista Subdivision
Secondary Plat, we understand that the prosp~ctive buyers prefer not to be
controlled bv the Laura Vista Covenants. Conditions and Restrictions which have
been developed and will be recorded with the Secondary Plat. If that is their
decision, we need to be advised. Prior to closing, we desire to receive a written
commitment from you that is recorded, or from the Buyers, that the owner of the

property will sign the Laura Vista Secondary Plat. The other option, per Jon
Dobosiewicz's letter, is to create a separate plat for what is currently shown as Lot
#55. Either approach is acceptable to the City and to us. The burden of re-platting
would be yours or the buyers.
With respect to access, the buyers have two options: (1) continue to use the existing
easement to Danbury Subdivision or (2) create a new driveway over land defined as
"Block B". During recent conversation we were led to believe that the latter is their
preference. Again, we would like to be apprised of the status. The purchase offer

has a condition of "Block B" being transferred prior to closing. This cannot and
I
will not haDDen. as it would reDresent a violation of conditions of aDDroval from the
City Several months ago we drafted an "Ag~ement" which has as an exhibit a
"Termination of Easement Agreement". These documents were created to provide
assurances to both parties regarding what would happen if the development
proceeded or if it did not. These documents h~ve not been executed as of the date of
this writing. One approach that could addres~ the buyer's concerns would be to

execute and record those documents prior to c.osing. The Termination Agreement
essentially provides that the easement continues to exist until such time as Laura
Vista streets are constructed and accepted by the City of CarmeL Once that occurs
it triggers the release of the easement and Laura Vista quitclaiming the property
known as "Block B".
With respect to "Block B" transfer, we have explained to the buyers that we have
some concern with respect to what happens o~ the property and therefore would
convey with some recorded restrictions. To further clarify, we see those covenants
as follows: I
1. Block B permitted uses are: (1) hard surfaced driveway, either asphalt
or concrete, (2) fence (subject to architectural approval by the

Board), (3) landscaping, including grass, (4) entry gate and
electrical service to serve ~aid gate (location of gate to be
approved by Laura VistalHomeowner's Association Board).
No other uses or structures shall be permitted on the premises.
2. Owner shall comply with all City of Carmel ordinances and
regulations with respect to use and maintenance of the subject
property. I
As noted in earlier conversations, our legal documents (e.g.- Homeowners'
Association Declaration, Articles, By-Laws, and Covenants, Conditions and
Restrictions) will all require modification by our counsel, Steve Robinson. I have
placed this activity on hold until we are advised of the final decisions affecting those
documents. Our expectation is that the legal expense to modify our existing
documents will be born by either you or the buyers.

This letter is in response to our recent discussion regarding Lot 55 within the Laura Vista
Subdivision. As you noted it may be the desire of the Ilowner of the property to remove the parcel
from the plat, have access as proposed to Laura Vista prive including construction of a drive and
gate and ownership of Block "B", maintain access to !Dublin Drive within the Danbury
Subdivision, and not have the lot subject to the covembts and restrictions of the neighborhood.

As you may recall this property was added to the subdivision plat with the consent of the owner
in order to among other things eliminate several zonink and subdivision violations including but
not necessarily limited to a lack of frontage on a public street, access to the parcel via an unplated
easement, and setback requirements for an accessory structure. Other issues are also present
regarding access to this parcel including the constructi~m of a portion of the Cool Creek North
I
Trail and the provision of a new access drive to the site within Block "B" of the subdivision.
The following are items to be noted when proceeding With the project:
1. That access to proposed lot #55 is restricted to the existing ingress and egress easement to
Danbury Drive until such time that said easem~nt is vacated. Only upon vacation of this
easement may a drive be installed within the proposed Block "B" for Lot #55 onto Laura
Vista Drive as shown on the Secondary Plat dnd Construction Plans. The owner of the

property identified as "Lot 55" is aware of this pondition as they spoke at and attended the
public hearing' and granted their consent to the fifing of the Primary Plat application.

2; The Department of Community Services will inot grant approval of the Secondary Plat
without one of the following: A deed restriction on Block "B" stating the an access drive
I
and/or gate shall not be constructed on Block j'B" until such time as the vacation of the

easement noted in item one above is complete or that this condition of the Primary Plat
approval is satisfied prior to approval of the Sedondary Plat.

