My name is Todd Weber,and I have been growing and selling produce for the past 25
years,with 12 of those years right here in Carmel.In previous years,we have set up
our produce stand in the Vine &Table parking lot.Over time,we have built a strong
clientele and garnered tremendous support from the residents of Carmel.
What began as a small produce stand that my daughter used to raise money for college
has now blossomed into a full family operation.It is my hope that my daughter’s children
will one day take over the business and continue our legacy.
Unfortunately,the Vine &Table location is no longer available to us,as the building is
under new ownership and we were unable to reach an agreement with the new
owners.However,we remain committed to serving the Carmel community and have
found a new location that we believe will be excellent for both our business and the
community.
Our family is dedicated to being a good neighbor and operating a business that will hire
local employees and help support local residents.

The Food stand will only be selling uncooked and uncut fresh fruits and vegetables.The stand is located in a

2.The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse
manner because:
The produce stand will not compete with any other business in the immediate area.The Kirby II Park retail center

will not be affected because the produce building and table with umbrella will only take up 3 parking spaces.

If anything the use will compliment other uses in the retail space.

3.The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the
property because:
The produce stand was designed to be a semi-permanent structure and not designed to be transported daily.

This allows the building to look professional and more appealing to the city and surrounding neighbors.

A skid steer is needed to put the building on and off the trailer for transportation,This would add 3+hours to our work
day.

IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
___________________________is granted,subject to any conditions stated in the minutes of this Board,which are incorporated
herein by reference and made a part hereof.

Statement of
Variance Request
UDO Section 5.66.D states that Food Stands are required to be removed from the premises when
not in operation.I respectfully request to be able to leave our produce stand on-site overnight
between July 1st through October 31st,in perpetuity.
Statement of
Support
Allowing my business to leave the produce stand building overnight will eliminate the need to spend
over 3 hours each day on transporting,setting up and tearing down.The building was constructed as a
semi-temporary structure,requiring a skid steer for loading and unloading from the trailer,and was
designed to be moved only a few times a year.
Currently the UDO specifies in Section 5.66.D that all Food Stands will need to be removed from the
premises when not in operation.This will impose a significant burden on both myself and my employees.
