Subject: Cherry Creek Estates Drainage Easements
Gary,
Thank you again for call1ing me back yesterday regarding the driveway encroachments of
drainage and utility easements in Cherry Creek Estates. This is something that we have
done on many lots in the past in this community and it hasn't been a problem in obtaining
building permits until I received notice from the Code Enforcement Dept. that Lot #207's
permit was on hold due to the driveway encroachment represented on the attached plot plan.
I would like to request a variance for this encroachment. As we discussed, in future
developments we and Platinum Properties need to pre-plan our projects to take these
easements into consideration in the design of our lot widths and avoid these situations
all together. However, I think we will encounter this issue on several more lots in Cherry
Creek Estates since the development of the remaining lots for the community is compleqe.
If it would be acceptable to you, as a formality Pulte can submit these variance requ~sts

for any lot where we have this same situation for the remainder of affected lots in this
community. I will make our Land Development Manager aware of this immediately so that he
can make sure we are planning for these easements in future projects in the City of
Carmel.
