Dear Mr. Kotsanos:
Thank you for your request received April 24, 2000 seeking information concerning a 100-year
frequency flood elevation determination on a tract of land along Williams Creek. Based on your'
description, the parcel, which lies in the SE y.. of Section 27, Township 18N, Range 3E, is located at
13011 Southampton Court in Carmel, Hamilton County.
Based on information in this office, the 1 OO-year frequency flood would reach an elevation of about
859.1 feet, National Geodetic Vertical Datum of 1929 (NGVD), at the site. Although the site shows to
be in the Special Flood Hazard Area, if the natural ground elevation is above the 1 OO-year frequency
flood elevation, a Letter of Map Amendment (LOMA) may be obtained from FEMA which allows lenders
to waive insurance requirements on buildings that were incorrectly included in the flood hazard areas.
Enclosed is a copy of the LOMA application package which should be completed and forwarded to
FEMA along with a copy of this letter and the required technical information if you feel the parcel
qualifies.
You should note that provisions of the National Flood Insurance Program (NFIP) require the purchase
of flood insurance as a condition of a mortgage secured by real property, and loans for new construction
and/or substantial improvements in identified flood hazard areas. These areas are identified as "Zone
A" on the City of Carmel Flood Insurance Rate Map (FIRM) published by the Federal Emergency
Management Agency (FEMA). The above site is covered on panel number 180081 0007 C. Marked
in blue on the enclosed copy of this map is the location of the parcel in question, and it appears to be
completely inside the designated "Zone A". Under the Flood Disaster Protection Act of 1973, flood
insurance is required by law for buildings located inside the Special Flood Hazard Area (Zone A). As
provided for under the guidelines of the National Flood Insurance Program, the final decision regarding
flood insurance is left up to the local lending institution.
We recommend that any building which you propose for this site be provided with a lowest floor set at
least 2 feet above the 1 OO-year frequency flood elevation. If a basement is included, the basement floor
should be considered to be the lowest floor. Depending on the type of building and the lowest floor
elevation, including basements, flood insurance premiums can be substantial under the regular phase'
of the National Flood Insurance Program. The owner should discuss this matter with an insurance
agent before starting any plans for construction.
In addition, the f100dway of Williams Creek passes through a portion of the tract. For your
information, we have delineated the floodway (in yellow) on the enclosed copy of the Hamilton
County Preliminary Flood Insurance Rate Map. IC 14-28-1 prohibits constructing abodes or

residences in or on a floodway and requires the prior approval of the Department of Natural Resources
for any other type of construction, excavation, or filling in or on a floodway. To be approvable a project
should be designed so that it will not restrict the floodway, be unsafe to life and property, nor adyersely
affect the fish, wildlife, or botanical resources. Detailed plans should be submitted for formal approval
by the Department of Natural Resources under IC 14-28-1. A permit application and instructions are
enclosed for your convenience.
The dark shaded portion of the tract outside of the floodway and below the 1 DO-year frequency flood
elevation is called the floodway fringe area. While these portions of the tract would be subject to
flooding, they are not required for the conveyance of flood waters during the 1 DO-year event; therefore,
approval by the Department of Natural Resources under IC 14-28-1 for portions of the project in this
fringe area is not required unless a dam is to be constructed.
Please note that you may also have to obtain a permit from the Corps of Engineers under Section 404
of the Clean Water Act or Section 10 of the Rivers and Harbors Act. Information relative to the Corps'
of Engineers permits may be obtained from:
