This item was uploaded July 11 in Public Notice Documents folder. Why can’t the gazebo be placed along the south side of the pool? The area south of the pool is an area of the yard that we actually use to play games and sports. There are mature trees as well that are actually on small elevation that is in-line with the main level of our home and deck. It would require significant engineering and removal of a large amount of trees and dirt in order for it to be placed there. Placing the gazebo in that area would also look weird as it would be in the middle of our backyard. By placing it on the north side, it goes into a space that we were never able to utilize because of the overgrown pine trees. We are unable to use the east side of the pool because of the easement. Will the gazebo and concrete pad be located at least 3- ft away from the 30-ft wide easement that runs along your back yard? We are planning to install some custom shutters that will run on the northern wall of the gazebo that will provide additional privacy in the area that the pine trees used to be. Please continue to work with Matt Shively of the Carmel Building & Safety Department on necessary residential building permit(s) for an accessory structure. A gazebo is not considered a temporary structure. We would classify this a permanent structure since it would be installed permanently on a concrete pad. From the site plan you provided in your email, it looks like this Gazebo will be at least 10-ft from the façade of your home, thus the concrete pad and gazebo would need to be 5-ft off the side yard property line. Also, the concrete pad and gazebo needs to be 33-ft from the rear property line, since a 30-ft Drainage & Utility Easement exists. If you cannot amend your plans to be out of the setbacks, then you would need to apply for a Development Standards Variance from UDO Section 5.02.B.1.b. Please refer back to my email I sent to you on June 3, 2024 that contains links to the application portal and instructions in how to file for a variance. I will forward this email to you. Here is the site map for the gazebo. If you could let us know which variance we need that would be great. As the map shows, the concrete ends with 15ft to the property line. My understanding is it would be 5 feet based on where we want to put it. With no variance, the gazebo would be sitting in the pool. I have also included a picture of the structure. It is my understanding that this type of structure is considered temporary rather than permanent. Is that correct? Since it is a temporary structure, do I still need to apply for the accessory structure permit and variance? I was looking at all the paperwork and it seems like a lot for a temporary structure. I told by Mike or Matt (I can't remember his name) to contact you in regards to the steps that need to be taken to get a variance for a gazebo that we would like to install in our backyard. He was able to look at our lot and said that there is a 5 feet variance. The structure we are planning to use is 16 ft x 18 ft. He said I would also need to obtain a permit for an accessory structure. I have already started to work on completing that. If you could please let me know what the process and paperwork is that needs to be completed, I would appreciate it.