3. Removal of Lot 55 from the Laura Vista Subdivision Primary Plat would require a replat
application and public hearing in front of the IPlan Commission. It is not likely that the
conditions as noted above would change. Removal, of the lot from the Laura Vista Plat
would require the creation of a new subdivision of one lot.
4. No Building permit could be issued for construction of any type on Lot 55 due to the
technical violations noted at the time of the Prirhary Plat review process until the Secondary
Plat is recorded.
5. The Covenants and Restrictions do not have to apply to all the lots within the subdivision.
Lot.55 could be excluded form the covenants intended for the rest of the lots within the
subdivision and even platted as a separate section.
Our approval of the secondary plat will be forthcoming upon adequate resolution of the items
listed above. .

PROJECT COMMENTS-PLAT I
Item #2: "Consent to Encroach" is only granted when it can be determined that a specific
encroachment will not adversely affect the function of an easement or the utilities
contained within it This means that alII the details of the encroachment must be known
before approval is granted; therefore, it Iwould be impossible to grant a "Consent to
Encroach" for each lot until the individ~al construction plans for each lot are set and a
building permit is pursued, Typically, Consent to Encroach Agreements are required
with side load garages and smaller lots rhen the ,driveway is forced into the side yard
easement, parallel with the easement, and possible conflict with drainage and/or
underground utilities. Other encroacbJents might include fences, decks, signs, irrigation
systems, etc. These Agreements are re~uired to be recorded and remain with the
property, regardless of the owner. I will certainly be available for assistance in the
preparation of these Agreements. I
PROJECT COMMENTS-CONSTRUCTION PLANS
Item #6: Flood limits have been shown to the satisfaction of the City. However, please show the
proposed contours along the boundary between Common Area "A" and lots 24 thru 27 to
establish that the proposed grades will put these lots above the 100-year flood elevation.
Because of the better than average slopb (1.5%) in the rear yard swale of Lots 19 thru 24,
the City will not require a catch basin tb be installed within this swale. However, in the
future, an effort should be made to inclhde catch basins at a reasonable spacing in all rear
yard swales in order to provide adequate drainage to the swale as well as a direct storm
sewer outlet for the site improvements hnd equipment such as sump pumps, roof drains,
and subsurface drains. I

Item #13: It should be understood that regardless rfwhether the Faust's vacate their driveway
easement or not, the Alternative Transportation Path (ATP) will be constructed.
However, it would be advantageous to klLparties if the Faust's drive can be relocated. In
that light, it may benefit Primrose to participate in the cost of construction of the new
Faust Drive to help facilitate the vacatibn of the existing easement. The alternative, if the
Faust's do not vacate, would be for Prikose to construct the A TP at an alternate location
(approved by the City) which would likely result in a higher cost. To clarify, the City's
main interest in this matter is that Prirlose takes the necessary measures to encourage the
Faust's to vacate the existing easementl If this can be accomplished without Primrose's
participation in the construction ofthe hew Faust Drive, the City will be satisfied in this
matter. I
Item #15: Item #15 of the City of Carmel Depamrent of Engineering Letter dated February 3,2003
was referring to the A TP (Cool Creek ~orth Trail) Not the 6 ' Multi-Use Path. A "PR"
Line should be established indicating the trail Center Line from the North Property Line
to the West Property Line of Laura Vi~ta. If the existing drive is not 12 feet wide
already, it should be widened to matchlthe Cool Creek North Trail typical cross section
width, which includes 12 feet of pavement width with 2-foot stone shoulders on each
side. The section of the existing drive Ithat is to be used as part of the ATP shall be
resurfaced to provide smooth transitions and uniformity with the new trail segments. The
minimum easement width for the A TPI should be 25 feet and should be centered on the
A TP and extend from Property Line to Property Line. A note indicating the 25' easement
for the ATP should be added to the Plat and the Construction Drawing
Additional Items: The Engineering Department has conclrns about the manner in which drainage, sanitary,
utility, and path/trail easements have bben represented in the construction documents and
on the plat. The note found on the Plat and the Construction Drawings referencing
various easements "to be centered" onlphysical features is not the proper procedure for
implementing accurate construction orl easement recordation. Further coordination with
Jon Dobosiewicz and the Department Of Community Services will be required in order to
ensure that all easements are clearly d]lfined on the plat before it is approved and
subsequently recorded.

