The applicant seeks the following development standards variance approval for a patio retaining wall: 10. Docket No. PZ-2024-00093 V VOWC PUD Section 6.1 & UDO Section 5.02.C(7) Minimum 10-ft setback from the side lot line required; 3.6-ft requested. The site is located at 12737 Parsons Gate. (Village of WestClay Subdivision, Section VO2-B, Lot 303). It is zoned Village of WestClay PUD/Planned Unit Development (Ordinance Z-465-04 as amended). General Info: • The Petitioner seeks approval for installation of a swimming pool and outdoor entertaining space, which also includes a retaining wall. • Also, a 10-ft wide easement runs along the rear/east side of the lot. • Related pending building permit is B-2024-00382. • The site is located in Village of WestClay subdivision, and HOA (Homeowner’s Association) approval has been granted. • An email of support has also been received from the adjacent neighbor to the north. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Pool/Accessory Structure Setback - • The UDO requires a 10-ft minimum setback for a swimming pool, its decking, and equipment. And, the Petitioner requests a 3.6 foot side yard setback. This is a variance of 6.4 feet, or a 64% change. • The pool area will be heavily landscaped around the perimeter. Remaining Review Comments: • Please also seek approvals from the Carmel Engineering Dept. and the Hamilton County Surveyor's Office for encroachment of material in the 10-ft wide DU&SE (drainage utility and sewer easement) that runs along the east/rear of the lot. (The Petitioner can contact Jarrod Huff at jhuff@carmel.in.gov and Sam Clark at samuel.clark@hamiltoncounty.in.gov to get that conversation started, if not yet done.) Final Comments: • The Planning Dept. supports the variance request, with the condition of easement encroachment approvals from the Carmel Engineering Dept. and the Hamilton County Surveyor's Office. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, with the condition of approvals from the Carmel Engineering Dept. and the Hamilton County Surveyor's Office for encroachment of material within the 10-ft wide DU&SE (drainage utility and sewer easement), and with adoption of the Findings of Fact submitted by the Petitioner.
