Dear Mr. Moriarity,
The Carmel Plan Commission Commercial Committee took the following action at its December 6, 2022, meeting
regarding design approval for a building addition and remodel to the former Williams Comfort Air building for a new
fitness facility. The site is located at 1077 3rd Avenue SW. It is zoned I-1/Industrial and is not located within any overlay
district.
APPROVED with CONDITIONS: PZ-2022-00190 ADLS Amendment: Ozwell Fitness & Wellness Center
CONDITIONS: Petitioner receives Variance approval from the BZA for signage overages
In order to assist the Department’s review, please attach a copy of this letter when submitting application for any permits
regarding the improvements contained within this approval.

Re: BZA Docket Nos. PZ-2024-00111 V to -00112 V: Ozwell Fitness Sign Variances.
Dear Ms. Roberts,
At the meeting held on Monday, July 22, 2024, the Carmel Board of Zoning Appeals took the following action
regarding the Development Standards Variance (V) requests filed by you for the property located 1077 3rd Ave.
SW:
APPROVED with CONDITIONS: Ozwell Fitness Sign Variances - Development Standards Variance
approvals for:
• PZ-2024-00111 V: Wall Sign – 70% of tenant’s Spandrel Panel height allowed, 82% granted.
• PZ-2024-00112 V: 1 sign allowed per street frontage, 2 granted (1 existing wall sign, 1 proposed
ground sign granted).
• CONDITIONS: The Petitioner addresses all remaining review comments in ProjectDox, and the
Petitioner also completes street right of way dedication, sidewalk installation (or payment into the
Thoroughfare Fund), and receives a final Certificate of Occupancy.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approvals are valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is July 22, 2027.
Please include a copy of this letter with any permit application.
