Sailer development standards variance petition
10820 Spring Mill Road
Philip and Amy Sailer reside at 10820 Spring Mill Road. They would like to construct a
guest house on the 9.32 acres and are seeking two development standards variances.
The first variance (PZ-2024-00105) is to increase the height of a guest house from 18 feet
to 20 feet. Extra effort has been made in the design of the guest house to make it complementary
and visually compatible with the French architecture of the main living quarters. Holding the
height to 18 feet would result in a lower roof pitch and would compromise this effort.
The second variance (PZ-2024-00106) is to permit the guest house to be constructed in
front of the principal building. The main residence is set back over 750 feet from Spring Mill
Road. Behind the house, the topography drops off significantly towards Williams Creek and the
Nature Conservancy that abuts the property to the west. The lot is also heavily wooded, such that
the proposed structure would not be visible from Spring Mill Road.
We believe the proposed guest house will be an asset to this property and to the general
area. We respectfully seek approval of the variance petition.

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
CARMEL ADVISORY BOARD OF ZONING APPEALS

Petitioner: Lloyd R. Burch
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
the proposed quest house will meet or exceed the standards set forth in the One &Two Family Dwelllinp
Code.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
value of the property and surrounding area will benefit as the use of the property is not changing and the
proposed quest house has been designed to complement the French architecture of the existinq
residence.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties
in the use of the property because:
extra effort has been made for the architecture of the quest house to complement the existing residence.
Strict application of the heigh standards will lead to a compromise in
appearance.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this Board,
which are incorporated herein by reference and made a part hereof.

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
CARMEL ADVISORY BOARD OF ZONING APPEALS

Petitioner: Lloyd R. Burch
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
the property topography falls off sharply to the west towards Williams Creek. Granting of the variance will
allow for safer access.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
the existing house is set back 754 feet from Spring Mill Road. The lot is heavily wooded and structures
will not be visible from the road.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties
in the use of the property because:
the practical difficulties this site presents is that the building envelope is very limited given the unusually
long setback of the residence. Strict application of the setback standard will result in an impractical siting of the
quest house.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this Board,
which are incorporated herein by reference and made a part hereof.