As you are aware, Hamilton County Highway epartment is constructing the "off-
ramp" from Keystone Avenue to 146th Street. Last week I was contacted by Dave
Lancet, American Consulting Engineers, cons Itant to the County for the
aforementioned project, and informed that th beams for the bridge over Cool
Creek would be set this week. I have spoken Jith a representative of Reith Riley
who wiD perform the work and have been info ed that the target date is February
19. The installation of the beams creates a lim ted clearance issue for our connection
to the existing sanitary sewer manhole since th manhole is located under the
proposed bridge on the south side of Cool Cre k (refer to attachment).
Consequently, Jim Neal, County Highway En .neer, suggested that it would be
appropriate to make the connection prior to t~ bridge completion and has given
verbal consent for Primrose Development to mrke this connection.
I appreciate your discussing this matter with the representatives of the Carmel
Engineering Department and Community senjices. It is our understanding that
making the connection to the existing sewer manhole is acceptable to the City
provided inspections are made during the proc~ss. We presumed that the most
logical manner to accomplish this is to run the ~onnection back to the east (onto our
property) and install the western most propose~ manhole on our property. I have
scheduled Schneider Engineering to stake the llignment for Valenti-Held. This wiD
help us further evaluate the impact upon the e .sting trees and to determine the best
route for the sewer lateral.

I have contacted Valenti-Held and they have Jeen authorized to perfonn the work.
They have been provided Dave Lancet's name I as the on-site coordinator for the
Hamilton County Highway work and also been instructed to notify your department
with respect to inspections that must occur. ~I hen I spoke with Dave Held, Valenti-
Held, late last Friday, he intended to move eq ipment onto the site by Monday;
however, I am not aware of what delays might be caused by the snow storm and up-
coming weather, so I will have Valenti-Held c . tact your office.
Dave understands that no installation is to be ade without notification to your
office.
I want to thank all the City Departments for t eir cooperation in helping make this
work possible with short notice.

PROJECT COMMENTS-PLAT I
Item #2. We continue to see an increase in situations where "positive drainage" is not being
accomplished along the side yard prop~rty lines, many times due to these tight building
constraints. Add to this any side-load garage and/or landscaping that may be done and the
potential for ponding to occur in low pbcket areas is inevitable. All lots will be reviewed
upon completion of the building and gtading to assure proper drainage is in place prior to
any certificate of occupancy being graJted. Additionally, ALL encroachments into the
side yard easements (including drivewhs) will require Board of Public Works and Safety
approval via a "Consent to Encroach" ~greement.

PROJECT COMMENTS-CONSTRUCTION PLANS
Item #6. Flood plain limits follow approximate contour lines. This is how they should be shown.
I
Please provide verification that areas of the site that are below FEMA map elevations, but
scale out of Zone 4A, are in fact not in ithe flood plain. We maintain that more accurate
floodplain limits need to be shown. As Icurrently shown, the floodplain line falls within
the creek itself. If necessary, use the I qo year BFE (base flood elevation) values that
follow the topography. Also, please inClude within the legend that the M.F.P.G.
represents the Minimum Flood Protectfon Grade (the word "Grade" was left off) and
include the specific language that "No 6pening on the structure (including walk outs or
basement windows) shall be allowed below this elevation".
Suggest that a catch basin be place in the rear yard swale between Lots 23 and 24 with a
12-inch or IS-inch pipe running north and connecting to Structure#606. The invert at the
new catch basic would need to be a mirtimum of 812.06' to maintain a .27% slope.
Adjust rear yard grades to maintain a ~nimum of one-foot of cover over the pipe.
We do not believe that if this drive is to, be constructed, that it is to be constructed
entirely by others. It was our understanding the cost was going to be shared between the
County and the Developer. :
We will not approve plans that do not i*clude all information relative to the construction
of this path. This would include survey~reference information, elevations, dimensions,
any pipe crossings (for surface drainagd), and/or other information to help illustrate the
physical parameters of the path. We nedd to be comfortable regarding the construction of
this path and how it is to be accomplishbd in the field. We will not allow it "to be worked
out in the field". . I

6. Weare still working with and awaiting indi~ation of the location of the A TP path by the
City of Carmel. In addition, we are going tllrough the process of securing a DNR
Construction in the Floodway Permit for the 6 foot multi-purpose path located on the
south (east) side of Cool Creek as shown on CIOI & C102. It is the developer's
understanding that any additional DNR permits for the A TP Path or any connecting paths
required within or outside the project limits kill be secured by the City of Carmel or
appointed agent.
7. The inter-local agreement was withdrawn in light of the fact that the annexation process
has been initiated and anticipated to be appr0ved no later than January of 2002 by the
City of Carmel.

