The sign size was amended from the original submittal of 118.5 sq ft to 99 sq ft.
Yes, that was an error; he probably thought the building width was greater than 250 feet,
resulting in the 100 sq ft calculation. The Oak Street Mortgage Sign should only be 75 sq
ft in area, based on the freeway sign chart. Bldg width = 220 ft I & sign distance from
R/W = 130 I ft. The existing sign is 99 sq ft in area.
The Department has determined that the Oak Street Mortgage sign may exist as is. However,
if this sign is ever removed, the next sign to take its place on that frontage must meet
the square footage determined by the freeway sign chart.
As for the 2nd wall sign to face US 31 (south of the Oak Street Mortgage sign), this
sign's approval will remain as approved on Nov. 1.

Thanks for the info. I do notice on Jon Dobosiewicz's docket assignment e-mail where you
highlighted that, in addition to saying a variance is required due to size, it says that
"100 square feet is the maximum allowed by Ordinance". Is it possible that the original
filing was for a sign in excess of 100 sq. ft. and that they amended their request to the
99 sq. ft. sign that the permit reflects? That would explain how the permit got written
without a variance.
However, I still haven't figured out for sure where Jon got "100 Sq. ft." To be permitted
that amount currently, the building frontage would need to be "over 250 feet" per the
existing 'Sign Chart B: Freeway'. When I figure it, I don't get any more than 225 feet for
the building frontage. Do you think that was just an error on Jon's part or did this 'Sign
Chart B: Freeway' figure get changed in the amendment per Ordinance No. Z-433-04, which
amended 'Sign Chart B: Freeway'? In which case, if it did, the sign did meet the Ordinance
standards in place at the time.
If the Ordinance did permit 100 sq. ft. per Jon's e-mail, then the sign is legal and we
shouldn't have to do anything. If Jon made an error and 100 sq.
ft. was not permitted back then, how many hoops do we need to jump through to correct the
City'S error? Do we need do anything? If you determine we do, can we simply send a 10 day
notice and give a 10 day paper publication and piggy back with the existing petition - at
no cost to my client?

Attached is the scanned docket no assignment email from 2002 issuing the docket no for Oak
Street Mortgage and stating that a variance will be needed for square footage. It was then
the petitioner's responsibility to follow up with the variance application submittal,
which never happened.
The docket nos. on the Oak Street sign application were placed there by Dawn, to show all
related petitions for that site, not necessarily for the sign, itself.
Also, below are the meeting minutes for the Oak Street ADLS amendment in Oct.
2002:
7. Docket No. 134-02 ADLS Amend- Oak Street Mortgage
petitioner seeks amended Architectural Design, Lighting, Landscaping &
install a new wall sign. The site is located at 11595 North Meridian.

Rom Ely with the Sign Group, Inc. appeared before the Committee seeking approval for a new
wall sign, internally illuminated, channel letters with ivory faces at the north end of
the west elevation of 11595 North Meridian Street. The signage will match the existing
with the office complex.
Laurence Lillig said the Department recommends favorable consideration once all Committee
concerns have been addressed.
Paul Spranger moved to approve Docket No. 134-02 ADLS Amend, Oak Street Mortgage,
conditioned upon the level of illumination being acceptable to the Department. The motion
was seconded by Pat Rice and APPROVED 5-0.
I assume you will want to table the current variance petitions to take time to include a
variance for the Oak Street sign square footage. Let me know if this is not the case.
(Regarding the 2nd sign facing US 31, I am sure we can resolve the square footage allowed
for the 2nd sign, based on what the Subdivision committee approved Nov. 1, 2005. I will
discuss this with Mike Hollibaugh.)

I assume that docket number 134-02 ADLS Amend. listed on the front of the Sign Permit
Application is the ADLS approval for the Oak Street Mortgage sign? If so, what do the
Staff Report and meeting minutes state with regard to this sign and its size? Also, there
appears to be at least 3 variance docket numbers listed on the front of the Sign Permit

Appiication V-40-85,
V-14-88 and V-90-89. What were these variances for? If any of these were for signs (and
why list them as "Required Approvals" if they were not), then perhaps one of these
previous variances was used by staff to authorize the Oak Street Mortgage sign (if it fit
within the "box" of the previous approval, then all staff would have required is a new
ADLS). I do recall that David couldn't find one of the variance files when we were
researching this site for old variances. Perhaps this missing file is the variance that
was used to authorize the Oak Street Mortgage sign. Maybe this "lost" variance file is
misfiled in the 134-02 ADLS file? We do know for a fact that this building used to have
two signs on the west (Meridian) fa~ade and we all know that this would have required a
variance.

In any event, it appears the sign has ADLS approval, it appears they got a sign permit
having fully disclosed the size of the sign and it appears they constructed a sign in
conformance to the permit they obtained.

Upon further research, the Oak Street Mortgage sign NEVER received a variance for its
square footage in excess of what the sign ordinance allows for a sign facing the freeway.
Even the sign permit has a note attached to it stating that the sign should have had a
variance and it is a non-conforming sign.
The best thing to do is to table the current variances being sought and add an additional
variance for square footage for the Oak Street mortgage sign.

As you will recall, the Subdivision Committee, who does not normally hear ADLS petitions,
heard our request Tuesday night for a new sign on One Penn Mark and reduced our requested
105 sq. ft. sign size because "it wouldn't be fair to Oak Street Mortgage to approve a
bigger sign for a new tenant".
As you can see from the attached, the Oak Street sign did in fact have a variance and it
is 99 sq. ft. in size. The Committee's action limited our new sign size to 75 sq. ft. - 24
sq. ft. less than the Oak Street sign. In trying to be "fair", I think the result of the
Committee's action was to actually be "unfair" - and its decision was also certainly
inconsistent with previous approvals by the Special Studies Committee.
My question to you is, do we have some avenue available to try to correct this now or do
we need to wait and see exactly what size sign the tenant desires and only try to correct

Please accept this letter as a request to change the sign type for Oak Street
Mortgage. The original sign was to be reverse channel halo illuminated
letters, consistent with the signage north of 116th and Meridian. We are
requesting ADLS approval for internally illuminated channel letters with ivory
fates to match the signage south of the 116th and Meridian Intersection in the
Penn Mark Plaza. Oak Street Mortgage Is south of the intersection, 11595 N.
Meridian.
I have also submitted revised drawings and the landlord approval for your
