Re: BZA Docket No. PZ-2024-00124 V: Pegues Pool Setback Variance
Dear Mr. & Mrs. Pegues:
At the meeting held on Monday, August 27, 2024, the Carmel Board of Zoning Appeals Hearing Officer took the
following action regarding the Development Standards Variance (V) request filed by you for the property located at
14406 Marsdale Place:
APPROVED with CONDITIONS: Pegues Pool Setback Variance - Development Standards Variance approval
for: Swimming Pool & Equipment be located a minimum 3’ setback from easements required, 3-ft
encroachment into easement granted.
CONDITIONS:
• Receive easement encroachment approvals from the Carmel Board of Public Works & Safety (BPW)
via the Carmel Engineering Dept. (work with Jarrod Huff), as well as from the Hamilton County
Drainage Board (via the Hamilton County Surveyor’s Office (work with Sam Clark).
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is August 26,
2027.
Please include a copy of this letter with any permit application.
