Re: Lucas Private Baseball Field, Special Use (PZ-2024-00082 SU)
Dear Hearing Examiner:
Lucas Family Living Trust is seeking a special use to be granted to install a
private baseball field on an existing open field at the Lucas Estate. The ballfield will
be used for members of the Lucas Family to practice and play baseball. Occasionally,
family members’ baseball teams will use the field for practices, but field will not be
used for games or tournaments.
The Lucas Family has taken great care to make sure their neighbors are not
disturbed. The infield will be substantially set back from neighbors and the street, so
it will create minimal disturbance to the neighbors. A line of trees will be planted to
further screen the field. There will be no lighting, scoreboard or sound system, further
preventing disturbance to the neighbors.
The Lucas Family anticipates that there will be approximately 20 players at
any practice or scrimmage, with perhaps ten additional parents and coaches present.
It is anticipated that the field will be used for practices and scrimmages from
approximately 5:00 pm until dusk weeknights and also intermittently on weekends.
The baseball field will also be attractive and not affect the neighbors’
aesthetics. The baseball field will feature a netted backstop with black poles. It will
feature roofed dugouts. The outfield will be natural grass and the infield will be
permeable artificial turf.
Ample parking and comfort facilities will be available for those using the fields.
It’s not anticipated that the field will be used at the same time as other events at the
Lucas Estate, so it’s not anticipated that there will be any material increase in traffic
and there is more than enough parking currently.
The field is simply intended for private recreation, no different that the nearby
tennis court, basketball courts, and other sports fields. It’s just a quiet place to play
the game.

Description of Request
Petitioner requests approval to install a private recreational facility, namely, a baseball field with
an artificial, but permeable, surface for the infield, netted backstop and dugouts for the private
use of the Petitioner and Petitioner’s family and guests, and, in any event, without any monetary
remuneration.
Statement of Support
The proposed baseball field is intended for the members of the Lucas family to play baseball.
From time-to-time, the Lucas family may allow those family members’ baseball teams to have
practices at the field. The baseball field is intended to be a place where family members can
informally gather to play a game they love. The field will be substantially setback and screened
from neighbors and the road. Additionally, the baseball field will not feature lights or a public
address or similar loudspeaker system.

FINDINGS OF FACT - SPECIAL USE
CARMEL BOARD OF ZONING APPEALS

Petitioner: Lucas Living Trust
1.The premises in question is particularly physically suitable for the proposed Special Use because:
The premises already features a large open field allowing the baseball field to be a healthy distance from the
neighbors. Additionally, planned and existing landscaping will substantially screen the premises from the neighbors.
Currently, the premises has substantial parking, restrooms, and other convenience facilities that can be used.
Finally, the baseball field is consistent with the character of the area, as many of the homes are on large lots and have
private recreation facilities, such as tennis courts and baseball fields.
2.The Special Use will not injuriously or adversely affect economic factors, such as cost/benefit to the community
and its anticipated effect on surrounding property values because:
The baseball field will be setback by at least 100 feet from adjacent properties and will not intensify use of the
premises. Additionally, the baseball field will be used by small groups of people and will require very little in
the way of community services. Additionally, neighborhood values are not expected to decline as many
neighbors have private recreation facilities such as baseball fields and tennis courts, making this use
consistent with the community.
3.The Special Use will be consistent with social/neighborhood factors, such as compatibility with existing uses
and those permitted under current zoning in the vicinity of the premises under consideration and how the
proposed Special Use will affect neighborhood integrity because:
The baseball field is consistent and compatible with neighboring properties in that several neighbors have large
private recreation facilities such as baseball fields, tennis courts, and similar private facilities. Additionally, the
baseball field will be set back at least 100 feet from neighboring properties and will be screened with attractive
landscaping to cut down on any noise. Additionally, the baseball field will be in an open field in a large estate
that has dedicated access from Ditch Road, which is separate from neighbors, limiting any neighbor’s
interaction with guests using the baseball field.
4.The Special Use will not injuriously or adversely affect the adequacy and availability of water, sewage and storm
drainage facilities and police and fire protection because:
The baseball field is mainly grassy area so the existing storm drainage will be minimally impacted. For those
areas that have a storm water impact, Petitioner has engaged a civil engineering firm to ensure an appropriate
storm water design. Additionally, no new water or sewage facilities will be added, and the existing facilities
will be used at off-peak hours, further preventing strain on existing systems. Additionally, any groups using
water and sewage facilities will be limited in nature. The site will not be using irrigation.
5.The Special Use will not adversely affect vehicular and pedestrian traffic in and around the premises upon
which the Special Use is proposed because:
The baseball field will be situated far off Ditch Road and there is ample parking, which will prevent vehicles
from stacking into Ditch Road. Also, the baseball field will be used by a limited number of non-family
member guests for short periods of time. The free flow of pedestrian and vehicular traffic off Ditch Road will
remain unaffected.

