The property is zoned B-2 that permits automobile sales and service. The Home Place Overlay (HP-OL) District § 3.01 prohibits auto sales 8. The Board of Zoning Appeals at its meeting February 25, 2019 approved Use Variance (Docket Number 1812-001OV) with a two-year time limit that was administratively extended by the Department on March 3, 2021. The Board of Zoning Appeals on August 23, 2021 extended the Use Variance for an additional three (3) years to August 23, 2024. The Letter of Grant is attached hereto. College Avenue: APPROVED with Conditions: Docket No. PZ-2021-00135 UV, Use Variance approval for Prohibited Uses in Overlay, Automobile Sales & Display granted with the Conditions of a three (3) year time limit and dedicating additional street right of way for the roundabout (if needed). Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Use Variance approval is valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received and approval granted by this Department.
