Cover Sheet/Memo regarding Docket #PZ-2024-000143-000145V
This is a Public Hearing before the Carmel Board of Zoning Appeals Hearing Officer
Docket #PZ-2024-000143-000145V, regarding property address of 10367 Woodhall Lane,
Carmel, IN 46032, requesting the following variances:
1. Front yard setback of 25 feet instead of the allowed 30 feet.
2. 41% of lot coverage instead of the allowed 35%.
3. Side-yard setback of 6.7 feet aggregate of 18.9 feet instead of the allowed minimum.
Real estate affect by application is: Acreage .44 Section 9, Township 17, Range 3
WOODHALL LANE Lot 5 Irregular Shape.
These requested variances are unopposed and the Homeowners and the Homeowners
Association have all expressly agreed to the requested variances.
Statement of Request
We request the following variances for 10367 Woodhall Lane, Carmel, IN 46032:
1. Front yard setback of 25 feet instead of the allowed 30 feet.
2. 41% of lot coverage instead of the allowed 35%.
3. Side-yard set back of 6.7 feet aggregate 18.9 feet instead of the allowed minimum.
Statement of Support
The unique nature of this development, 100 ft. common space buffer behind all the lots on the
east side of the development, resulted in lots with little depth. This aspect combined with the
irregular shape of lot #5 makes it impossible to build a home on lot #5 that would be consistent
in size and quality of the existing homes in the development unless our requested variances are
allowed. Additionally, the HOA’s requirements for the size of the home add additional
challenges.
Due to the large amount of common space surrounding lot #5, the granting of the requested
variances will have no impact on any other current or future homeowner. These variances will
also allow us to build a home that will fit in with the manner of the other homes already in the
development.
Our only adjoining neighbor, Dave Irish, who is also the President of the Woodhall Lane’s HOA,
agrees to the granting of these requested variances.
1. Section of UDO being varied from: UDO Section 2.04: Minimum 30 ft. front yard
building setback allowed, 25 ft. requested.
The unique nature of the development resulted in all the existing homes being granted a 25
ft. setback. This is a development of 9 lots, and 4 homes have been completed and 1 home is
substantially completed.
Allowing our request for a 25 ft. front yard setback will allow our home to be better
integrated into the neighborhood. We only have one adjoining neighbor, Dave Irish.
Common Space and a pond are on the other side of our lot.
2. Section of UDO being varied from: UDO Section 2.04 Maximum 35% lot coverage
allowed, 41% requested.
Almost all of the homes in Woodhall Lane have been granted more than the maximum of
35% lot coverage with some as high as 52% (Dave Irish’s home). This requested variance is
needed to allow us to build a home that meets the HOA’s requirement, and one that fits into
the esthetics of the neighborhood created by the existing homes.
Due to the large amount of common space surrounding our home, the granting of the
requested variances will have no impact on any other current or future homeowner.
3. Section of UDO being varied from: UDO Section 2.04 minimum 10 ft. side yard
setback, 20 ft. aggregate; 6.7 ft requested, 18.9 ft requested.
Almost all of the homes in the Woodhall Lane development have been granted similar
variances.
The 6.7 ft. requested setback is on the southside of our lot and is adjoining Common Space
and a pond, so no homes will be built in that area. We exceed the 10 ft. side yard setback
requirement with our only adjoining neighbor, Dave Irish. In fact, most of home is designed
in a manner to provide maximum space between our home and the Irish home.
