We have thoroughly enjoyed using it as a family and sharing with friends. We have decided to pursue installing a gazebo next to the pool as a way to continue to enjoy being outdoors with family and friends. However, with all the current easements and landscaping, the only area that makes reasonable sense for placement is the area adjacent to the neighbors to the north. Thank you for your consideration, Larry and Rosanne Stover Larry and Rosanne Stover 13991 Brookstone Drive Carmel, IN 46032 Statement of Request and Support Variance Hearing Officer, We are requesting a variance to allow an accessory structure/gazebo that is greater than 10 feet from our residence to be allowed to be within 3 feet of the property line instead of the usual 5 feet. We are requesting the variance as the far 30 feet of our backyard is in an easement thereby limiting the usable space that we can place structures. In addition, by moving the gazebo closer to the property line, it increases the walkway in front of the gazebo, and individuals will not have to walk on the less study top of the pool cover housing. Also, the neighbor’s fence appears be slightly on our property. If we place the gazebo 3 feet from the fence it will be near 5 feet from the property line. DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS (Petitioner to fill out 1-3 + first two blanks) Docket No.: Petitioner: _Larry and Rosanne Stover_ 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The requested variance is only a change of a few feet from the mandatory distance. The accessory structure/gazebo would be 3 feet from the property line instead of the required 5 feet. This will likely not be appreciated visually and should cause no undue hardship. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The gazebo will only be moved an additional 2 feet to the nofth toward the property line. This change would likely not be noticeable to most individuals. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: Ihe accessory structure/gazebo will be in close proximity to the pool cover housing. lndividuals will be required to walk on the top of the pool cover housing which is /ess stable and may result in an accident. DECISION lT lS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
