CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, AUGUST 26, 2024
(V) Pudhota Residence, Sunroom Addition Variance.
The applicant seeks the following development standards variance approval for a sunroom with deck:
8. Docket No. PZ-2024-00129 V UDO Section 2.04 35% maximum lot cover allowed; 39%
requested.
9. WITHDRAWN - Docket No. PZ-2024-00131 V UDO Section 2.04 20-ft rear yard
setback required; 19-ft requested. The site is located at 3361 Shelborne Woods Pkwy (Woods at
Shelborne, Lot 83). It is zoned S1/Residence. Filed by Rajesh Pudhota, owner.
General Info:
• The Petitioner seeks approval for a building addition, concrete patio, and raised patio deck addition.
• Some grading of land in the backyard is also proposed.
• Variance is requested for exceeding lot coverage.
• The site is located in Woods at Shelborne subdivision; HOA (Homeowner’s Association) approval is done.
• Surrounding this site are single family residential homes and Common Area green space.
• The pending accessory building permit is B-2024-00998.

Variance Requested:
Lot Coverage -
• The UDO requires a maximum 35% lot coverage, and 39% is requested. This is a 4% variance.
• The house addition and wooden deck addition will not encroach into the 20-ft wide rear drainage easement
that runs along the back of the lot.
• The proposed design and materials of the building additions will complement the existing house.
Remaining Review Comments:
• All planning/zoning review comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request, since it is a small increase in lot coverage and since the
Carmel Engineering Dept. has no concerns, either.
• Petitioner should work with the Carmel Engineering Dept. to gain approvals for any earthwork and grading
in the back yard, especially in/near the drainage easement.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