DECISION
Yes No: The Board has reviewed the requirements of Article 9 of the Unified Development Ordinance as they
relate to this Special Use, and does not find that those criteria prevent the granting of the Special Use.
It is therefore the decision of the Carmel Board of Zoning Appeals that Special Use Docket No.
is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and
made a part hereof.

SECTION 2 MATERIAL HANDLING AND
SPILL PREVENTION PLAN
IN ORDER TO MINIMIZE THE RELEASE OF POTENTIAL POLLUTANTS DURING
CONSTRUCTION THE CONTRACTORS SHALL IMPLEMENT THIS MATERIAL
HANDLING AND SPILL PREVENTION PLAN. THE CONTRACTOR SHALL REVIEW
THIS PLAN WITH ALL SUBCONTRACTORS AND REQUIRE THAT THEY IMPLEMENT
THE PLAN AS WELL.
1. CONSTRUCTION EQUIPMENT
A. FUELING, LUBRICATION AND FLUIDS: ALL OPERATIONS INVOLVING THE
ADDITION OF FLUIDS TO EQUIPMENT SHOULD BE DONE IN ONE LOCATION, AS
DESIGNATED BY THE CONSTRUCTION MANAGER, SO THAT SPILLS ARE LIMITED
TO ONE LOCATION ON THE SITE, WHICH WILL FACILITATE THE CLEANUP OF
SPILLS. IF AN ONSITE-FUELING TANK IS PLANNED TO BE ON SITE, IT SHALL BE
DOUBLE WALLED AND STORED IN THIS DESIGNED AREA. THIS LOCATION IS AN
AREA THAT WILL NOT ALLOW SPILLED FLUIDS TO MIGRATE INTO SUBSURFACE
SOILS. IN THE EVENT OF A SPILL, THE FLUID SHALL IMMEDIATELY BE CLEANED
UP BY REMOVING THE CONTAMINATED SOIL OR STONE, WHICH SHALL BE
DISPOSED OF IN AN ACCEPTABLE MANNER. SPILLS ON HARD SURFACES SHALL
BE SOAKED UP BY AN ACCEPTABLE MATERIAL SUCH AS OIL DRY AND THE
ABSORBENT MATERIAL DISPOSED OF IN A PROPER MANNER. THE SPILL SHALL
ALSO BE REPORTED IMMEDIATELY TO THE CONSTRUCTION MANAGER'S
SUPERINTENDENT.
B. EQUIPMENT REPAIR, ESPECIALLY WHEN FLUIDS MUST BE REMOVED FROM
THE EQUIPMENT OR THE POSSIBILITY OF FLUID SPILLS IS HIGH, SHOULD
ALWAYS BE DONE OFFSITE AT A FACILITY THAT IS MORE SUITABLE THAN A
CONSTRUCTION SITE TO HANDLE SPILLS. WHEN EQUIPMENT MUST BE
REPAIRED ONSITE IT SHOULD BE MOVED TO THE MAINTENANCE AND FUELING
AREA IF POSSIBLE. OTHERWISE, SUITABLE ON SITE CONTAINERS SHOULD BE
PLACED UNDER THE EQUIPMENT DURING REPAIR TO CATCH ANY SPILLED
FLUIDS AND THESE FLUIDS SHOULD BE DISPOSED OF IN A PROPER MANNER.
C. ALL REUSABLE FLUID CONTAINERS, SUCH AS GASOLINE CANS, SHALL BE
INSPECTED FOR LEAKS EACH TIME THEY ARE USED. IF LEAKS ARE FOUND, THE
FLUID SHALL BE REMOVED FROM THE CONTAINER IN A PROPER MANNER AND
THE CONTAINER DISPOSED OF IN AN ACCEPTABLE MANNER. EMPTY
DISPOSABLE CONTAINER, SUCH AS GREASE TUBES AND LUBRICATING OIL AND
BRAKE FLUID CONTAINERS, AND THEIR PACKAGING, SHALL BE DISPOSED OF IN
A PROPER MANNER AND SHALL NOT BE LEFT ON THE GROUND OR IN THE OPEN
ON THE CONSTRUCTION SITE.
2. CONSTRUCTION MATERIALS AND THEIR PACKAGING
A. EROSION CONTROL MEASURE SHOWN ON THE SUBJECT PROJECT SHALL
BE IMPLEMENTED PRIOR TO AND DURING CONSTRUCTION IN THE PROPER
SEQUENCING TO MINIMIZE SOIL EROSION. EROSION CONTROLS SHALL BE
INSPECTED AND MAINTAINED AS DESCRIBED ELSEWHERE ON THE PLANS.
EXCESSIVE DUSTING OF SOIL ON THE SITE SHALL BE MINIMIZED BY REDUCING
CONSTRUCTION TRAFFIC ACROSS BARE SOIL DURING DRY AND/OR WINDY
