LEGAL DESCRIPTION
Apart of Lots 128, 129, 130, 131 and 132 in Orin Jessup Land Company's First Addition,
an addition to the Town of Home Place, Indiana, the pat of which is recorded in Deed Record
103, page 21, in the Office of the Recorder of Hamilton County, Indiana.
The property is zoned B-2 that permits automobile sales and service. The Home Place
Overlay (HP-OL) District § 3.01 prohibits auto sales
8. The Board of Zoning Appeals at its meeting February 25, 2019 approved Use Variance
(Docket Number 1812-001OV) with a two-year time limit that was administratively
extended by the Department on March 3, 2021. The Board of Zoning Appeals on August
23, 2021 extended the Use Variance for an additional three (3) years to August 23, 2024.
The Letter of Grant is attached hereto. The Petitioner requests that the Use Variance be
renewed for an additional three-year time period pursuant to UDO Article 9.15.

Dear Mr. Coots:
At the meeting held on Monday, August 23, 2021 the Carmel Advisory Board of Zoning Appeals took the following action
regarding the Use Variance (UV) request filed by you for the property located at 10601 N. College Avenue:
APPROVED with Conditions: Docket No. PZ-2021-00135 UV, Use Variance approval for Prohibited Uses in Overlay,
Automobile Sales & Display granted with the Conditions of a three (3) year time limit and dedicating additional street
right of way for the roundabout (if needed).
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Use Variance approval is
valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written
request for a one-time, six-month extension of the approval must have been received and approval granted by this Department.
The expiration date of this use variance is August 23, 2024.
Please include a copy of this letter with any permit application.
