DEPARTMENT REPORT

(V) Weber Farms Produce Stand Variance.
The applicant seeks the following development standards variance approval for a seasonal produce stand:
3. Docket No. PZ-2024-00096 V UDO Section 5.66.D. Food Stands required to be
removed from the premises when not in operation, request to leave on-site overnight for the
season. The site is located at 154 W. Carmel Dr. It’s zoned C1/City Center District. Filed by Todd
Weber of Weber Farms.
General Info:
• The Petitioner seeks approval for a farm produce food stand to be located at this site, and not be removed
every night when not in use during the season of July 1 to October 31.
• The prior location for this farm produce stand was at the former Vine & Table location, at 313 E. Carmel Dr.,
just down the street.
• Surrounding this site are industrial and commercial uses, as well as a regional stormwater detention pond.
• The related temporary use permit is B-2024-00753.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Food Stand on Site Overnight -
• The UDO lists the Food Stand Use-Specific Standards in Section 5.66.
• One of those standards is that Food Stands shall be removed from the premises when not in operation.
• The Petitioner seeks variance approval to allow the Food Stand to remain on the site, even overnight, for the
growing season of July 1 to October 31.
• Planning Staff is supportive of this variance request.
Remaining Review Comments:
• All planning/zoning review comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request, as the food stand will be removed after October 31.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
