The applicant seeks the following variance approval for the height of a newly constructed barn: 1. Docket No. PZ-2024-00116 V UDO Section 2.04 Maximum 18-ft accessory building height allowed; 23-ft requested. The 5.38-acre site is located at 10500 – 10520 Shelborne Road. It is zoned S1/Residence. Filed by Stephen & Sandra Jenison, owners. General Info: • The Petitioner seeks approval for a new pole barn accessory building with a 40’ by 48’ footprint. • Variance is needed for building height. • The site is not located in any subdivision; so, HOA (Homeowner’s Association) approval is not needed. • Surrounding this site are single family residential homes on large lots. • The pending accessory building permit is B-2024-00889. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Accessory Building Height- • The UDO definition for Building Height is: The vertical distance from the lot ground level to the highest point of the roof for a flat roof, to the deck line of a mansard roof, and to the mean height between eaves and ridges for gable, hip and gambrel roofs. • In this case, the requested accessory building height is 22’3”, when only a maximum of 18’ is allowed. This is a variance of 4 feet, or a 22% change. • The proposed detached accessory building will be used for storing an RV motor home. • The pole barn will have a metal roof and metal siding, with shades of tan-gray. • The structure will be setback approximately 20’ from the south property line and 40’ from the west property line. (The minimum allowed setback is 5-ft for an accessory structure.) • The structure will sit close to 400 feet back from Shelborne Rd. Remaining Review Comments: • All planning/zoning review comments have been addressed. Final Comments: • The Planning Dept. supports the variance request, since it will be set back very far from the street and be located at least 170 from the nearest home. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
