Old Business
1. Docket No. PZ-2023-00014 PUD: Andrews PUD Rezone
The applicant seeks PUD/Planned Unit Development rezone approval to allow a new neighborhood
consisting of 30 single-family dwellings. The site is located at 4411 E. 146 th St. and is zoned R1/Residence.
Filed by Jim Shinaver and Jon Dobosiewicz of Nelson & Frankenberger on behalf of Schafer
Development, LLC.
Petitioner: Jon Dobosiewicz:
• Original proposal included 60 units of duplexes and townhomes, while the finalized plan includes only 30 single
family detached units.
• Proposed community amenities still include a dog park and community gardens adjacent to 146th Street. A pond
overlook was also added to the plan as well as programming for the internal common area consisting of a path and
benches.
• Predicted price point of between $700,000 and $750,000 dollars per unit.
• The PUD consists of customized design standards to ensure all homes are attractive and vary in design.
• The entrance to the PUD off of 146th Street was angled to create another intersection to help slow down and calm
traffic, as well as the addition of a speedbump on the south end of the project. A stub street to the east was also
added to the project.
• All elevations of the dwellings will now have masonry as opposed to the original concept design having it only on
front elevations.
• Minimum of three different floorplans with four different elevations for the neighborhood.
• Enhanced buffer yards and street tree plantings were added to the plan. A thirty foot buffer yard with tree
preservation and fifty foot building setback is present on the lots on the southern edge of the development.
• Requirement to advise and fine trade vendors for violating access restrictions during building development on the
lots. Access for construction-related traffic is to be limited to the 146th Street entrance.
Residential Committee Recap: Jeff Hill:
• The committee spent the last few months working with the petitioner on items such as the stub street, common
area programing, reconfiguration of the street network for traffic calming purposes, construction traffic
mitigation, landscape buffering increases, and anti-monotony.
• The committee provided a 4-0 positive recommendation to the full Plan Commission.
Department Report: Alexia Lopez
• The largest change throughout the process was transformation of use from two story townhomes and duplexes to
two story, single family, three car garage homes.
• Architectural requirement improvements to include masonry on all sides, minimum of 5 homes with porches
project further than the garage, all porches will be 6 feet deep or 80 sq. ft.
• Added landscaping to common area. Minimum of 10 native trees per acre of open space common area.
• Recommended positive approval to the City Council.
Committee Comments:
Buckler: This has been before the committee on several occasions. Significant changes to the betterment of the project
have been made and to the delight of the surrounding neighbors. I would therefore commend the developer. I am sure it is
not as lucrative a project as your original plan was. I still think it is a lucrative project that meets the needs of the
developer and neighbors. I just want to thank everyone involved for their attention to all comments and concerns. I think
the end product is very telling about how diligent everyone was to come up with such a good project.
Campagna: Did we get confirmation from Engineering about the speed hump?
Lopez: I did not follow up with him [City Engineer]. It’s in the PUD but it does defer to the Engineering department I
think for the final approvement of that.

Kirsh: We can request it [the speed hump] in the PUD but we can’t make the City Engineer put it in.
Hill: It’s in the PUD, if there is a requirement there is a mechanism for it to be implemented if so chosen.
Kirsh: I think what Commissioner Hill is tipping his hat at, is there federal law? There is at least state law that you got to
jump through a lot of hoops to get a speed hump in. So maybe the PUD is a mechanism to pass some of those hurdles. We
just can’t promise the speed hump, we can only request it.
A Motion made by Buckler and seconded by Campagna to provide a favorable recommendation to the Council for
Docket No. PZ-2023-00014 PUD: Andrews PUD Rezone
Approved 5-0, Abstain: Coleman, Absent: Minnaar and Westermeier
