SURVEYOR'S REPORTThe topographic data was gathered using survey grade GPS and standard radial surveying techniqueswith an electronic instrument with data collector. Elevations on hard surfaces or structures are accurateto within 0.05 feet; elevations on natural surfaces are accurate to within 0.1 feet on the date on which theelevations were obtained; however, changes in elevations can occur due to soils swell and subsidence,freeze thaw cycles, and wind and water erosion. The magnitude of these changes depends upon soilstypes, seasonal changes, and the frequency and intensity of wind, rain, and snow events. It isrecommended that if the topographic data is to be used for planning or design purposes that a check ofelevations be performed prior to any construction activity. Contours are plotted based upon interpolationof the spot elevations shown hereon and are generally accurate to within one-half of the contour intervaldepicted. The following paragraphs are observations and opinions regarding the uncertainties in thelocations of monuments both found and set, record documents and the deed lines as established orreestablished by this survey, and as introduced by probable random errors in the measurements madedue to the instrumentation and techniques employed (relative positional accuracy). The survey may showdifferences between the deed (D) and measured (M) dimensions along the deed lines. There may bedifferences between lines of occupation (possession) and the deed lines as shown on this survey. MONUMENTSMonuments were set or found during the course of this survey, those set in the ground are 5/8" rebar withyellow plastic caps stamped "WEIHE ENGR 0012", unless otherwise noted. Monuments set in hardsurfaced areas, such as asphalt, are as indicated on the drawing and have a washer stamped "WEIHEENGR 0012" where possible. There may be 5/8" rebar with red plastic caps stamped "TRAVERSE",wooden stakes, or spike nails found on or near the subject real estate. These are working points andshould not be confused with monuments marking the boundaries of the subject property. Monumentsfound at or near the deed corners, or along the deed lines of the subject real estate are indicated on thedrawing. Because the difference is deemed insignificant, monuments were not set in those cases wherea found monument was not in exact agreement with this survey, but within the tolerances required for acertain Class of survey. The difference may be shown on the survey to accentuate the uncertainty of thatmonument. In those cases where the difference is greater than the relative positional accuracy oruncertainty in controlling monuments, caution should be exercised before making any improvementsalong the lines affected. Those uncertainties considered to be significant are discussed below. Themonuments established at the corners of the subject real estate are within the acceptable relativepositional specifications for an Urban Survey, 0.07 feet + 50 ppm as defined in 865 IAC 1-12-7.All quarter corner and sixteenth corner monuments in this quarter section have been obliterated due toreconstruction of the surrounding road ways or construction activities related to the development of areasubdivisions. Excavating the locations of the corners would be a futile endeavor because saidconstruction activities disturbed the land and road beds deep enough that any monuments would havebeen removed. Rather than rely on some mathematical solution to reestablish the obliterated corners,where the math solution would surely disagree with existing property lines and other monuments, Iretraced previous surveys and plat work to reestablish the corners locations.Stoepplewerth performed many surveys in the area including the original surveys for the subject propertyand adjoining Jackson's Grant Subdivision. Within Jackson's Grant Subdivision, aluminum disks werefound at the intersections and changes of direction of the centerlines of the streets. These are controllingmonuments for the reestablishment of lots within the subdivision. of the fifteen nearest monuments onlythree were found to be at or a little more than 0.1 foot of where the dimensions shown on the platsindicated they would be found. The standard deviation in all monuments was 0.01 foot in the northdirection and 0.03 foot in the east direction. THEORY OF LOCATIONThe subject real estate is described by metes and bounds. These types of descriptions make "calls",which are references to record, natural, or artificial monuments at the corners; and record, natural orcultural boundary lines. The most common method is to recite the direction and length of each line asone would walk around the perimeter of the property. The following are observations relative to thosecontrolling monuments and calls as referenced in the description.I used the above monuments to "back out" of the subdivision and extend lines by record bearing anddistance to the needed quarter corner and sixteenth corner monuments. Since the original survey andsurrounding plats were all based on the same datum there was no need to adjust the lines of the subjectproperty to any other datum or change the calls identified in the descriptions. COMMON TITLE LINESInformation regarding the ownership of the subject real estate or adjoining parcels is that as shown inlocal government records, or as furnished by others. A comparison was made between the deed calls ofthe subject real estate and those adjoining parcels with common lines with the surveyed parcel and nodiscrepancies were found. OCCUPATION ALONG DEED LINESOccupation means some observable improvement either man made or a natural barrier manipulated byman to delineate the property line. It should be noted that not all fences are erected to define propertylines and caution is warranted before accepting this type of barrier as such. One should also be awarethat when these types of occupation are not in agreement with deed lines certain unwritten rights mayexist over the land between them. Those parties relying on the survey should assume that the uncertaintyof ownership of these areas where occupation lines and deed lines are not in coincidence is, at least,equal to the magnitude of the difference. Unless otherwise noted or shown on the survey, there is novisible evidence of occupation (possession) along the deed lines of the subject real estate.Parcel 1:Clay Center Road, a public thoroughfare, runs along the entire west side of the parcel. There are publicutilities running along the west side of the road. At the time of the survey no documentation for the widthof the right of way was found or furnished to the surveyor. An intermittent tree row meanders along thenorth line. Several capped rebar were found on the line at the lot corners of the adjoining Jackson's GrantSubdivision. An asphalt pedestrian path is located north of line, running across the south side of the lotsin Jackson's Grant. There is no visible evidence of occupation along the easterly lines common withParcel 2. There is a driveway with fences, an electric gate, underground electric and a speaker boxrunning across the south end of the parcel. There is an access easement in place (Instrument No.2014001579) that allows these improvements to exist until certain "Relocation Work" by the school takesplace. There is a woven wire fence extending northerly from the adjoining property to 63.1 feet to 73.8feet into the property. It should be noted that the adjoining south properties as well as the surveyedproperty were all under the same ownership at one time and the fences are probably from that era andnot intended to demarcate deed lines.Parcel 2:An intermittent tree row meanders along the north line. Several capped rebar were found on the line atthe lot corners of the adjoining Jackson's Grant Subdivision. An asphalt pedestrian path is located northof line, running across the south side of the lots in Jackson's Grant. There is no visible evidence ofoccupation along the northeasterly line or the westerly lines common with Parcel 1. A farm type fenceruns from 2.8 to 4.1 feet north of the south line. An intermittent farm type fence runs from on line to asmuch as 2.9 feet east of the east line. The curbing, asphalt and apart of a concrete sidewalk alongDomino Drive extend across the east line by as much as 2.2 feet. EXCEPTIONS/EASEMENTSNo title commitment for the subject real estate or adjoining parcels was provided; therefore, items suchas easements or other exceptions commonly found in title commitments or policies, which may or maynot affect the property, are not shown. If additional information is required to be shown on the survey,please provide me with the appropriate documentation.
