WH El~ 2.11.5, the Carmel Town Plan Commiss ion has prepared a ThoroL1ghfare PIRn
for '-:he Town of Carmel, Indiana, aiJ.d the Ju.risdictional Area, including &n Oi'dinance
for its enforcerrH~nt; has held a public hearing on the plan and Ordinance; haG by l'C-
G,)lutlOn adopted the Thorollghfar~ Plan and recommended thereon to the Tovm Board
of Trl1stees that said Ordinance be passed; all in accordance with Chapter 174, Acts
of General Assembly of Indiana for 1947, and all acts amendatory and sL1pple,ncntal
thereto: NOW THERSFORE:
:aE IT ORDAINED by the Town Board of Trllstees of the Town of Carmel, Indiana:

This Ordinance shall be known and may be cited as the "Thoroughfare Plan of Carmel,
Indiana - 1959".

Section 5. POLICIES AND DIRECTIVES.

right-of-way width shall conform to the policies and specified dcsign;:;.tions
and indications in the Thoroughfare Plan, provided that where a 5tre-ct

reqLlired to plat only one-half of the right-of-way width desig..,.t,-,ci fo~

S"ctiO!1 6. CONTL'\lUING AUTHORITY OF TOWN PLAN COMMISSION.
Subse'iuent to the adoption of the Thoroughfare Plan and the passage of this
Ordinance, the Town Plan Commission may:
a. Determine lines for new, extended, widened or narrowed thoroughfa""cs
in any portion of the Town of Carmel and the Jurisdictional Area.
b. Certify to the Town Board of Trustees the amended or additional plan
under the same procedures as established for the certification and
approval of the Thoroughfare Plan.
S"ction 7. AMENDMENTS.
in addition to the provisions of Section 6 herein, amendments may be initiated as
follows:
a. The Town Board of Trustees of Carr.'1el, Indiana, may direct the Carmel
Town Plan Commission to prepare an amendment, as desired, and Sl1.bn1it
it to public hearing within sixty (60) days after formal written r"'-ILlest by
the Town Board of Trustees.
b. The owners of fifty percentum (50"1ol or more of the area of property
abuttinG' upon a street may also petition the Town Plan Commission re-
qLlesting an amendment to the Thoroughfare Plan.
Sc..>:1i&u. AVAILABILITY FOR PUBLIC INSPECTION.
Two copies of the Thoroughfare Plan and Ordinance anel two copies of the typical
thoroughfare cross-sections shall be kept on file in the office of the Clerk-Treasurer
of the Town of Carmel, and shall be SLlbject to pLlblic examination dLlring the re::;Lll,~r
office hOLlrs of the Clerk-Treasurer.
~wion 9. VALIDITY.
Ii any title, section, claLlse, provision or portion of this Ordinf~nce shall be h"ld to
be invalid or unconstitutional by any COLlrt of competent jLlrisdictioll, sLlch decision
shall not affect any other title, section, clause,provision or portion of this Ordi.n&nc(~.
