The applicant seeks the following variance approval for a building addition on a corner lot: 6. Docket No. PZ-2024-00126 V UDO Section 2.06 Minimum 35-ft minimum front yard setback required; 25-ft requested. The 1.08-acre site is located at 59 Bennett Rd. (Village of Mt. Carmel, Lot 27). It is zoned S2/Residence. Filed by Louis & Rebecca Paiz, owners. General Info: • The Petitioner seeks approval for a house addition. • Variance is needed for front yard building setback. • The site is located in the Village of Mt. Carmel subdivision; however, there is not an active HOA (Homeowner’s Association). • The lot is a Corner Lot with two front yards – one on Bennett Rd. and one on Village Drive East. • The subdivision plat shows a platted 50-ft building setback along both street frontages. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Front Yard Setback - • The UDO requires a minimum 35-ft front yard building setback for S2-zoned lots. • A 25-ft front yard setback is proposed along Village Drive East. This is a variance of 10-ft, or 29% change. • The house addition’s exterior colors and materials will match the existing house’s as close as possible. • The rear of the lot is encumbered by a 75-ft wide gas pipeline easement. Remaining Review Comments: • All planning/zoning review comments has been addressed. Final Comments: • The Planning Dept. supports the variance request, since the rear of the site is encumbered by a very wide gas pipeline easement, it limits which direction the house can expand. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
