CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, JUNE 24, 2024
(V) Singh Minor Subdivision Variance.
The applicant seeks the following development standards variance approval:
8. Docket No. PZ-2024-00087 V UDO Section 1.07 - Transportation Plan Compliance; Reduced ROW
dedication requested. The site is located at 4281 W. 106th St. It is zoned S1/Residence. Filed by Pat
Rooney, attorney on behalf of Gurpreet Singh, Lakhwant Singh, Rupinder Multani, & Kamaljit Kaur,
owners.
General Info:
• The Petitioner seeks approval to plat two residential lots on 14 acres.
• The site will become Singh Subdivision plat. Planning Staff is administratively reviewing the administrative
subdivision petition/application.
• Surrounding this site are single family residential homes to the south and east, open space common area to
the north, and commercial office buildings to the west.
• A BZA variance is requested from the Transportation Plan Compliance requirement in the Unified
Development Ordinance (UDO), for reduced standards.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Transportation Plan Compliance -
• Per UDO Section 1.07, Transportation Plan Compliance is required, and that includes dedication of street
right of way to the City, as well as construction of a 10-ft wide multiuse path along the street frontage (or
payment into the Thoroughfare Fund for what it would cost to construct).
• The Petitioner requests BZA variance approval for a reduced amount of street right of way dedication and
path to be required.
• A 139-ft wide legal drain easement and a 218-ft wide gas pipeline easement cross the site at 106th Street.
• Petitioner will install a multiuse path along 106th Street simultaneously with the construction of the two
homes (except for those two areas where there is a conflict with the pipes/easements).
Remaining Review Comments:
• All planning/zoning review comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request. The Petitioner will dedicate most of the street ROW (right
of way) along 106th Street, except for where the street ROW will go over the easements. In those areas they
will be placing a public access easement over the land and committing to dedicate the ROW in the future
if/when the city needs it.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