Dear Jon:
I spoke with Dick Hill of the Department of E gineering earlier this week and
understand that we should have Engineering' review comments within a day or
two. Once received, Schneider Engineering w n make the appropriate revisions to
the Laura Vista Plat. I presume that you are ~n receipt of the letter from Keith
Albrecht that addresses the prohibition on any future development of the
undeveloped parcel located north and east of Laura Vista (map attached). Given
the Fire Department's request for a temporart cul-de-sac at the north end of Laura
Vista Drive, it would be our intent to construct a permanent cul-de-sac at that
location. I have had Schneider Engineering dfl velop a revised sketch of how this
could happen (copy attached). If you do not h ve an objection we will plan to
formalize this change to the Secondary Plat.
Our Secondary Plat has a proposed "access easement" for the Fausts, which can
occur only if they vacate their existing ease~e!t to the north. We continue to work
with the Fausts on this and related concerns. rresuming that we can get them to
agree to release their easement, would there be any problem if we quitclaimed the
area currently shown to be a twenty-four foot I ide easement? It occurred to me
that this might make more sense and provide he Fausts additional comfort since
they could "control access" to the area andw at occurs within the driveway area.
Additionally, maintenance would be their res onsibility. In accomplishing this, as
Developer, we will want to place some restricti ns on what can happen and how it
happens (e.g.-architectural review). Just as is he case for the easement, we would
not quitclaim the property until the easement s released.

We will likely have some timing issue as their rivate driveway may be constructed
before we have the public street segment cons ructed that links their private
driveway to existing public streets. Anticipaf g this, I would hope that the City
would permit, on a temporary basis, their con inued ingress and egress on the
existing north-south driveway easement until he dedicated street connecting Laura
Drive is in place.
I would propose a release of the existing ease~ent that states that the existing access
easement is terminated as soon as Laura Vist public streets providing the "link"
between their easement (or property frontage in the event of a quitclaim), is in
place and accepted by the City of Carmel

Dear Mr. Dobosiewicz:
Jim White of Primrose Development LLC requested that I address the status of
the property located immediately north and ~djacent to the proposed Laura Vista
project and west of Foster Estates. This ap~~roXimateIY 4-acre tract was recently
purchased from Bayview Development Com any, Inc. As the owner of Lot 233
in Foster Estates (14418 Jeremy Drive) I pur hased the property with the intent
of "protecting the rear of my property" from a Y future development. In recording
the deed I established a deed restriction that Iprecludes selling the subject
property for the purpose of developing the prbperty.
Mr. White has indicated that given the restricJions on development that have

Jim White of Primrose Development LLC re~uested that I address the status of
the property located immediately north and rdjacent to the proposed Laura Vista
project and west of Foster Estates. This approximately 4-acre tract was recently
purchased from Bayview Development cO~lpany, Inc. As the owner of Lot 233
in Foster Estates (14418 Jeremy Drive) I pu chased the property with the intent
of "protecting the rear of my property" from ny future development. In recording
the deed I established a deed restriction that precludes selling the subject
property for the purpose of developing the p!roperty.
Mr. While has indicated that given the restri~ons on development that have
been imposed, Primrose Development LLC intends to construct a permanent
cul-de-sac at the north end Laura Vista Drive. This road configuration is totally
acceptable to me, as we would not anticipatb any future need for a road to

