This variance request will allow for a building/tenant
sign to be moved and to restore visibility of the sign
location as the current approved sign location is now
blocked by the new Republic Airlines HQ 7 story
structured parking garage. The current approved
location is not visible from any contiguous roadway
or from US31 as it was initially intended.

FINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE
CARMEL ADVISORY BOARD OF ZONING APPEALS

Petitioner: Encore on Penn LLC, Mark Zukerman
The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
It is simply moving the sign location from the West facing side of the building to the South facing side of the building
due to a new 7 story garage built immediately in front of the current sign. No additional signage is being requested.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
All of the surrounding buildings have signage that is visible as well.
The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
The current West facing sign location is nearly 100% blocked by the new Republic Airlines Headquarters 7 story
parking garage.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
