Lynch-McGrath SIGNATURE PAGE TO RELEASE OF EASEMENT Cross References: Instrument No. 2020061588 Instrument No. 9709752192 PARTIAL RELEASE OF EASEMENT This PARTIAL RELEASE OF EASEMENT (this “Release”) is made as of the day of , 2024, by THE CITY OF CARMEL, INDIANA (the “City”). WITNESSETH: WHEREAS, Michael and Mary Kinney are the owners of certain real estate located in the City of Carmel, Hamilton County, Indiana pursuant to a certain Warranty Deed recorded on September 8, 2020 as Instrument Number 2020061588 in the Office of the Recorder of Hamilton County, Indiana (the "Real Estate"); WHEREAS, the Real Estate is subject to a certain Grant of Easement recorded in the Office of the Recorder of Hamilton County, Indiana as instrument No. 9709752192 (the "Easement"); WHEREAS, the City wishes to disclaim, waive, terminate, release and relinquish any rights and interests it may have to use the Landscaping portion of the Easement. The Drainage Easement remains in place. NOW, THEREFORE, in consideration of the foregoing premises and the mutual agreements hereinafter contained, the parties agree as follows: 1. Recitals. The foregoing recitals are hereby affirmed by the City and incorporated herein. 2. Release and Termination. The City, as the benefitted party, hereby disclaims, waives, terminates, releases and relinquishes any rights and interests it has or may have in and to the Landscaping Easement, and declares that the Landscape Easement is EXTINGUISHED in all respects as of the date hereof. 3. Authority. The undersigned executing this Release certifies that he or she is duly authorized and empowered to execute and deliver this Release.