PROJECT COMMENTS-PLAT
1. Why is the easement between Lots 27 and 28 a access easement in addition to being a Drainage
& Utility easement? We will want to assure th no encroachments are allowed (driveways too as
they may have basketball goals, etc. impeding a cess).
2. 65-foot wide lots are very narrow. We have co cern about sides oflots being graded properly to
grade and the potential impact of any side load arages.
3. Irregular easement on Lots 49, 50 & 51 is sligh ly confusing as to bearing of easement line.
Please clarify easement lines on Lot 49 as to w ich ones are parallel to other bearings and/or
extensions of other easement lines.
4. The 3rd member of Board of Public Works and afety, Lori Watson, can be added to signature
page.
PROJECT COMMENTS-CONSTRUCTION PLAN
5. Show spot elevations at rear lot comers (Lots 4 through 54 and 19 through 27) even if this is to
match existing. Show proposed contours fittin into existing. Is the fence to remain?
6. Show more realistic flood plain limits and 100- ear floodway along rear lots adjacent to creek.
7. We want consistent, good grades on rear swale .
. Lot 1 to Lot 4 should have approximatlY 1.42% all the way. We want no less than 1 %
achieved on as builts.
. Please revise rear spot shots to achiev consistent slope.
. Behind Lot 5/6, raise rear elevation to ~15.6 (so swale slope is 1.42%, similar to other

Dear Jon:
I am in receipt of the meeting minutes from t e Technical Advisory Committee
meeting regarding the abovementioned proje . Since there were multiple issues
raised at that meeting, I am writing to update you on their status.
It is our understanding that annexation of the Laura Vista site and other adjacent
area is being pursued by the City of Carmel. ith respect to the development
standards, you had noted the need to have an. ter-Iocal agreement in place since
annexation will not occur until approximately February of 2003. Subsequent to the
T AC meeting I confirmed with Charlie Frank nberger that he is pursuing the
formalization of such an agreement on Prim e's behalf.
With respect to the County Highway's comm nt that the State Highway
Department "does not want the County to all w anything in the right-of-way right
now", I contacted the State Highway Greenfi d Office to request clarification. This
is a pivotal issue to the Laura Vista Project a d frankly a "deal killer" if sanitary
access cannot be accomplished via this route. rrhis was totally unexpected comment
as we had conducted a preliminary conversatibn with the County and were led to
believe that access would not be an issue. Aft r several telephone conversations, we
are to understand that the State Highway De artment has stopped construction on
the off-ramp until the County acquires all its pprovals. Additionally, the City of
Carmel desires access to the right-of-way for t e installation of a water line.
Consequently, the State is setting a meeting w th representatives of all these affected
projects for early November, 2002. I remain opeful that a "Crossing Permit" can
be obtained.

As you are aware, the Engineering Departme t received plans at the meeting. We
are currently awaiting their comments. Bran on Burke. Schneider Engineering, is
also attempting to get more information from he Engineering Department
regarding the details of the A TP path.
Regarding Scott Brewer's comments, I have S hneider Engineering working on the
necessary plans and detail to address (1) tree reservation, (2) protection of trees
during construction, (3) language involving w at can happen within tree
preservation areas, (4) entry signage and land caping detail and (5) street tree plan.
&hneider Engineering is revising and clarifyi g the erosion control plan sheets to
address the Soil and Water Conservation's 0 Ice concerns.
The Fire Department continues to request the temporary cul-de-sac on the north
end of Laura Vista Drive. As you requested, have confirmed that a small group of
Foster Estates residents that "back-up" to the "Bayview Development" undeveloped
parcel located north of Laura Vista and south of Cool Creek have purchased the
property. The minutes state that that Foster states Homcowners' Association
purchased the property. That is not true. Fu hermore, it is my understanding that
these residents intend to record a restriction t at precludes development of the
property. I am currently attempting to get a ritten confirmation from them.
Given this scenario, I have directed Schneide Engineering to design a permanent
cul-de-sac at the north end of Laura Vista Dri e.
The minutes also state" Gary would like to s a temporary turnaround at both ends
(reference being to Laura Drive)". From my call this statement is incorrect. The
Fire Department indicated that the north end as the concern and that the south
end of Laura Vista Drive was acceptable. Co sequently, we plan no chane:e to the
current street design on the south end of Lau Vista Drive.
We are in contact with the Postmaster to und rstand their concerns and address
them.
Finally, I was contacted recently by Jim Neal f the County Highway Department
regarding access to the site so he could better ssess the amount of clearing and
grading that would be required to construct a private drive for the Faust. I remain
hopeful that the County will be able to assist t e Fausts financially so that they can
be convinced to release their easement in favo of the new easement. We estimate
the driveway construction to be a $22,000 issu .

Carmel Clay Historical Society: There are no objecti ns to the Use Variance, but no landscape
plan has been submitted with the Development Plan Comments will be made after a landscape
plan has been submitted.
Lakeside Park. Section One: The Landscape Plan fo the Secondary Plat and Construction Plans
does not meet the Open Space Plan. Landscape Pia ,Buffering requirements, and Tree
Preservation Plan commitments submitted for the ap roved Primary Plat received by this office
on August 29, and September 10,2002. The Secon ary Plat plans and Construction plans must
meet, or equal these approved plans.
Sheet 6 shows the installation of a storm sewer betw en yard inlet 159 and yard inlet 160. This
sewer installation bisects a tree preservation area (C mmon area #1). The installation by
trenching through this tree preservation area is not a ceptable. Sewer installation through tree
preservation areas must be accomplished by tunneli g to sufficient depth not to injure trees in the
woodlands; otherwise, drainage should be accomplis ed by grading, earthwork, or trenching
outside the tree preservation areas. These wood Ian preservation areas are primary natural
opens pace conservation areas.
Lakes at Hayden Run. Section Two: Four "street tree .. shown along Lorenzo Boulevard on the
Primary Plat are missing from the Secondary Plat Ian scape plan for Section Two. These need
to be replaced. The developer's commitment to plant at least one large maturing shade tree near
the street but outside the right-of-way in the front of e ch lot not on Lorenzo Boulevard (a county
thoroughfare) must be included in Section Two as it as in Section One. The individual amounts
for species are missing from the submitted landscape plans. These must be added to the plan.
The Primary Plat Landscape plans show the woodlan on the north perimeter being saved in its
entirety. The Section Two plans show an encroachm nt into the woods by lots, a drainage
easement, and a 6' asphalt path. Sheet 22 shows Tr e Preservation Detail F (fencing), but there
is no corresponding fencing on the Landscape Plan. his woodlands in its entirety is a primary
conservation area on the open space plan for this sub ivision as submitted to the Carmel Clay
Plan Commission on October 21,2001, and subsequ ntlyapproved. This issue must be
resolved before this plan can be approved.
Fence row or native trees along the north-east perime er should be preserved by utilizing tree
protection measures as well.
Villaae of West Clay. Helen Wells Buildino:
The Villas at Sweet Charity Farms: Landscape plans ust include planting notes and graphic
planting details. Please also include a diagram detaili g required bufferyard plantings and
proposed plant numbers. Any additional shade trees mmitted to be planted in the front yards of
lots must be near the street but outside the right-of-wa . Please detail the species of the 102
shade trees committed for the 51 lots on the landscap plans.
Additional plant materials for buffering should be adde behind Lots 1-7 and along the path
between Benevolence Court and Beaument Boulevard South to screen views into the PSI
property. More should be added along the east perim er south of Lot 27. It my suggestion that
the open drainage on the south east corner be graded utside the existing strip of brush and
woods.

Laura Vista Subdivision: Due to the wildlife in this ar a, connectivity of the common areas should
be a priority. The US Fish and Wildlife Service has a knowledged this riparian corridor (forested
floodplain) as an ecologically sensitive area (possibl habitat for the federally protected Indiana
bat) that should not be disrupted. A written tree pres rvation plan needs to accompany the
secondary plat including graphic details of the tree a d all woodland protection measures.
Wooded common areas need to be listed as tree pre ervation areas on the plat and in the
neighborhood covenants. Requirements and allowe activities must be detailed for tree
preservation areas within the neighborhood coven an s.
If a monument !)ign is proposed, a plan of the sign th required landscaping must be submitted.
There has been no landscaping plan submitted at all. If one is not proposed, a written
explanation must be provided. I will be glad tomeet eparatelyand on site if needed. Shade
trees should be planted along the portion of the multi use path from Laura Vista Drive west to the
woods. (Path on plat?)
Clav Terrace: There have been significant changes b tween the Rezone PUD plan and the
Development plan currently submitted. The current p an does not include any landscaping, tree
protection, or reforestation plans as required with the Rezone application. Comments will be
made when those are submitted. The areas to plant he required landscaping and reforestation
seem to have significantly lessened due to changes i storm water detention and change of
layout.

the disturbed areas. I think it best to leave the wooded ar as undisturbed.

from the northwest comer of the pond, contour 815, alo g the south side of the pond, along the east side of
