Packet, Supplemental for BZA 07-22-24
July 12, 2024 Dear Board of Zoning Appeals members, Good afternoon. In response to a few questions from our neighbors, we will host a discussion at 4423 E 116th Street on July 18 at 6:30 pm. We’ll talk about the home remodel, how we provide care for our residents with Alzheimer’s and other dementias, how our care model relates to the remodel, and property values in Carmel for neighbors living next to similar homes like ours. The letter I sent to our neighbors is included in this update. We will also hand out an information packet, which is likewise included here. The handout will include detailed renderings of the remodeled home and landscaping, activity plans used in other Legato Living homes, and an appraisal study we commissioned regarding Carmel neighbors living next to similar boutique memory care homes. Regarding the property values, the data show that similar boutique memory care homes in Carmel do not negatively affect neighboring property values. I look forward to our meeting on July 22. Read the following and pause for a response. Then follow up with a brief discussion about each song. Some songs have two lyrics to finish. 1. “When I was just a little girl, I asked my mother, what will I be ___________?” (be) “Que Sera, Sera (Whatever Will Be, Will Be)” sung by Doris Day was featured in the 1956 film The Man Who Knew Too Much. With its empowering message, “Que Sera, Sera” has inspired generations to embrace life’s adventures with courage and grace. 2. “Love me tender, love me sweet, never let me ___________.” (go) Do you know the next line? “You have made my life complete, and I love you ___________.” (so) “Love Me Tender” by Elvis Presley is a ballad that was initially written for the 1956 film of the same name. The melody of the song was adapted from the 1861 Civil War ballad “Aura Lee,” while the lyrics were written by Ken Darby and Presley himself. 3. “I can make you mine, taste your lips of wine, anytime, night or day, only trouble is, gee whiz, I’m dreamin’ my life ___________.” (away) “All I Have to Do Is Dream” by the Everly Brothers is another dreamy ballad. Released in 1958, the song was penned by the renowned songwriter Boudleaux Bryant. The song’s harmonious blend of tender lyrics and the Everly Brothers’ signature vocal harmonies propelled it to the top of the charts. 4. “All the leaves are brown and the sky is gray, I’ve been for a walk on a winter’s ___________.” (day) “California Dreamin’” by the Mamas & the Papas was released in 1965. This folk-rock classic captures the essence of longing for the warmth of California during a cold New York winter. The song’s harmonious blend of vocals and the iconic flute solo have made it an enduring symbol from the 1960s counterculture movement. 5. “I get no kick from champagne, mere alcohol doesn’t thrill me at all, so tell me why should it be true, that I get a kick out of ___________?” (you) Debuting in the 1934 musical Anything Goes, Cole Porter ’s classic “I Get a Kick Out of You” sets the stage for romance with its witty lyrics and captivating melody. The song has been covered by many artists, including Frank Sinatra and Ella Fitzgerald, and remains a beloved standard in the American songbook. ©ActivityConnection.com – Finish the Song Lyric – Page 2 of 5 6. “Earth angel, earth angel, will you be mine, my darling dear, love you all the ___________.” (time) “Earth Angel (Will You Be Mine)” by the Penguins is a soulful doo-wop staple from the 1950s. This proved that independent record labels, like Dootone Records, which represented the Penguins, could succeed. 7. “Ohhhh, my love, my darling, I’ve hungered for your ___________.” (touch) The 1955 song “Unchained Melody,” with music by Alex North and lyrics by Hy Zaret, was originally written as a theme for the prison film Unchained. However, one of the most popular versions of the song came out 30 years later when Nat King Cole recorded his rendition of the tune. Many others have also covered it over the past century, and both Bette Midler and Willie Nelson are on record saying it is their favorite song. 10. “When you kiss me, heaven sighs, and though I close my eyes, I see La Vie en ___________.” (rose) The lyrics for “La Vie en Rose” were written by Edith Piaf herself, while Louis Guglielmi (goo-lee-EL-mee) and Marguerite Monnot (mo-NO) wrote the music. The song made Piaf an international star, and the title translates to “life is pink.” It is a play on the phrase “rose-colored glasses,” which means to look at life with optimism. Ella Fitzgerald and Louis Armstrong also recorded a well-loved duet of the song. 11. “Well, since my baby left me, I found a new place to dwell, it’s down at the end of Lonely Street, at Heartbreak ___________.” (Hotel) “Heartbreak Hotel” was Elvis Presley’s first No. 1 hit and million-selling single. Here is another memorable line from the tune: “Could you coo? Could you care? For a cunning cottage we could ___________?” (share) 15. “Never know how much I love you, never know how much I care, when you put your arms around me, I get a fever that’s so hard to ___________.” (bear) Eddie Cooley and Otis Blackwell wrote the song “Fever” in 1955. Root of the Matter Out in the