(david@barkerlaw-in.com) DATE: June 14, 2024 RE: Build-out of Buffalouie’s at 43 West Main Street, Carmel, IN 46032 (“Buffalouie’s) As a follow-up to our onsite meeting at Buffalouie’s, please review, process and approve the following commitments with respect to the pending ADLS Permit (“Commitments”): 1. See updated Architectural Drawings with supporting documentation (see layers to right on computer screen) as prepared by Michael E. Stanula on June 3, 2024. Please note the detail of the cooler block wall screening which will be eleven (11) feet in height and painted white with black accents to match the west side of the building. At the south end of the block wall screening, there will be gates commensurate with retail standards and as shown on the attached drawing, i.e., PVC white gates. In addition, the drawing reflects the outdoor patio area with a two (2) rail white PVC fence three (3) feet in height and containing two (2) five (5) foot single swing gates with closing hinges and gate stops; 2. See updated drawing from K and K Fence Co., Inc. with respect to the outdoor seating area; 3. The current gas meter will stay in place and white PVC screening will be placed around said meter approximately five (5) feet in height to visibly screen said meter; 4. The rooftop HVAC units will be completely screened with solid white PVC panels on all four (4) sides of said units; 5. The electrical meters currently located on the west building will be relocated to the east building away from the outdoor seating area; and, 2 6. On the north side of the building, the two (2) sections of the façade that currently have shake shingle wood inserts will be replaced with solid brick and painted white to match the rest of the building. Please accept the above Commitments to hopefully address all final issues with respect to the ADLS permitting process. As always, your anticipated cooperation is greatly appreciated.
