HomeMy WebLinkAboutPacket for HO 06-24-24Carmel Board of Zoning Appeals Hearing Officer Coleman Residence 12737 Parsons Gate Carmel, IN 46032 Docket No. PZ-2024-00093 V Petitioner: Philip Ennis, PJE Lawn Care & Landscaping We are seeking a Development Standards Variance approval to Encroach 6.6-ft into the minimum 10-ft setback from the side lot line in order to build an outdoor entertaining space to include a swimming pool and retaining wall in the VOWC PUD Section 6.1 and UDO Section 5.02.C(7). The Coleman family currently has a pool; however, the original installation company did not complete the pool to their satisfaction. They have had numerous issues with the current layout of their outdoor space as well as the pool being incredibly slippery, leading to safety concerns for their small children. PJE Lawn Care & Landscaping began working with the Coleman family in 2022. After much consideration, they determined that the best course of action would be to completely remove their current pool and reconfigure their outdoor space. The new outdoor space will allow a more usable lawn space for their children, an elevated entertaining space for their family, friends and neighbors, and a brand-new pool. The pool’s location was selected to give them a larger, usable lawn space, as their lot is not very large, and the current configuration of the space does not work. The reconfigured outdoor space will improve the property value for their home and their neighbors without hindering anyone else’s space. The Architectural Review Board for the Villages of West Clay have approved all portions of the project. We thank you for your consideration. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The home that is currently owned by the Coleman Family, will be improved upon with the implementation of the proposed outdoor entertaining space. The swimming pool and patio retaining wall will be confined to the owners’ backyard and is not anticipated to pose a health or safety concern. The surrounding properties will only be positively affected by the proposed development, as it will enable the Coleman Family to continue fostering neighbor relationships in their community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The proposed variance will allow the construction of an improved outdoor space that fits well within the surrounding properties, with an in-ground swimming pool and patio retaining wall in the rear yard, thereby enhancing the property value as well as the value of adjacent properties. The proposed outdoor living space was designed and will be built by P.J.E. Lawn Care & Landscaping, a company that has improved the outdoor spaces of numerous homes in the Central Indiana area, specifically in City of Carmel. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: Strict application of the minimum 10-ft side setback limits the homeowners on how they can use their property as their lot is not very large, and their growing family needs as much useable space as possible. Strict application would only serve to thwart an otherwise allowable use and enjoyment of the property and any further development of the property. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. ___________________________ is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