sticks If someone lives out in the sticks, it means they live out in the countryside or in the middle of nowhere. This phrase depends entirely on the word sticks, which is a euphemism for trees. Sometimes the phrase appears as out in the Styx. This references the River Styx of the underworld in Greek mythology. The River Styx was far beyond the normal borders of the living world, so to be out in the Styx meant you were far away indeed. Who Said So? Scientists have discovered that this little bone is making a comeback. The doctors analyzed 21,000 knees from the past century and found that in 1875 the fabella only existed in 17.9% of the population. Today, it is present in 39% of the population. Why the increase? Doctors think because we are better nourished, taller, and heavier, the body is responding by regrowing this little bone. Eye in the Sky It rains on the sun, but not with water. In the corona, or outer atmosphere, of the sun, rain falls in the form of one-million-degree plasma, or electrically charged gas. Great loops can be seen shooting from and returning to the sun’s surface. These are the loops of superheated plasma. As they reach their apex 30,000 miles from the sun’s surface, the plasma cools, condenses, and then, thanks to gravity, falls back to the sun as “coronal rain.” This new discovery explains why the sun’s corona is hotter than the surface. The “rain” cools the sun’s surface. Riddle Me This What needs an answer but doesn’t ask a question? MY NAME IS JENNA. I AM HERE TODAY BECAUSE I AM ACTUALLY A RESIDENT -- OR I AM A NEIGHBORING TO STORY COTTAGE ON CARY GROVE. I LITERALLY LIVE RIGHT NEXT DOOR TO THEM, I JUST WANTED TO GIVE MY INSIGHT IN REGARD TO WHAT IT IS LIKE TO BE A NEIGHBOR TO A FACILITY. GENUINELY, I LOVE LIVING NEXT DOOR TO THESE INDIVIDUALS AND TO THIS PROPERTY. IT BRINGS ME JOY TO KNOW THAT THE INDIVIDUALS THAT RESIDE AT THIS HOME ARE BEING VERY WELL TAKEN CARE OF, THAT THE PROPERTY VALUE, US A HEARD, MY PROPERTY VALUE HAS INCREASED JUST FROM RESIDING NEXT DOOR. WHEN I PURCHASED THE HOME, I WAS AWARE OF WHAT WAS GOING IN AND KNEW THAT IT WOULD NOT AFFECT MY PROPERTY VALUE, BUT GOING OFF OF WHAT I I WAS PURCHASING VERSUS WHAT THE LAND WAS PURCHASED FOR. WITH THAT, THE LANDSCAPING IS CONSTANTLY TAKEN CARE. PARKING IS NEVER AN ISSUE. THE OVERALL CONCERN OF MEDICAL VEHICLES BEING THERE ARE NOT AN ISSUE. YES, YOU MAY HAVE AN AMBULANCE THAT ARRIVES BUT IT IS NO DIFFERENT THAN IF I FALL OFF A LADDER AND CALL 911. INDIVIDUALS WHO ARE VISITING THEIR FAMILY MEMBERS THAT RESIDE IN THIS HOME RESPECT THE NEIGHBORHOOD AND CHERISH THE NEIGHBORHOOD AS MUCH AS THE INDIVIDUALS THAT RESIDE IN THE HOME AND AS MUCH AS I DO. I JUST WANTED TO PROVIDE THAT INSIGHT TONIGHT AND I'M HAPPY TO ANSWER ANY QUESTIONS YOU GUYS MAY HAVE OFFLINE BUT I JUST WANTED TO GIVE YOU THAT FEEDBACK TODAY. THANK YOU. The appraiser assumes that the title is good and marketable and, therefore, will not render any opinions about the title. The property is appraised on the basis of it being under responsible ownership. - The appraiser may have provided a sketch in the appraisal report to show approximate dimensions of the improvements, and any such sketch is included only to assist the reader of the report in visualizing the property and understanding the appraiser's determination of its size. Unless otherwise indicated, a Land Survey was not performed. - If so indicated, the appraiser has examined the available flood maps that are provided by the Federal Emergency Management Agency (or other data sources) and has noted in the appraisal report whether the subject site is located in an identified Special Flood Hazard Area. Because the appraiser is not a surveyor, he or she makes no guarantees, express or implied, regarding this determination. - The appraiser will not give testimony or appear in court because he or she made an appraisal of the property in question, unless specific arrangements to do so have been made beforehand. - If the cost approach is included in this appraisal, the appraiser has estimated the value of the land in the cost approach at its highest and best use, and the improvements at their contributory value. These separate valuations of the land and improvements must not be used in conjunction with any other appraisal and are invalid if they are so used. Unless otherwise specifically indicated, the cost approach value is not an insurance value, and should not be used as such. - The appraiser has noted in the appraisal report any adverse conditions (including, but not limited to, needed repairs, depreciation, the presence of hazardous wastes, toxic substances, etc.) observed during the inspection of the subject property, or that he or she became aware of during the normal research involved in performing the appraisal. Unless otherwise stated in the appraisal report, the appraiser has no knowledge of any hidden or unapparent conditions of the property, or adverse environmental conditions (including, but not limited to, the presence of hazardous wastes, toxic substances, etc.) that would make the property more or less valuable, and has assumed that there are no such conditions and makes no guarantees or warranties, express or implied, regarding the