WEATHER, AND BY APPLYING WATER OR OTHER ACCEPTABLE DUST CONTROL
MEASURES TO THE SOIL. UPON COMPLETION OF CONSTRUCTION AND
SUITABLE ESTABLISHMENT OF PERMANENT VEGETATION, TEMPORARY
EROSION CONTROL MEASURES SUCH AS SILT FENCE, CHECK DAMS AND INLET
PROTECTION DEVICES SHALL BE REMOVED IN A MANNER TO MINIMIZE
ADDITIONAL LAND DISTURBANCE. ANY AREAS DISTURBED BY THESE
OPERATIONS SHALL BE PROPERLY REVEGATATED.
B. LARGE WASTE MATERIALS CREATED BY CUTTING, SAWING, DRILLING, OR
OTHER OPERATIONS SHALL BE PROPERLY DISPOSED OF IN SUITABLE WASTE
CONTAINERS. THE SITE SHALL BE CHECKED AT THE END OF THE DAY, AS A
MINIMUM, AND ALL WASTE MATERIALS, INCLUDING THOSE BLOWN ACROSS OR
OFF THE SITE BY WIND SHALL BE PICKED UP AND DISPOSED OF IN SUITABLE
CONTAINERS. WHERE POSSIBLE, OPERATIONS SUCH AS SAWING THAT CREATE
SMALL PARTICLES SHOULD BE PERFORMED IN ONE SPOT IN AN AREA
PROTECTED FROM WIND, AND WASTE PARTICLES COLLECTED AND DISPOSED
OF FREQUENTLY TO MINIMIZE WIND DISPERSAL. PACKAGING USED TO
TRANSPORT MATERIALS TO THE SITE FOR CONSTRUCTION OF THE FACILITY
SHALL BE DISPOSED OF PROPERLY, WHETHER THE MATERIAL IS TAKEN OUT OF
ITS PACKAGE AND INCORPORATED INTO THE PROJECT IMMEDIATELY OR
STORED ONSITE FOR FUTURE USE. PACKAGED MATERIALS STORED ONSITE
SHALL BE INSPECTED REGULARLY AND ANY LOOSE PACKAGING SHALL BE
REPAIRED OR DISPOSED OF PROPERLY.
C. ALL DEWATERING OF ACTIVITIES SHALL BE DONE IN ACCORDANCE TO
GOOD EROSION CONTROL PRACTICES. THESE PRACTICES SHOULD INCLUDE
THE USE OF DIRT BAGS SUCH AS SILT FENCE INLET PROTECTION. THE USE OF
THESE TYPES OF DEWATERING DEVICES WILL REMOVE LARGE QUANTITIES OF
SILT, SEDIMENT, AND DIRT AND PREVENT THESE MATERIALS TO ENTER THE
STORM SEWER SYSTEM.
D. IF THE USE OF LIME IS USED TO STABILIZE THE SOIL OF THE SITE THEN ALL
CONSTRUCTION EQUIPMENT USED SHALL BE CLEANED OF ALL EXCESS
MATERIAL WITH WATER IN THE MAINTENANCE AND REFUELING AREA AS
SHOWN WITHIN THESE PLANS.
E. NUTRIENTS AND FERTILIZERS SHALL ONLY BE USED TO ESTABLISH RAPID
VEGETATION. WHEN THESE PRODUCTS ARE UTILIZED, THE USER SHOULD PAY
STRICT ATTENTION TO THE PRODUCTS RECOMMENDED USAGE.
3. CONCRETE WASTE WATER
A. ALL CONCRETE WASTEWATER SHALL BE DISPOSED OF IN THE DESIGNED
AREA AS DIRECTED BY THE CONSTRUCTION MANAGER. THIS AREA IS TO BE A
3' DEEP, 10' SQUARE PIT AS DETAILED ON THE EROSION CONTROL PLAN. THIS
AREA SHALL BE INSPECTED ON A DAILY BASIS AT A MINIMUM. WHEN THIS AREA
BECOMES FULL, THE POLLUTANTS SHALL BE EXCAVATED, PLACED IN AN
ACCEPTABLE CONTAINER AND DISPOSED OF IN PROPER MANNER, BY THE
EXCAVATION CONTRACTOR.
4. PAINT PRODUCTS
A. ALL EXCESS PAINT AND THEIR RELATED PRODUCTS SHALL BE DISPOSED
OF IN THE MANNER AT WHICH THE MANUFACTURER SUGGESTS. UNDER NO
CIRCUMSTANCES WILL PAINT OR THEIR RELATED PRODUCTS BE CLEANED OR
DISPOSED OF IN SOIL, SANITARY SEWERS, STORM SEWERS OR DETENTION
BASINS. ANY VIOLATION OF THIS SHALL BE REPORTED TO THE JOB
SUPERINTENDENT.
IN THE EVENT OF ACCIDENTALLY CONTAMINATION ALL EFFORTS SHOULD BE
MADE TO REMOVE CONTAMINANTS IN AN APPROPRIATE MANNER. THE CARMEL
FIRE DEPARTMENT SHOULD BE CONTACTED IMMEDIATELY TO DETERMINE IF
FURTHER MEASURES ARE NEEDED.