condition of the property. The appraiser will not be responsible for any such conditions that do exist or for any engineering or testing that might be required to discover whether such conditions exist. Because the appraiser is not an expert in the field of environmental hazards, the appraisal report must not be considered as an environmental assessment of the property. - The appraiser obtained the information, estimates, and opinions that were expressed in the appraisal report from sources that he or she considers to be reliable and believes them to be true and correct. The appraiser does not assume responsibility for the accuracy of such items that were furnished by other parties. - The appraiser will not disclose the contents of the appraisal report except as provided for in the Uniform Standards of Professional Appraisal Practice, and any applicable federal, state or local laws. - If this appraisal is indicated as subject to satisfactory completion, repairs, or alterations, the appraiser has based his or her appraisal report and valuation conclusion on the assumption that completion of the improvements will be performed in a workmanlike manner. - An appraiser's client is the party (or parties) who engage an appraiser in a specific assignment. Any other party acquiring this report from the client does not become a party to the appraiser-client relationship. Any persons receiving this appraisal report because of disclosure requirements applicable to the appraiser's client do not become intended users of this report unless specifically identified by the client at the time of the assignment. - The appraiser's written consent and approval must be obtained before this appraisal report can be conveyed by anyone to the public, through advertising, public relations, news, sales, or by means of any other media, or by its inclusion in a private or public database. - An appraisal of real property is not a 'home inspection' and should not be construed as such. As part of the valuation process, the appraiser performs a non-invasive visual inventory that is not intended to reveal defects or detrimental conditions that are not readily apparent. The presence of such conditions or defects could adversely affect the appraiser's opinion of value. Clients with concerns about such potential negative factors are encouraged to engage the appropriate type of expert to investigate. The Scope of Work is the type and extent of research and analyses performed in an appraisal assignment that is required to produce credible assignment results, given the nature of the appraisal problem, the specific requirements of the intended user(s) and the intended use of the appraisal report. Reliance upon this report, regardless of how acquired, by any party or for any use, other than those specified in this report by the Appraiser, is prohibited. The Opinion of Value that is the conclusion of this report is credible only within the context of the Scope of Work, Effective Date, the Date of Report, the Intended User(s), the Intended Use, the stated Assumptions and Limiting Conditions, any Hypothetical Conditions and/or Extraordinary Assumptions, and the Type of Value, as defined herein. The appraiser, appraisal firm, and related parties assume no obligation, liability, or accountability, and will not be responsible for any unauthorized use of this report or its conclusions. DEFINITION OF MARKET VALUE *: Market value means the most probable price which a property should bring in a competitive and open market under all conditions requisite to a fair sale, the buyer and seller each acting prudently and knowledgeably, and assuming the price is not affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing of title from seller to buyer under conditions whereby: 1. Buyer and seller are typically motivated; 2. Both parties are well informed or well advised and acting in what they consider their own best interests; 3. A reasonable time is allowed for exposure in the open market; 4. Payment is made in terms of cash in U.S. dollars or in terms of financial arrangements comparable thereto; and 5. The price represents the normal consideration for the property sold unaffected by special or creative financing or sales concessions granted by anyone associated with the sale. * This definition is from regulations published by federal regulatory agencies pursuant to Title XI of the Financial Institutions Reform, Recovery, and Enforcement Act (FIRREA) of 1989 between July 5, 1990, and August 24, 1990, by the Federal Reserve System (FRS), National Credit Union Administration (NCUA), Federal Deposit Insurance Corporation (FDIC), the Office of Thrift Supervision (OTS), and the Office of Comptroller of the Currency (OCC). This definition is also referenced in regulations jointly published by the OCC, OTS, FRS, and FDIC on June 7, 1994, and in the Interagency Appraisal and Evaluation Guidelines, dated October 27, 1994.I have not conducted any personal inspections for this assignment. Most of the studies report on the different types of community residences separately so that, for example, you’ll see the findings on sober living homes separately from those for group homes for people with developmental disabilities.
